Hi i hope you can help me!

 

i Have been in my current property with my wife and 2 children for almost 7 years and have had a northern rock "together" mortgage for the last 4 year 10months(5 year fixed 5.75%) and through various reasons but mostly stupidity by myself over this period i ave got myself in about 30k of unsecured debt

 

The credit card and personal loan debt is mostly mounted up by "robbing peter to pay paul" and now have several debt agencies chasing me for various amounts of money

 

The agencies scaremongering, court order, phone calls and now doorstop collectors have panicked me into paying them moneys i just couldnt afford

 

subsequently this has made me miss several payments to northern rock and my current arrears stands at 19500. having made several payment arrangments with them which i didnt keep due bad money management(in my head i thought i had it all under control but in reality i was failing big time)

 

i recieved 3 letters on the same day 2 weeks ago 2 from northern rock asking me to contact them abouth my arrears and how they could help me with my current "situation" the third letter was a solicitors letter telling me to contact northern rock within 7 days to agree a payment plan or they would commence legal action against me but the date on this letter was 10 days previous to me receiving it.

 

spoke to northern rock straight away they advised me that the legal action had started 2 days before i rang and couldnt be stopped!

 

in the 2 weeks since then i have recieved a court order pack with a date of 21/3/2011 and have been frantic with worry, i have no idea what to do and am hoping for some advice on here. the girl on the phone at northern rock gave me a number for a company called payplan who they work together with for my unsecured debts whom i have a telephone appt booked in with today

 

I feel that the lies that i have told everyone over the last 2 years to try to keep my head above water are all coming back to haunt me and i am going to lose everything! I have hid this from my wife and now she knows if we lose this house it will also cost me my marriage

 

I have no idea what steps i should be taking for this court date and have no confidence in keeping our family home that we love

 

we both work full time and have an income of 2700 a month and being honest the payments of 1100 to northern rock(145000mortgage + 25k"together loan) are excessive and being fixed during a recession hasnt helped!

 

i have tried looking at a remortgage which could be much cheaper but my current credit score and the current lending criteria are against me

 

sorry for the long winded post i thought i better put everything in to try and get the best advice

Hi

The first thing to do is contact a free debt chariity immediatly. CAB, National debtline,Cccs these are free.

Start making,token payments 1 pound to all non priority debts.Keep up the mortgage payments.

What legal proceedings have NR started.

Don't Panic I'm sure others will be along to help.

Hi Andrew,

 

Please, please, please ignore fsb these people are just trying to profit from those in difficult situations and should be avoided at all costs.

 

As Cadbury suggests, get some free impartial advice about getting your financial position as a whole in order hopefully Payplan will help with this and work out what you can afford to pay to your mortgage and other debts.

 

If you want to keep your house, first priority should be paying the mortgage, forget the unsecured lot INCLUDING the 'together' loan, they can't make you homeless - at least not without getting a CCJ, then charging order, then order for sale which would take forever and gives you lots of opportunities to intervene.

 

Payplan will probably help you compile a financial statement which should show whether you can afford the mortgage and to clear the arrears. If you can, Northern Rock may then agree the terms for a suspended order to be granted at the hearing and as long as you pay you keep the house.

 

Maybe check back when you've spoken to Payplan and things are clearer.
