    • You will probably get a couple more reminders followed by further demands fro unregulated debt collectors with even increasing amounts to pay. They are all designed to scare you into paying.  Don't. It's a scam site and they do not know who was driving and they know the keeper is not liable to pay the PCN. Also the shop was closed so they have no legitimate interest in keeping the car park clear. So to charge £100 is a penalty as there is no legitimate interest which means that the case would be thrown out if it went to Court.  Keep your money in your wallet and be prepared to ignore all their letters and threats. Doubtful they would go to Court since a lot more people would not pay when they heard  MET lost in Court. However they may just send you a Letter of Claim to test your resolve.  If yoy get one of those, come back to us and we will advise a snotty letter to send them.  You probably already have, but take a look through some of our past Met PCNs to see how they are doing.
    • Hello, been a while since I posted on here, really hoping for the same support an advice I received last time :-) Long, long story for us, but basically through bad choices, bad luck and bad advice ended up in an IVA in 2016. The accounts involved all defaulted, to be expected. In 2018, I got contacted by an 'independent advisor' advising me that I shouldn't be in an IVA, that it wasn't the solution for our circumstances and that they would guide us through the process of leaving the IVA and finding a better solution. I feel very stupid for taking this persons advice, and feel they prey on vulnerable people for their own financial gain (it ended with us paying our IVA monthly contribution to them)-long and short of it our IVA failed in 2018. At the same time the IVA failed we also had our shared ownership property voluntarily repossessed (to say this was an incredibly stressful time would be an understatement!) When we moved to our new (rented) property in August 2018, I was aware that creditors would start contacting us from the IVA failure. I got advice from another help website and started sending off SARs and CCAs request letters. I was advised not to bury my head and update our address etc and tackle each company as they came along. Initially there was quite a lot of correspondence, and I still get a daily missed call from PRA group (and the occasional letter from them), but not much else. However, yesterday i had a letter through from Lowell (and one from Capital One) advising that they had bought my debt and would like to speak with me regarding the account. There will be several.of these through our door i suspect, as we did have several accounts with Capital One. Capital One have written to us with regular statements over the last 5 years, and my last communication with them was to advise of of our new address (June 2019), I also note that all of these accounts received a small payment in Jan2019 (i'm assuming the funds from the failed IVA pot). Really sorry for the long long post, but just thought id give (some of) the background for context.... I guess my question at the moment is.....how do I respond to Lowell...do I wait for the inevitable other letters to arrive then deal with them all together or individually...? Do I send them a CCA?  Many thanks

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello

 

I wanted some advices as im a bit unsure right now on this matter,

 

Basically cutting to the chase,

 

I sent Credit Solutions Limited a letter my Income/outcome and offered a £1 token payment per month that letter was sent on the 9th of February

 

Which I then received a letter on the 17th of February stating the following

 

WE are pleased to confirm your repayment of a £1 token per month for 6 months as this time the account would be reviewed

 

Says the first payment needed to be a Cheque so I sent that right away, so I thought great 6 months of a payment of a £1 was great due to I was paying £30 was clearly I couldn’t afford to do as it was like paying john to rob off to pay bob etc

 

But today I got an letter stating the following

 

Opportunity to Save 50% on your outstanding bill

 

We understand our CLIENT has previously attempt to contact you, but the above outstanding amount remains unpaid

 

It may be that your are currently experiencing financial difficulties to show their willingness to assist you in this matter, Our client is willing to make a 50% Discount on your account

 

Should you fail to pay we will request field agents to call upon you to collect the debt or to ascertain your financial circumstances.

 

Be advised the issue of court processing’s will increase the outstanding amount

 

Solicitor’s cost £80 + 120 Count Fee

 

 

1) ive not heard for the OC at all so the client has tried to contact you is rubbish

 

2) err yeah im a bit confused as recent letter says an agreement of 6months of a £1

 

Ive kept all letters and such for my records so I thought about just copying both of these letters and ask what happened to the Agreement of 6 months

 

Or is this just a basic letter what gets sent out which to me it seems they have jus basically ignored the 6month argeement which was set up and now heading towards court

Usual computer generated tosh.

Just keep paying your £1 and ignore.

They will not be taking any court action unless their so called 'client' says so.

Only the legal owner of the debt can initiate count action.

 

Who is the original creditor and what kind of debt is it?

 

You say you pain the first payment by cheque. How are you intending to pay further installments?

DO NOT set up a direct debit or give your debit card details to a DCA, they have been known to take amounts far in excess of that agreed.

 

Always use standing oders, internet/telephone banking or postal orders when dealing with DCA's

Even cheques are not advised, they have your bank details and more inportantly your signiture on them.

Never trust a DCA

original creditor is O2 contract mobile phone of £1500

 

Was hoping it was computer generated tosh

 

was recently paying £30 a month for about 5 months then requested it to be a £1 token payment due to not having that amount of money and trying to pay off other debts which they were happy to accept and to be reviewed in 6months

Just an update

 

I can totally understand why people don’t like calling Debt collection companies

 

normally CSL are quite quiet on the phone calls so today I had a missed called from them, well I was going to ring them anyhow to make sure the Cheque £1 Token Payment got to them as I sent it a while back

 

Anyhow call was basically like this

 

The person on the other end of the phone was like oh the call was just about your £30 payment a month I was like errr your agreement was £1 token a month for 6 months and then to be reviewed

 

hes like NO SIR we know nothing of this we didn’t set that up?

