    • 4.  Under The Pre-Action Protocol 201?, a Debt Buyer must undertake all reasonable enquiries to ensure the correct address of a debtor, this can be as simple as a credit file search. The Claimant failed to carry out such basic checks. Subsequently all letters prior too and including ,The Pre action Protocol Letter of Claim dated 7 January 2020 and the claimform dated 14th February 2020 were all served to a previous address which I moved out of in 2018. 9.   The claimant failed to comply with the additional directions ordered by District Judge Davis on the 2nd February 2024 'The Claim shall be automatically struck out at 4pm on 3 April 2024 unless the Claimant delivers to the Court and to the Defendant the following documents.' None were received by the court nor the defendant by that date. re: 13 & 15...they dont need to produce the deed, thats a private b2b document only the judge can demand sight of. i would remove 13 totally as within their WS they have produced the Notice Of Assignment. and delete it from 15 a few ideas. dx  
    • Underp04 (I think it was him) put up the statement IDR used in court from some supposed expert mr edge. can you find it? It stated 10 years was the statute barred limit but also that the laws were very confusing. very much worth digging out!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Foxtrotoscar... I too am in the same position with a large number (over 10) of Payday loans. Of them all, Minicredit were the only ones not to accept a payment plan; and indeed did end up lodging a county court claim to recover their money. Now I'm not going to get into an argument on whether their claim was valid, but needless to say the amount they were requesting (over £750) was far (far) more than the original loan. The company that was acting as quasi-legal council for them - ACT credit - were the ones I ended up dealing with. I offered them a settlement figure of slightly under half that amount on a Friday afternoon and by Monday (9am) it was accepted with a proviso it was paid by 3pm that day. I paid by 3pm the following day and it was all fine.

 

I am sure there will be some on here who cannot offer a settlement figure; or who wish to nonetheless consider going to court and seeing that happens (after all, a CCJ will be removed from a credit file if settled in full within a month). For me though, I was in a position where I could make this problem go away by offering a final amount and in the end it was remarkably easy to do so.

 

If I were to recommend anything I'd say "aim low" with your settlement figure.The speed with which mine was accepted tends to suggest they'd rather have (almost) anything rather than nothing.

Having received the court papers, a week ago I am today posting stupid1 (the original poster) defence, I have the full email trail and some interesting stuff to put before the court. Will let you know how things progress. @ sillygirl the defence is nothing to do with DNs more to do with things MC havnt done. I didnt mean to infer that was my line of defence, sorry for the confusion.:wink:

I am at the stage now with Minicredit were I haven't been able to make the payment and they have just added on the second charge of £55. I would be really grateful if someone could offer advise on how I proceed now with these guy? I made contact with Minicredit prior to the due date of loan, advising of my situation & advised I would be able to make token payments in Jan & Feb, with full payment in March. I got the usual reply no repayment plan etc etc. I then found this link from OFT and I pointed out the section about as a creditor to not pressure debtors into pay in full, in unreasonably large installments or to increase payments when they are unable to do so, as per Office Of Trading debt collection guidance. I therefore offered to make a payment of £30 in Jan & Feb, with the remaining balance in March. They replied with the below email;

 

MiniCredit has the right to immediately start Legal action when the

Customer

has entered into a Debt Management Plan. If the current loan balance is not

repaid immediately, the balance will be defaulted on the 90th day overdue.

 

You may log in to Your MiniCredit.co.uk account to make partly payments

within 90 days from the due date to avoid Legal action.. All overdue

charges

and interest will be added until full repayment.

 

 

Please visit Your MiniCredit account to read the Terms and Conditions and

the Loan agreement.

 

You have accepted our Website Terms of use and the Privacy policy when You

registered as a client of MiniCredit. And it is a fraudulent behaviour to

borrow money when You have no intentions to make the repayment on time and

You will face criminal charges.

 

15. Debt Management Programs, IVA's and Bankruptcy

MiniCredit usually drop off in some way as they have from experience, and I intend to pursue these when we get to court, indeed the judge will be well interested.cant say to much on here atm cos MC have eyes and ears

You fill in the AQ stating the claim needs to be transferred to your local court as a litigant in person you do not have the funds of a large company to travel to other courts, of course if they win they will claim travel costs - but I can't see how they would win

What do you mean by this please??? Are you sure???

