Hi

I have not bothered contacting TS as they will only tell me what I already know.

I am just hoping the mix up of the bags is a genuine mistake and my bag is found and in one piece, I can only hope.

I will wait until tomorrow and contact Mr Shah again and let everyone know what has happened.

By law these companies have breached The Supply of Goods & Services Act 1982, where they have failed to deliver the goods for the services they promised and we are entitled to this by consumer law.

I have emailed consumerdirect for the next steps and wont hesitate bringing this matter to court.

Further update

I just had a text message from Mr Shah who said he called Pakistan and has confirmed that my bag is in Lahore and has told me to give him 2 days for the luggage to get to Rawalpindi.... I pray that it's got all the goods I sent.

Quick update, I have spoken with consumerdirect with my case ref number and they have asked me to send 1 more letter, stating the same and as last warning, 14 days to respond. They have also mentioned that this case is also forwarded to the trading standard for review. They have suggested to wait for him to respond and if he doesnt come back to consumerdirect and this might be taken through trading standards, and in worst case via Court. There seems to be some quick turnaround if trading standard take this case. I will keep everyone informed, and has prepared the second letter, will send by register RM tomorrow.

That is good news.

Of course we know that Consumer Direct do want to see that you have exhausted all avenues before they will escalate things,so its important to have a paper trail of your efforts.

I think you will find that Trading Standards will be more able to get some results and especially so if this person or business has come to their notice before.

For those in the Bolton area-which is the home area of the trader,this is much easier for those who have complaints,and I would suggest that anyone in the Bolton area do go in person with originals of any documents and paperwork,where copies will be taken.

There is another avenue failing any results from TS which I will be posting details of here soon.

As per Tracking he has recieved the second letter, no response from him. I tried calling him again and he has barred my number it seems. I called from a different cell and he is not picking up. I SMSd him about the letters and he calls back and askd who I am and whom I want to speak. It was him and when I say Mr Aiyub refund my money or Parcel, he said who is Ayub and disconnected the call. I am 101% sure he is Aiyub, I am not sure what other options are left but this guy is not giving me any room to negotiate despite my umpteen tries. In frustration, I have send an email to BBC watchdog again, and also find some link for Bolton Mayor and Bolton local govt authority and trading standards.

 

Is there anything else which can speed up things?

Sorry for not posting anything sooner.

My luggage has still not reached its destination and I have tried contacting Mr Shah several times but he has not been answering my calls. The last time I heard from him he told me to give him 2 days so I did. Now he is not answering my calls and when I texted him to ask him when the luggage would be getting to rawalpindi. He texted me back saying the luggage was in a warehouse in lahore and I should let them do their job. I have contacted him and texted him nearly everyday since and he is not responding.

Anyway the initial letter I sent him was sent back to me and I have now been told by consumer direct to send him another letter and to get a certificate of posting and if he does not respond to send another letter and that consumer direct will also be getting in touch with Mr Shah. I was also told that he could be taken to court over this.

I have also asked him to give me the address details for the warehouse in lahore but he has not.

I have been through this cycle Samara. I think its a super [problem]. The reality maybe that they have actually lost the package(which seems next to impossible) or they are actually running a bogus [problem] where they actually sell the goods and services in other country or may be the parcel never went its still in UK.

 

Mr Aiyub is doing the same, not picking phone and last time when i called from a diff number, he called back later to check who has called and when I asked is it MR Aiyub, he says who Aiyub and disconnectd the call. I do not think they will respond.

 

You wont believe I have emailed to Bolton council, Trading std and Bolton Mayor as well regarding this business running in this area, I do think the last resort would be the small claims. If you want I can share these email address so that you can do the same and probably things might be picked little faster by the authority.

 

I am again not sure if there is anything left before moving to small claims, I have the signed reciept of the second letter by Aiyub through royal mail tracking and Ill advice you do the same.

 

Martin suggested earlier there is still somthing which can be done before small claims and if he can advice...

I agree Upendra it's a [problem] alright and the luggage has probably either been kept by themselves or sold. Do you think writing to the MP would help?

Anyone wanting to file a claim with this company could do it using MCOL online.

You would need to follow pre action protocols by sending a 14 day letter before action.

Given that it is a limited company the claim would need to be issued against the company itself.

Good that looks promising.

I have still been unable to find anything in relation to the Bolton firm-it is definitely not registered as a Limited Company.

It may be that this guy is or was running it under as a second name under a parent company.

If he was running this business as a sole trader and non limited company,it is possible to sue him individually but you must have a good address for service and be sure he will get it.

He has mentioned the Morrison street address on the leaflet, and his invoice doesn't list any address, I am damn sure this is his home address.

Hi All,

 

Just to give you an update on the company I used. Well it turns out they are genuine as I had a phonecall from someone in Lahore to let me know they had the bag and have told me it should be with my relatives in a few days, he gave me a description of my bag and told me that they had a lot of problems with the shipment and the luggage had been held up in customs for 2 months. I can only complain about their rubbish customer service as they should have kept me upto date with what had been going on instead of ignoring my calls which led me to believe they were [problem] artists.

Upendra, I really hope you and others that have suffered can get Mr Ayub and things go your way and he compensates for your loss

I have some news my relatives received the bag today, well basically after chasing them since the last post on here they finally received it. I am annoyed with their customer service as the last time I spoke to them they told me the bag would be with my relatives within a few days but that didn't happen. I had been trying to get hold of this guy since then but his phone was switched off every time but yesterday I called and was told that he had been told by the owner of Ato Z not to deliver the bag until the wrong bag they sent my relatives had been returned. I was furious at why the hell they couldn't contact me and have told me this. Anyway I told him I didn't want the bag delivered and my cousin would pick it up from him as this was a safer option so address was given and luckily my cousin was in Lahore at the time, they got the other bag couriered and picked up my bag..........phew!!!

I am hoping that Upendra your getting somewhere with your case and things get sorted out promptly for you.
