      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

can anyone help, about three years ago i stopped using my credit card which i had with Lloyds - i also had three personal accounts and on all of them i was charged ridiculous amounts of money - nearly £400 a month on one account towards the end of my banking with lloyds. The situation i am in is that i am ready to send my SAR on my three acounts but am hoping to include my credit card, i have searched high and low and cannot find any history ie. statements referring to it - i have called the credit card services who said they have no record and i need to go into my branch which i did and they also could find no history and were unable to help even after lenghthy phone calls to the credit card services at the bank.

Does anyone have any details on who i can contact to reclaim my card details so i can include them on my SAR.

The information you require should be included in the data subject access documents when it arrives (are you sure the missing account was with Lloyds?)

many thanks - i will try experian and yes it was definatley Lloyds, at the time i had no other accounts with anyone and the problem is i can not include my card account number on my SAR as i do not know it. - thanks again i will post how i get on.

Hello again - this is turning out to be a nightmare. I have paid for experian and equifax and all that it tells me is that yes i had a card with lloyds but no account information, so yet again i call credit card services - they now tell me that if the account is dorment for 9 months it gets auto closed (my branch disagree) and after 11months all account information is wiped and lost and that there is no way of retrieving it.

i know that this is not legally correct under the data protection act but they are refusing to give me any contact details for anyone who may be able to help as they tell me no one can.

 

Please can anyone help with contact numbers, names and/or adresses of someone who can give me back my credit card account information.

I know you want to do this all on one SAR but if you get your lloyds bank statements first they will show any payments you made to your credit card and it will give you the card number as a reference (it does on mine). If for some reason your statements don't show the card number as a reference ask them to track a payment. Unless you always paid your card in cash it'll be there somewhere. Hope this helps!

Just quote that you want your credit card info and list all relevant addresses you stayed at - they should be able to trace your information and provide it - why pay them £10 twice! Just put something like - Platinum Visa Credit Card. Other people have done this in a SAR and got info back when they didnt know their acct number with other companies so worth a try with Lloyds.

thanks guys since writing the original post i have sent my SAR for the three normal accounts as it was taking so long to sort it out, i think i will wait until the statements come through and see if they shed any light as i think after the calls and chats in branch there is definatley something odd going on - but they cannot be bothered to do anything to help other than stare blankly at their computer screens.

will keep you posted as things unfold