I suppose by now MiniCredit have received our (stupid1s) defence. Coincidently after critisicing their online account in the defefence

and the amount due being different to the amount claimed,

it appears we are now unable to access the online account.

My minicredit debt now stands at amazing £360 from £100 loan. Anyway I have sent various emails with offers etc and I don't even get a response now. I have recently received a telephone call from a foreign sounding guy with the usually threats. I want to make I am approaching this right, as no doubt i will receive court letter soon. Do I continue making offers? i would mind speeding things up, so the interest & charges stay down. Can I escalate it to court sooner?? Any help appreciated.

You could put in a claim but it is best to wait. Keep the emails as it is evidence to use against them. Can you make a part payment to them to prove your intent to pay the original loan plus one rollover fee?

 

If heQy try court I can write a basic defence for you. They do not need to send a default notice nor letter before action.

How is this going for everyone?

 

I myself have taken out some payday loans in the past and at one point it seemed as if I was only taking out more payday loans to cover the rollovers from my previous loans from other companies.

 

I believe now that I am on track to getting this sorted. A few of the companies are accepting payment plans whilest others are letting me defer payments and I'm continuing on from there.

One quick question: If for example I had a debt of £300 with Company A. I've been in touch with 'A' and they've said that I can pay them £35 to rollover the debt, When I spoke to 'A's representative on the phone I originally asked to set-up a payment plan, they said that they cannot do that as of now and the only thing they'll do is accept a rollover payment. Is this correct or if I make a reasonable offer to pay a certain amount must they accept that?

 

Also, if I paid £35 to hold the account and stop interest and charges etc... Should that be taken off the overall amount?

Payday Express - £200 debt: Paid £20 today on the 16/02/2011, due to pay an extra £20 on the 25/02/2011 for minimum payment to hold the account (rollover payment). Will leave me with a balance of £200 to pay on 15th of March.

The rule of thumb is usually loan + 1 months interest is acceptable, looking at what you have said, Payday Uk seem to have done this,Wonga seems to be a 6 month plan which is usual,if you are not going to pay Payday Express in full on 15th March then you need to re-arrange to a payment plan,never heard of cash genie but this plan means you would pay them for over 12 months, if this is not having interest added then this seems a good plan but you need to make sure all you will repay is £275,all 24/7 seem to be doing is "rolling" it over again and this is not what you seem to be asking for,a s I have only ever dealt with Wonga and briefly Payday ex dont know much about them but someone who has used them should be along soon.

@ themadcap, here is a copy of the email I received from the Cash Genie rep:

 

James,

 

We have received £10 on 4th February 2011 to hold your account for 2 weeks. Another £10 is due on the 18th February 2011.

 

Your balance currently stands at £275.00, this is frozen from interest and charges while you are in the payment plan, but if your plan is failed then charges and interest that you would have incurred during the period of your plan will be added to the balance. So it is vitally important to make sure funds are available on your due date.

 

Please email me if there are any change in your circumstances that would affect you paying back this loan.

hi i took out £100 which end up being £80 lost my debit card which i call to tell them and could i make paying in the bank which they told me no and now my bill is £261 from friday i feel that some thing should be done this is not right

Still waiting for a copy of our defence from the court which they said will be sent but that was a month ago,

Heard nothing from the court or Minicredit other than a request from the court for us to sign a new AOS

as they have "missplaced" the original. The AOS was sent to a company called Act Credit Management

tho and not Minicredit. It seems they are a company that do legal stuff for small companies.

How is your spying mission going? it is odd that people respond to your queries, they are just adding to their woes because they are tellung you (minicredit spy) exactly what their plans/movements are so you can laugh behing their backs. Incidently, nice user name..FoxtrotOscar...telling us all to F*** O** basically.

i have my own minicredit thread and was just seeing if i done the right thing by paying back their stupid interest, commission and charges!

im in the same situation as many others on this site (14 payday loans in total) and trying to find the best way to deal with it.