Err you did?

No sir we did no such thing

 

Well that’s kind of funny because in front of me I have a letter from you stating that agreement and what the letter was sent and all the other information

 

Wish for me to go down the road letter and photocopy it and resend it back to you recorded postage

 

few seconds of pause on his end ..then started to be RUDE and didn’t care what I had to say.. his reply yeah £1 token received on blah blah so date… called ended

 

 

Charming I thought but ohwell.. if they cant be bothered to update they records correct then I can understand why people have so many problems with debt collection companies

 

 

Yeah maybe I could of handled it in a different way but how the call was going was trying to trick me into paying more so only thing what jumped into my mind was ive got the letter from you to prove it etc

The CAG mantra is never speak to them on the 'phone, any contact should be in writing. In that way you have documentary evidence of what has occurred, otherwise as you have just learned, they will tell you any drivel that enters their head to try and get you to pay more.

Yes you are correct,

 

Guess I was wanted to make sure they got payment as was due before Tuesday as didn’t want to break the agreement which was set up,

 

Well I didn’t pay them more anyhow as that would means me being short of food to live on

Agree.Dont deal at all ny phone.

Up to you,but personally I would just put something short and simple in writing which gives you a copy and proof that it was sent.

 

 

Dear xxxxxx

 

I refer to the above account,and my offer of repayment of xxx a month,which was accepted by you in a letter dated xxxx which I have a copy of.

 

Suffice to say,I was extremely concerned,to be contacted on xxxxxx and asked to pay more/questioning my failure to make repayment arrangements.

Clearly,there appears to be some communication problems.

I insist that all further correspondence is done strictly in writing and not by telephone,and expect you to uphold Ofiice of Fair Trading and CSA codes of practice.

 

Please forward me a copy of your complaints procedure.

 

Yours Faithfully

Send recorded and keep a copy.

 

 

The purpose and importance of this,is that it puts YOU back in the driving seat,and they have no excuse to continue to flout the rules.

Thank you so much

 

I did send them a letter with the payment basically saying can you reply with a letter to confirm you have got the payment

 

but seem they didn’t take much notice of that as ive got no such post from them

 

Thank you such much for the letter you posted above and all the advice,

 

I will save that letter to MS word and use it from now on

Also going to start doing a diary of everything first thing tomorrow morning once I got folders to store everything in so I can keep track of everything

Yes keeping a file with everything in is a good idea,

When you get your proof of posting -staple this to the letter you have sent-this means no problems searching if needed later.

Tesco do a pack of 5 coloured card folders for around £1-these are great for keeping these things in.

But you can find at Wilkinsons too.

No need to be splashing out on expensive files.

I had a read of that last night and can see why you don’t trust them and to be honest,

 

 

Well was about to walk down the road to post the “”some communication problems”” Letter which Martin posted up for me

 

Just was about to go outdoors and got greeted by the postman here some letters from you so ah thought I would read them before going

 

letter from Credit Solutions Ltd,

 

 

 

FAILED DIRECT DEBT

 

 

of the £30 a month payment and goes on about the contact us in 7 days blah blah

 

1) I never paid that £30 by via Direct Debt so that’s a load of rubbish in the first place I had to ring them yes silly of me to call them but I as posted above I learnt the hard way

 

2) funny how when I was paying £30 it was paid on the 28th of each month then got moved to 1st of each month so I could keep track of people I was paying which they happily did for me and updated the account with a note saying that. And I never had a problem with the payment on 1st of each month

 

3) so from my point of view. Its a load of rubbish how the letter carries on and says I broke the arrangement Very strange that how it wasn’t due to the 1st of next month

 

4) a new arrangement was set up to pay £1 a token payment which I posted above

 

Now that is what makes me laugh this letter went sent on the 25th of this month and they got my new offer Token Payment of a £1 on the 23rd so seems they either cant read they account screen correct or really do have some communication problems

 

 

Now im just going to EDIT and ADD this to the LETTER Martin kindly posted up for me and post it to them which more LACK of communication problems with my account, so ill await the complaints procedure

 

Just got to edit it to my needs. If I get stuck writing it I may need some help

Include in the letter that you do not authorise any DD and they are to remove your card details from their systems forthwith. Also contact your bank and tell them you have not & do not authorise any DD payments to that company. Make sure your bank does not charge you for the failed DD payment.

Thank you will add that to the letter,

 

I did speak to the bank regarding direct debts and cancelled all of them and informed them that I don’t want any direct debts set up on this account due to fees and failed payment fees.

 

due to being in debt and fees would just make it worse etc did that a while back once I started to sort out my debts and got a different bank account

 

Just checked online banking and seems ive not been charged no failed payment fees so hopefully be okay on that side of things

Good.

The bank is obliged to honour your instructions or faces breaching the lending codes.

Online banking is a very good way of monitoring DDs and SO's and of course allows you to cancel them yourself.

must of been because I was a little stressed due to that silly phonecall

 

In the letter i posted to them I requested for the compaies bank Details so i can pay VIA Standing Order

 

Still awaiting a reply for that one though if i hear nothing then ill pay VIA postal orders
