    • An update - Still receiving emails and letters - but have been getting text messages too. nothing aggressive just asking me to get in touch.    the text makes it look like it from the bank on first glance - it reads -   'the banks name' would like to dicuss our recent communication...etc... then lists IDR phone number and email FYI - reporting them as spam
    • Hello, After seeing all of the posts about BMW on here I really wish I hadn't even considered them! I bought a used car from them over the weekend, one specifically which had a reversing camera and cruise control in the advert. I was foolish at the time of purchase and didn't check to see these functions work on the test drive (totally my fault). Now that the car is home I've checked and checked and neither of these functions are available. I even checked on Parkers and it seems that no Skoda Kamiq '21 models come with any parking cameras at all. When buying the car, I was told all that was needed was 'Four signatures and £500' to secure it. I was never shown any of the documents, and instead the sales rep opened a box on his iPad and asked me to sign. He had been complaining about the length of time some customers take these days all throughout my time with him. (Again) foolishly I signed. In my email inbox I now have four attachments from BMW, one of which is my signature under a letter which basically says that the cars don't need to match the advertisements online, or have any of the features that a sales rep talks about. I realise that I've made mistakes in not doing my due diligence here, but thought I might as well ask the experts here if I have any rights left to claim that the car was miss-advertised, or if I unknowingly signed them away? Thanks in advance

    • ah this is a B2B PCP then as your are sending the SAR as a private individual and not as repping the co. you need to prove to them. unfortunately, i think that will also reset the 30 days. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Ok, well you obviously disagree, I will say however that yes there are lots of posts about banks clearing out accounts, but I have yet to see one that includes the words "after cancelling my card". Also the advice about cancelling continuos payment authority is realitively new so quoting the last 5 years may not be relevant.

I appreciate that getting the money back is a pain, but I would have thought that you of all people would know exactly how to go about that.

 

After all, I am only following the line of the site team at CAG

:lalala::help::sorry::welcome::flock:I have to say as previously mentioned in my older posts the payday loan sharks raided yes raided my bank account when i had an agreed extension rollover in place and i had never ever defaulted with any of them to cause them to do it .quick quid took all my money instead of the roll over and my bank stopped it but it took a week or more before i got my money back so be very carefull with your bank accounts they take what they want when they want regardless of any agreements you have in place with them

Hi quackquack. Oh i quite agree they are bastards and will happily stich you up and i would be the first to say don't give them your card details for an arrangement. However, this is a totally separate issue. Dealing with all this is hard enough without adding unnecessary complications. Would you agree?

Oh dear, nice to see you are big enough to take an apology which I sent to you privately but will do so on here. I am sorry if I offended you or anyone, all I try to do is put across another point of view, or challenge what I believe to be an incorrect or misleading statement. I do try to challenge them with facts and not hearsay.

One of the major problems with forums like this is that the written word is to a lot of people, emotionless, so that it can be hard to appreciate the intended meaning.

Another is that people take challenges or different points of view as a personal attack (me included) when they are not meant to be.

I have a great deal of respect for sillygirl on many issues, her advice on ccj defences is excellent for one example, but that doesnt mean I have to agree with everything she says.

The poster Hay is now aware that he or she has comeback on the bank if somehow the PDL gets to the money especially as they admit it is too late to get their wages paid into another bank.

Finally I have never been rude to you and although you may find my posts unwelcome, that doesn't mean everyone does.
