    • Lolerz - I don't understand you.  Rebuked you?   No. I simply replied to your orange comments with legal facts as I know them.  I've already worked through the s42 and s146 issues - over the last 3-4y - and these issues are (mostly) resolved legally.  In terms of posting evidence.  Sure I can post some.  But my most recent questions have been a) how can I enforce a sale before trial?  And b) how can I make a complaint and/or a claim v receiver? (E.g. to which body do I complain?).  At the mo I'm asking for some helpful pointers on those specific questions??  I'm not asking for help with how to prove or present evidence. Fwiw - all evidence for trial has been disclosed (although additions are poss). The lender sent me like 10,000 emails and docs.  There's also 000s of emails, docs, photos, videos, recordings and texts that relate to freeholders/ me.   I read, filed and categorised everything for ease of future reference.  Witness statements and evidence were prepared for trial in the 42 and 146 matters. (now joined with current claim to save duplication).  I've lived the process before.  My current statement and linked evidence has taken like 6 months to draft/ write - to ensure I can succinctly prove my defence and counterclaim points.   Whether I can convince a judge at trial w/o lawyer / barrister is debatable 🙄   But I've prepared.  And continue to try better prepare - which is why I visit this site (and clinics).  This is NOT my business or expertise at all.  I'm just trying.  Not that anyone should ever have to justify why they need help if they ask politely!

    • It doesn't use the word reconstructed in the cover letter.  Although, I have just noticed on the cover letter they have asked me to complete a financial statement and offer a repayment within the next 10 days, or they will continue to follow court directions.  They sent a separate letter on the same day advising me they will be continuing with their claim ?  They have done the same for both claims.  Is it worth just doing that - doing the financial breakdown and offering a x amount.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I claimed for £2335 (or there abouts) and got the standard letter back saying that the charges were acceptable. Anyway I phoned up to say I wasnt happy and they passed my case for further review. I got a letter on Friday to say that as a gesture of goodwill etc they would deposit £1089.50 into my bank account. Well I am exstatic to have this extra money but dont know whether I should maybe phone and say I am not happy and want the full amount or at lest nearer to the full amount????? I dont know how they came up with the figure they have given me???

Anyone any suggestions as to what I should do? I am a bit scared to o anything in case I come away with nothing!!!!:confused:

I am still at the early stages of my claim as in I'm waiting to recieve the list of charges. Having said that, I have done a lot of research and this seems to be the usual trick they try - as in offering you a lower offer to begin with. If you do not have the time to read through the various treads (which others were in the same situation as you and carried on with their claim and got a better offer) then may I suggest that you get in touch with a member on this site called Perseus, who be able to answer that same question for you. Good luck and keep us posted with the progress. If I were you before callin them (bank) seek advice from this forum as in what to do.;)

Hello,

Can anyone help me as we received a letter from the Halifax stating that the bank charges they lieved from our accounts were just and fair and they will not refund the £ 4,619.00 plus interest at 8% back to us the only letter we have to issue is court action But ? the MOCL dose`nt let you make the claim here in Scotland can anyone help is there a online claiming site for Scotland ??

12th March 2007 - sent S.A.R - (Subject Access Request) and £10 to Halifax.

 

3rd May 2007 - LBA sent to Halifax.

 

15th May 2007 - £2,500 offered over phone (full amount asked for is £5,300) - OFFER DECLINED.

 

17th May 2007 - Filed claim via MCOL.

18th May 2007 - Claim request issued.

 

Notice of Issue received from Court - 22/5/07.

Claim deemed to have been served as of 23/5/07.

Notice of Acknowledgement received from Court - 31/5/07.

Halifax now have until 20th June to file defence or whatever......

After receiving my letter offering settlement of £1089.50 I have just come off the phone to the bank and have settled for £1550 so I am extremely pleased as I wasnt going to take it further as £1089.50 was better than nothing. I just called to ask them how they came up witht he settlement and they advised that it was half of my claim value (less the interest that I had included) I said I probably would accept a settlement if they could increase it and he said the most I can offer would be £1550 so I just accepted!!! Yee ha! Very pleased as the next step was taking it the ombudsman which I dont really have the time or energy to do.

claim settled bank of scotland 3000.00 offered firstly 1510.00 which they put into bank when i called got full total of 3000.00 very pleased with result can now pay back some debts that these charges incurred thanks to all that answered my queries off to sort credit card late payments now !!

Just settled with Bank of Scotland following claim for £1042. They initially refused, then offered £600 after second letter. Phoned to advise them I wouldn't accept this. They asked what I would accept as they 'wouldn't pay full amount'. Advised them I'd only settle for the full amount. Was put on hold whilst 'supervisor' was checked with. Less than a minute later, was advised they would pay full amount. Woo hoo!

Double checked I wasn't agreeing not to go after them for charges on another account (letter ready to print now!). Confirmed this. Money to be with me within 14 days (already given me the £600).

Claimed £299.00 + Int + Court Fee

Settled as above

 

Claim started at the end of February and received the usual fob off letter that all charges are fair etc and we are not offering you anything. Filed MCOL, they acknowledged then sent a letter to say that it was not commercially viable for them to continue with this claim and that they would pay in full. Money in account this morning.

Hi i have just been made an offer of £1342 from the bank of scotland which is slightly more than i asked for but im not complaining, got an email from the fos and they told me that the bank think that there charges are fair but do not want to be investigated further by the fos so will recieve letter tomorrow with aceptance slip and, whoo hooo another victory for the good people out there.

To all consumers who have been ripped off GO DO IT DO IT NOW, if your from scotland get in touch with the fos its an easier route than going to court if your owed more than £750, as you would have to take out more than one court action i did and am now just another statistic in the ever growing campaign to get whats rightfully yours good luck to everybody who has made a claim or is thinking of one.

I did the money claim on-line thing - it was issued on the 11th May, they acknowledged on the 21st then received a letter in the post on Tuesday to say that they were going to settle.

 

I had almost given up hope of every getting anything back as I started the claim back in February.:)

hi dolphin 939 i started the ball rolling back in january which i gave them 8 weeks as stated in my letter nothing so got in touch with the fos who took my claim and after 8 weeks with them got a reply from the bank stating that the charges applied to my account were correct and i would recieve nothing back so i gave the fos there decision and within 3 weeks the fos replied by email saying that they were sorry for the delay and the bank were offering £1342 back rather than letting the fos do an informal investigation so its been longer than some people but im glad i have been succesful and not had to go to court.

hi dolphin939 the fos have sent me a letter today to send back with my acceptance slip for the money so once i send it back then the bank knows i have accepted the money and the fos will back that up dont know when the money will be in my account but have waited this long so another week or so will be a breeze knowing i have won.
