Hi Guys, We are always paid on 29th each month. We all assumed that since tomorrow is a Bank Holiday we would be paid today. We only just found out that we would not be paid until the next working day which would be Tuesday 3 May 11!!!! Can they do it? many people here made plans for the long weekend and have no money to realise them. Please help - is there anything we can do?

In which case the answer is that you wouldn't be able to do anything to sort this out at this late stage. Hindsight is a wonderful thing, but the BH should really have been anticipated and somebody should have confirmed the pay date with the employer before today.

 

Strictly speaking, if you are due to be paid 'On 29th of each month' or 'the last Friday of each month' then the employer should have taken steps to pay you on time, and this could be considered (at a push due to the circumstances) an Unlawful Deduction, but by the time you pursued that course of action you would have been paid anyway, but in the event that you suffer bank or other charges due to the late payment you would certainly have a claim t recover those from the employer.

Any advice given is done so on the assumption that recipients will also take professional advice where appropriate.

Simple answer.

If you are paid late by your employer or a bank error then you are entitled to claim Compensation from your employer or bank (be sure who) for expenses and costs related to the error.

e.g. Bank Charges, Late payment fees, ECT.

But you must show that they made the error.

Your contract will show this as it will state your normal pay date (on or last working day before a day/date)

If your employer refuses to pay these costs then you can claim through the small claims courts (maximum claim value apply's) or through a Solicitors. You can also claim any costs in recovering these monies.

If your employer does anything to punish you for such actions they will commit an offence.
