      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Is there by any chance a template letter on here to send to Banks asking them not to close accounts??

 

To be honest Liz, they can close accounts without giving a reason, so if they ask you to close them, there's not really anything you can do!!

 

My bank asked me to close my accounts just beacause I applied for another current account for my DD's to go out of and they didn't like what was on my credit file - they gave me no reason and I'd never been charged, nor had a balance below £100 in that account!!

 

Strrange these banks, very strange....

Seems to be more of these banks "cherry picking" their customers?? It's really unfair isn't it?

So long as they bear in mind the A & L were hammered recently for retaliatory closure of an account. Only £125, but it's the publicity that hurts.

 

Mind you, A & L were great with us. Several redundancies and a major illness, and they couldn't have been nicer. Suspended mortgage account until things gor better, no penalties, repay outstanding over the term of the mortgage with no interest accruing. No problem raising a new mortgage after a redundacy which allowed a couple of CCJ's to creep in. I almost felt guilty when I remortgaed last year just for a better rate. Sometimes, individuals in an organisation just seem to buck the trend. Our local manager was just fantastic.

It is indeed Lizzie.....but it backfires in the end; I fight them and fight until they either reverse their decision (as has happened with another bank) or cost them loads by getting the Ombudsman involved (costs the banks around £300 for each complaint they deal with) and make the media aware.......it is really unfair beacuse it causes so much stress.....

 

If a shop committed a criminal offence and caused customers harm, they would not be allowed to give them an "injunction" notice stopping them from entering the premises - same principle, but the banks get away with it.......would it not class as some sort of discrimination?

That's nice to hear when they are good like that isn't it??

 

Total opposite to how Abbey were with us when hubby got made redundant - they piled charges so high it was unbelieveable. They'd then through the unpaid DD's voided the life/paymentcare policies we'd spent years paying into, the mortgage cover was voided too etc.. all because of charges being taken. Obviously because of this we had got no payment protection to pay bills and cover the income loss as we'd always paid into!! So we got into a "big mess" had no alternative but to remortgage with them at a higher rate because we "wasn't squeeky clean customers anymore" and we didn't deserve the rate we were on so had to swap to a higher rate mortgage with them losing the "fixed rate" we were on!! So now we have a few defaults coming home to roost because the PPI's didn't pay out on cards with thanks to Abbey clogging our accounts with charges - they do make me "mutter"!!!

 

Shame these banks can't be nice about things and look after their customers isn't it? Instead they make what is a difficult situation so much worse than it is already?

Blame it on GB and his so called economic miricale giving the banks self regulatory power so they don't have any set procedures and make the rules to suit themselves.Well the miricale has turned into a disaster I know of at least a dozen of my friends who have filed for bankruptcy because they are constantly being squeezed by the finiancial institutions.And being a responsible parent of two teenage boys I think to myself if it's bad now what is it going to be like for them when they get older.

I agree, do you not think thought that things are going to change and the industry is going to have its come-uppence?

 

It's going to have it's come uppence in a very big way and on a scale that even the people at the top won't be able to survive with.The tide is starting to turn people are not putting up with being bullied by the banks anymore.People are no longer bothered about CCJ's against them or bankruptcy which years ago were frowned upon that is the culture of today and it's not only the young but old alike.

I totally agree as a parent of two teenage sons myself - these lads don't stand a chance the way these institutions are behaving.

No, and it's probably our fault. I don't think they quite expected the backlash that has occurred since these guys set this site up. It's too late for them to stem the flood from their old mistakes, but I'm sure they'll be adhering pretty much to the letter of the law pretty soon. And maybe it's no bad thing, so long as the consumer is made increasingly aware of his rights. After all, the CCA s there to protect US.

 

Scuse me, but I've lost the thread of what I was on about. I took the advice of someone on one of the threads and had a few sherbets tonight. I've the attention span of a goldfish at the moment.

They can beef up their legal teams as much as they like because it isn't going to make the slightest bit of difference.At the end of the day they are in a position where they can't do jack.It is getting to the point where DCA's are trying to bully people into paying who guinuinly can't are now sticking two fingers up to them.If they come to the door people just tell them to f off or have them nicked for tresspassing.If they get heavy then people are getting heavy(hope your reading this Ken).All in all it is a complete breakdown and the blame must be laid firmly against the banks.

For the MIB when they come back, I discovered something today which I am not happy about, it involves unlawfully applied defaults causing me a problem.

 

Once I finish clearing up a couple of long winded cases the eye of tam is turning to you with a vengance.

Congratulations people on a great thread. I have resisted posting while I have tried to catch up from the beginning – but have failed! I have printed off 10 pages a day at work for the last two and half weeks and then read all the posts on the train home (an hour’s journey). I am on page 113 so hopefully sometime next week I will catch up completely and will be reading this! Lol

It took us abotu 3 months to reach 100 pages and about 2 weeks to add another 34 to it so its a fast moving discussion :)

Right having said hello, a post which hopefully you can help me with.

I wrote to a DCA (13FEB07) and requested a copy of the CCA and the deed of assignment from EGG to them. They have written back “we will contact our client and request the relevant information” !!!!

Would I be right in thinking that they have no right to contact me without the deed of assignment and CCA in their possession?

Further they have cashed my £1 cheque for the CCA request. That can not be right either surely as they don’t have the document to send me.

I want to write back and tell them that if they contact me again with anything but the CCA and deed of assignment it is harassment – further I want my pound back (its not the money it is the principle). Also have they broken any laws or rules?

Finally I wrote on the same day to EGG and requested my CCA and any deed of assignment from them as well. They too have cashed the £1 cheque on the same day – no reply from them so far.

The DCA will always have to refer a CCA request back to the original creditor because they are stupid enough to buy a debt without the paperwork.

 

Forget the £1 you sent, thats a statutory fee payable with the request.

 

Alos only one of them has to respond as you made 2 requests within a month of each other. As the DCA is handling your account I would have left it with them as they are more likely to exceed the time limits allowed :D
