Hi,

I am a lone parent on jsa and in receipt of child tax credits.

 

I have a mobile phone contract which i paid for by direct debit.

 

However I missed a couple of payments and my direct debit to 3 was cancelled by my bank.

 

They were unable to take any further payment and notified me and I told them i was having difficulty paying the ammount because of a benefit problem.

 

I said I would try to make payments to clear the arrears and my service was restricted ie. no calls in or out, no emails or texts so I basically couldnt use the phone at all.

 

I paid £25 to them and said I would try to pay the rest.

 

Then I received a letter saying that i owed £62.36 and they were going to take this out of my account by direct debit

but i believed they couldnt because the direct debit had been cancelled by the bank.

 

Today they have taken 62.36 out of my account via direct debit which i dibnt authorise.

 

I now have no money for frrod for me and my daughter for the rest of this week.

 

Surely they should not have been allowed to do this and they have taken my child tax credit payment for this week.

 

I have contacted the bank but they say that 3 didnt know the dd had been cancelled and have tried to take the money again.

 

But why after 2 months of not trying.

 

Is there anything i can do to get this money back

 

if I owed it to them and they set up another direct debit without my permission.

 

Any help would be appreciated.

if the DD was cancelled then the bank should give it you back under the DD guarantee, though they might wriggle as you did receive a letter saying it was going to happen

 

however.

 

as its benefits, i thnk you should try the right of appropriation letter route [ see the library - green tab top left]

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
