Ok, received defence from Cobbetts yesterday. Just a bit stressed about a few items on there.

 

1. They claim that my particulars of the claim do not disclose reasonable grounds for bringing a claim against the claimant. (I used the MCOL template from the templates library?)

 

2. They also claim that they will 'stike out' my claim because i have claimed charges which are over 6 years old... even though they weren't when i first sent the prelim months ago! - Can they do this?

 

3. They are inviting the court to direct that there be a 'case management conference' to consider the making of appropriate orders to give me the time to properly particlarise my claim??

 

4. They state that no admissions are made as to what charges have been debited from my account.... I've sent a copy of the schedule at every point of this claim.

 

The rest is pretty usual stuff - can anyone give any advice??

There's nothing to worry about. It's all bravado and intimidation, mainly because that's all they've got left. Sit tight and return the AQ when you receive it.

Well, received AQ from MCOL and they've only gone and transferred my court case to newcastle upon tyne - like thats any good to me!! About 180 miles further away.

Don't worry though, you wont be going there. You can suggest another court on your AQ form.
