I am in the same position. Halifax have put half of my claim direclty into my account. They are defending the CI element of the claim.

 

Do I pursue this ? I have an AQ to complete but do not want to risk losing the £100 it costs to file it if they are purusing the claim on the basis of the CI element only ???

 

Any help will be appreciated. I have until the 8th June to file the AQ.

Claims:

bgqs v Barclays (Claim No.1) - Claim Issued 16/3/07 Await Defence to be Entered - Data Protection Act Non-Compliance - *WON

 

bgqs v Barclays (Claim No.2) - Prelim Letter Sent (Charges + s.68 Interest) - 16/3/07 - *WON

 

bgqs v Halifax - Prelim Letter Sent (Charges +C.I Interest) - 16/3/07 - *WON

 

*Paid Deposit on New House with my Winnings !

Have you got your own thread? Where is it?

Without reading the details of your case I see a couple of options,

1)you can accept what they have given you and possibly lose out on the interest

2)Fight it for the interest but possibly lose the contractual interest and only get the 8%

Either way you still got the charges back and you should get costs.

I would fight it as they gave in to me the day before the hearing. See earlier in my thread as to wording.(Not jsut mine but others replies

Always remember that I am not an expert and can only give my opinion from my experience.
