Hi

 

I've received a County Court Summons for a payday loan of £100 with Primepayday UK which I took out a couple of months ago and have struggle to pay on time. They have already randomly taken £120 from my bank account, but are now demanding a significantly higher amount which they say is due to interest and late payment fees etc.

 

Do I dispute the whole claim, or part of it or accept the claim and make an offer of payment? Any advice much appreciated. Cheers.

They are demanding £121 plus court fees of £25. I will have access to a scanner on Monday to be able to upload the the papers.

LBA Sent 15.2.2007

Won £1500 on receiving court date..

The Particulars of the Claim are as follows:

 

"The total claim is for £121. This is in respect of a Pay day loan, reference xxxxxx, which was taken out on 11/04/11 and was due to be repaid on 28/04/11. The claim includes the original Loan repayment amount, costs to cover letters, e-mails, telephone calls made, issue of Default Notice along with interest and late payment fee, all these being detailed on the Loan Agreement/Terms and Conditions. A Default Notice was sent on 17/05/11 to which there has been no response despite attempts to resolve the matter by telephone and follow up e-mails. As such, with no repayment plan in place, and no agreeable contact/arrangement with the client, this course of action is now the only option available."

 

There is no mention here of the £120 that has been taken out of my account, and if this claim includes the original loan amount, interest etc then what is the money they have taken for? I've spoken to a couple of people I know about this and I now think I have grounds to dispute the entire claim. I have the evidence on my bank statements!
