    • I see you said you tried to stop the DD but it seems that didn't work. May I please ask why that didn't work? You should be asking your bank to cancel the DD and I don't see why they would have objected, hopefully you can clarify this. I agree that you should be making a claim here against your bank and ask them for a DD refund. There is no timeframes for this.

    • Yeah That's correct. We left rent payment coming out of his bank account from January 2023 - August 2023 until we could find somewhere to sort out his belongings which was fine. I tried to give notice a few times from August 2023 asking for advice from Sanctuary housing how we went about this explaining his condition and that he was in a Nursing home from December 2022. I explained we don't have any legal powers to his account like POT but were in the process of going for Deputyship and that I was the named person to act on his behalf to speak with Santuary housing. I said we could provide details of his condition and proof he was now in a nursing home with date he moved in. This went ignored despite repeated attempts to contact them until a housing manager contacted us end of February 2024 and notice was finally accepted with his tenancy coming to an end March 22 2024. Although they have continued to take rental payments for the flat despite someone else living in it from the 1st April. I wasn't aware payments were still being taken till I checked his May banks statements. I had asked them to back date rental payments to August 2023 when I gave notice rather than just giving notice in March 2024 but they've ignored that bit. I don't see why they shouldn't give it back they've taken money they shouldn't have.

    • Hello, Just to check I understand things right, he moved to a nursing home, you then kept paying the rent for a period of time whilst you sorted his belongings. You have asked to give notice and asked for backdated payments of rent from when you first asked which went ignored? They are still taking rent payments.   Have I understood correct?   If I've got anything wrong please correct me.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Ok, I know absolutely nothing about the way Banks and loans and whatnot work so I may come across as an idiot here but basically, I've just left Uni and as such, had Student Debit account with my bank Natwest.

 

As I understand it, the Student Loans and Grants I took out for the three years were a set sum put into my account, if I have no Money I have nothing to spend but somehow I've got a £300 debt up somehow and I first knew about it when Moorcroft first sent a letter to me saying I should ring up and set up a Payment Plan in the next 7 days. I handed the letter to my Mum who said she'd sort it but it seems she didn't as I've got another letter a few days ago saying because I didn't respond by agreeing to pay an acceptable lump sum I have 14 days to contact them or face court action.

 

But I have less than £100 in my account and I haven't even got a job yet, I simply cannot pay it in time.

 

Am I in serious trouble here? I'm too scared to contact them because I know I will fold under their bullying tactics, what are my options here?

Don't worry yourself unnecessarily. Moorcroft are bully boys but whilst they may huff and puff there is almost certainly no intent to take you to Court. They would not be able to in any case unless they OWN the debt, so have you had anything from Natwest which would suggest that they do?

 

Never EVER phone Moorcroft. Insist that everything is dealt with in writing, and start by writing to ask them to prove the debt. You might also send a SAR to Natwest to establish how the amount has been arrived at - you may not owe what they are claiming anyway! This will at least allow you time to find out where you are and decide what to do. If you agree that the debt is owed, then you can only pay what you can afford and even if this is only £1 a month, then that is all that they will get from you and there is not a thing they can do about it!

 

Send everything Recorded Delivery and stop worrying. No doubt you have had letters from Moorcroft's mythical 'Pre-Court Division'. This is simply one desk away from the 'Home Collections Division' and in reality are simply different letterheads to exert differing degrees of pressure!

Any advice given is done so on the assumption that recipients will also take professional advice where appropriate.

I don't recall any letters from Natwest telling me I had this debt, that's why I was so shocked at the letter from Moorcroft, the first letter they sent (Which I can't seem to find >_

 

I went into Natwest with the first letter as soon as I got it but the woman said if they sent it then I need to deal with them.

 

And the problem is I don't have a job, don't I need a regular income to set up a payment plan of even £1 a month or they're just going to say that hen I run out of money I have now then I can't fulfill the payment plan.

 

I'm pretty worried about this, lets just say they do own the debt and I don't manage to sort this out in their 14 day deadline next week, what will happen to me, will bailiffs knock on my mum's door or can I go prison? :(

No you can't go to prison.

 

A collector has no rights to call unless you agree to them doing so.

 

Their 14 day 'deadline' means absolutely nothing.

 

Write and tell them that you dispute the debt, do not acknowledge it and will not communicate further unless they provide information to substantiate their claim. Nothing more than that.

 

Is the account still live with Natwest?

Any advice given is done so on the assumption that recipients will also take professional advice where appropriate.

But for all I know, it's a fair debt, like I said, I don't know squat about banks, if it is all my fault for being ignorant, I do intend to pay I just would like to be given a chance to set myself up.

the slimy collector, if indeed it calls can be told to fu/off. the deadline from a dca is indeed a scare tactic, never ever phone a dca, only in writing, and never ever pay a dca unless they have the correct paper work,,,,,,,,

Hi I agree with the above posters and please remember that DCA's have a habit of sending claims for payment to anyone in the area whose name is anywhere near the person they want this is why we say make the DCA prove that the debt is yours and they have the legal right to collect it. You would be surprised how many times a DCA will pass a debt back to a creditor when challenged.

Yes - I was thinking of papering the kitchen with all the letter re that I have ...

 

Have they breached OFT guidelines on collection?
