Hi everyone, obviously I am not new to the forum

 

Got a friend with a bit of a problem/dilema and thought I would put it out for fellow Caggers to advise upon. Well here it goes:

 

My friends younger brother got a payday loan from Wonga, he received the money into his bank account.

Unfortunetly he then used his dads bank account to service the debt. Cut a long story short my friends dad has had over £1200 taken out of his account over several months.

 

Now obviously he has commited fraud by using his dads bank account number, but IMO Wonga has commited fraud by not verfifying that his dad has agreed to this (they have different names and initials).

 

Is it possible for his dad to say that even though his son is allowed to use his card it is fraud by wonga for not checking that he could?

 

just trying to think of a way to get his money back without causing trouble for his son (his son is 19 and a student)

Very tricky one....

 

Your friends dad could report the fraud to the police which the son could get done.....

Wonga could report your son for fraud, if they didnt get their money.

 

 

Yes their systems didnt pick it up..... but if dad okays him to use card, then their is no comeback on them.....

 

2 questions... do father and son have the same name???

Did daddy not check his account. obviously daddy has a few bob, that it took him a while to notice.

 

Think daddy needs to teach young lad a little lesson, and ask for for £2k back!!!

No they don't have the same name, completely different initials. Daddy doesn't have a few bob and has been struggling througout the recesssion with his kitchen shop

I am no legal expert, but I would say Wonga has not committed fraud the son has.

 

In the terms and conditions there will be a declaration that the card is the sons, by agreeing to these and then using a card owned by someone else the son has committed fraud.

 

The Dad could try a chargeback (nothing to lose) but my guess woud be Wonga would defend it and if they lost could then seek criminal charges against the son.
