      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have had no response from Payday Express at all, they ahve ignored any emails sent to them.

 

Capital Finance One have now decided to go quiet aswell, this won't stop me sending my daily emails to them.

 

Quickquid is still putting up a fight regarding their bank details, they ahve now extended the offer to paypal.

 

apart from this, the rest have been fairly easy to deal with.

Payday UK and Payday Express are willing to arrange a repayment plan only if I can have a severe illness, job loss etc. without this they wont accept one, so need to try work out what I am going to do regarding that.

 

CFO on the other hand, are now ignoring all my attempts to contact that them and they are adding charges on all the time, where do I stand with this regarding the charges? as I am constantly emailing them with a repayment plan etc.

A complaint is in order now for Payday UK and Payday Express to the Office of Fair Trading and Trading Standards for not treating you fairly, they cannot pick and choose which circumstances they can 'help' in when it is a default situation on top of their outrageous charges. The OFT particularly would like to see any emails you have where they are being obstructive.

CFO have got back in contact, a different person this time, I have been threatened with the door to door collections in which i sent the relevant letter to them about, they replied by saying that they can and will do this. I have been told they are wanting to remove all fines and charges and come to an arrangement but only after I make regular token payments, do they think I am stupid? token payments so they can off set them against the charges they are adding, I have tried several times for them to come to an agreement but they keep saying the same thing, we are wanting to help you and are wanting to come to an arrangement however we cannot do so since I have made no payment. any ideas?

well a bit of good luck came my way over the weekend, being debt free is more important to me than fancy gadgets so decided to sell my iphone and anything else I dont really need, so I have raised some extra funds that allowed me to clear the Capital Finance One loan, they agreed to remove all fees if i paid it in full and they did just that, I only had to pay the original amount owed. so thats two down now :D

 

everyone else has agreed to repayment plans except paydak uk and payday express, but we are getting there :D

I know how you feel though! I sold my old banger of a car and paid off one of mine. Getting thinner in the process 'cause I have to walk to work now - so they did me a favour LOL.

Well done, sometimes these gadgets are more hassle than the image warrants.

 

There is a sense of achievement as each loan vanishes, and as long as they don't recurr you should be able to get out of debt a lot quicker. Remember that the whole debt industry is self-perpetuating, and by not playing with them you are becoming financially independent. It is a good feeling when it happens and is worth looking at the old saying "Neither a lender nor a borrower be...."

 

Whilst payday loan companies have their place they aren't always the total solution.

Still very much in the same boat as you, wonga and text loan agreed to repayment plans and I have started paying them, payday uk and payday express want bank statements/ wage slips/ life story etc etc, .

Only i havent paid off CFO and they are still adding charges, they all need to understand that until they agree to my repayment plans, they wont see a penny, threatening me with door visits really doesnt work :). And I wont be sending my payslips to anyone. Worse case scenario is that eventually wonga and txtloan will be paid off, then I can clear the others in one payment, original amount only. Im sure theyll accept that rather than not get paid at all.

Thanks everyone for the kind words, I feel so much better about everything now, before I was getting really depressed, had been through a very rough patch and this was just making things worse for me, however now I happy and a damn sight wiser when it comes to money, the more I can pay off the more money it free's up to clear others, I am looking at being debt free quicker than I thought :D this site has been a life saver!

There are ways other than the National Debtline and CCS/Payplan ways, you just have to be strong and be aware of your facts AND rights. Some companies do not like third party debt advisory services (such as this site) as we tend to inform them of the REAL rights the 'nasty horrible debtor' has.

well I am having trouble with Payday Express, they are refusing to accept a repayment plan unless I send them bank statements or proof that my financial situation has changed and will continue to add interest and charges.

 

QuickQuid are still refusing to supply me with bank details, they are insisting on direct debit, paypal etc. every method they can raid my account with, they have now changed their offer back down to 3 months instead of the original 6.

 

Payday UK want to accept my plan but only for the first 3 months then they will review my account, is this worthwhile doing or will they simple apply these amounts to interest and charge me the same after the 3 months anyway?

 

Wonga, Txt loan are dealt with and a payment plan has been set up.

 

CFO and minicredit are cleared.

 

If I can sort out the top 3 then I will be in a happier place, I am already less stressed though they are starting to send more letters to the house :( I dont want this as I am in a position where I can get out this mess myself (thanks to you guys) and really dont want to give my parents any reason to worry.

Why would you pay a £25 failed payment charge? I thought this issue was now crystal clear with everybody, pay loan + 1month interest DO NOT PAY ANY CHARGE it is unenforceable

CFO are doing the same with me, but I doubt what they are doing will be held up if it goes to court, so I am not panicking over it, I will only pay what I believe I owe which is the loan + 1 month interest + 25 pounds (1 failed payment charge). Everytime they are emailing me with the new debt amount, I am referring them back to the first email I sent them proposing the repayment plan. As long as everything is in emails it can always be referred back to in the future.

I don't think they would be foolish enough to take extra payments as this clearly details the arrangement for the plan and you could take action against them on so many angles it would not be worth their while. as long as this is the plan that you originally set out and can afford it and will stick to it I would not have any issues with them, I'm sure some will disagree but that's my personal opinion

Hi, currently have a Payday Loan with Cheque Centre (for just over a year now), but just can not afford to carry on any longer with it. I defaulted yesterday and cancelled my debit card so that they could not take any further payments and e-mailed them with the request of a payment plan. This is their reply:

I have looked at your proposed payment plan and would like to inform you that this is acceptable to Cheque Centre . Our policy is , however , that customers must come in to the branch to make the first payment in order to set up the plan .

I have copied in the branch on this email so that they can see that we are happy to go ahead with your proposed payment plan without adding on any extra charges .

With regard to the method of payment , we do not take payments of this nature through standing order . We would still need to debit your account at the end of each month . This would only be for the agreed amount and we would not take any other non agreed monies .

I hope that this is satisfactory .

The next step is for you to now contact the branch who will be happy to set up your payment plan today .

Do you agree that this is acceptable and should i trust them and give them my new debit card details or shall i request an alternative payment method.

well a quick update, nothing much has changed really.

 

Payday Express are refusing so I will continue to send them my offer until it goes to a DCA.

 

Payday UK have agreed to the first 3 months so I will take this as I believe I will be able to clear this quicker.

 

QuickQuid still wont give out bank details so I will continue to request it until it goes to a DCA.

 

mail has been arranged to be held so I can collect it in person, feel good about things now :D
