This has been a concern of mine for some time If I were a banker I would be shreading and burning all records of six years old on a daily basis, so if clients had no copy statements the bank could turn up at court and attempt to put the burden of proof on to the claimant who would struggle unless they had the old copy statements. So today, is Mr Banker is destroying my records from 23 Nov. 2003? Or Has he only destroyed the records up to 27 July 2001 (in order to "comply" with his interpretation of the terms of engagement agreed between OFT and FSA in the on going test case) ?

  4. Well said! Where Have i heard that before? That was said in 1802 ? what will it take for us to heed his warnings?
  5. OK FOS They are not penalties.....so what are they? Fair charges for the service provided ? A reasonable fee reflecting the amount of work involved in "not paying" a DD...how much was I charged for not taking £10 out of the cash point when there were no funds avaliable? Oh yeh £0!! May be they are elephants?
  6. Don't waste your time with FOS. IMO there will be a read across to business accounts off the back of the OFT test case. In particular small business and sole trading accounts. Sit on your hands until next Wednesday and have a look at the situation then.
  7. But there is alot of interest in the handing down: what about this, posted within the last hour on the RH site. BREAKING NEWS Just off the phone to the press office of the Supreme Court, I've been told to expect an announcement within a couple of days. My money is on Monday. We should have notice of the expected handing down of the findings on the Test Case Appeal (which will be done within seven days). So we should have an idea of the way forward by the end of next week or by Tuesday 24 November at the latest.
  8. Just got one charge, you were'nt bothered about ? Why not give it to Children in need via charges for charity.com? They have an arrangement to waiver clams management fees so every penny INCLUDING ANY INTEREST goes to Children in Need, topped up by gift aid. what do you think?
  9. IMO They are, but are more pro active then most in seeking info and putting it into the public domain. They thank LB s for the information in this case but have been the source of other information. It's worth checking their news page sometimes it's free! & they recommend this site on their front page to claim for yourself
  10. This from ROBERTSON-HOLBROOK News Just Spoke to SCoJ (ex HOL) press office, reports in the press (namely The Mail) are somewhat optimistic. The Judgment is due to be handed down this term which is Michaelmas which could be at any time up until Thursday 17 December. Sian Lewis (press officer) told me; "We simply don't know but as soon as there is an intended handing down announced it will be posted on the News Page as there is a lot of interest in this case" "It will be this term and it will be before Christmas"
