Very interesting Les, the estopple defence sounds like complete tosh and an indication of how desperate they are getting!

 

How they can they try and demonstrate they've acted fairly without disclosing their costs in realtion to the ERC?? You've asked for this breakdown on numerous occations before going to court and they are havent provided it!

 

As for the solicitors costs, T&C's - what are they trying to prove? We know what the T&C's were and are not disputing that we agreed to them... Solicitors costs are nowt to do with us.....yawn

12/02 Phone call from SCM enquiring if I would be preapred to settle - I said 50% of ERC, the £82 interest and costs would be acceptable - solicitor agreed that this was reasonable and she would pass on to her client. Great I think, something salvaged.:)

15/02 - Letter received they will not pay ERC, am I aware of cases being lost, and being struck out - they will be making application next week to strike out ERC part of claim and will be after me for costs under indemnity clause on mortgage and unreasonableness. They will however pay the £80, no mention of costs. :(

we too have had a letter from SGH solicitors re our claim againt spml.

 

they are offering me £102 in full and final settlement of claim. (claim for £400)

14/06/06 Data Protection Act Sent to SPML

28/06/06 - Info / statements received from SPML

2/8/06 Pre Lim to SPML for £324.72

16/8/06 LBA to SPML

28/9/06 filed MCOL

defence filing date extended to 22/12/06

28/12/06 copy of defence received from sch

16/01/07 AQ filed with court

Hi,

I claimed for charges relating to unpaid DD, and also part interest they charged me when I closed the account. (they charged full months interest even though the account was paid off on 16th month)

 

we didnt have any ERC,s

They have offered to repay me that bit of my claim - is this what they have offered you?
