Yes they did eventually submit those docs to me after a second letter advising them I was contacting the ICO to make a formal complaint for failing to comply with an earlier SAR that they brushed off as an "administrative error" or something. When I sent the letter telling them I was in contact with the information commissioner to lodge the complaint, the original PCN etc quickly followed along with their excuse!

    • The property was our family home.  A fixed low rate btl/ development loan was given (last century!). It was derelict. Did it up/ was rented out for a while.  Then moved in/out over the years (mostly around school)  It was a mix of rental and family home. The ad-hoc rents covered the loan amply.  Nowadays  banks don't allow such a mix.  (I have written this before.) Problems started when the lease was extended and needed to re-mortgage to cover the expense.  Wanted another btl.  Got a tenant in situ. Was located elsewhere (work). A broker found a btl lender, they reneged.  Broker didn't find another btl loan.  The tenant was paying enough to cover the proposed annual btl mortgage in 4 months. The broker gave up trying to find another.  I ended up on a bridge and this disastrous path.  (I have raised previous issues about the broker) Not sure what you mean by 'split'.  The property was always leasehold with a separate freeholder  The freeholder eventually sold the fh to another entity by private agreement (the trust) but it's always been separate.  That's quite normal.  One can't merge titles - unless lease runs out/ is forfeited and new one is not created/ granted. The bridge lender had a special condition in loan offer - their own lawyer had to check title first.  Check that lease wasn't onerous and there was nothing that would affect good saleability.  The lawyer (that got sacked for dishonesty) signed off the loan on the basis the lease and title was good and clean.  The same law firm then tried to complain the lease clauses were onerous and the lease too short, even though the loan was to cover a 90y lease extension!!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi i have 5 payday loans

 

wonga £1391

payday express £500

quickquid £435

lending stream £487.50

payday uk £300

 

i have spoken to wonga via livechat and agreed 4x£300+payments with ALL interest/charges frozen

 

this is the email and i think she said i will receive a letter but am still at work,i want to pay them all off but the other 4 are charging £60-£80 a month to default whereas wonga arent!!

 

2questions really

 

has anybody else come to an agreement with wonga?

how should i play the other 4 ...am thinking it better to pay 1 of the others off in full? and default this month worry about the other 3 later;-/

 

if anyone has any advice that would be great?

oh also i have 2 accounts with 1 a bank i have 2 x debit cards

 

my salary is paid into 1 of these accounts i usually transfer money online into the other account to withdraw cash make payments etc? only the 1st 4 digits are the same on both cards

 

will they raid my other account if they know who i bank with etc

 

*** am reading through all the other posts/threads with interest

 

alot of nice helpful people on here which is good to know:-)

she also said the interest will still be shown on my account during the 4 months but this will all be taken off when the final paymnent is made?...???

anyone have any advice?

am thinking of paying wonga the installment and maybe 1 other off in full and leaving the other3 and making an offer

 

i dont want to pay £100 to extend it im not bothered about my credit rating either really

 

am more worried about phone calls to home/work than anything??

 

and if 2 different acc numbers/cards can be linked by them and clean it out? this will all be happening wed 30th june....;-0

Wayne surely if you concentrate on one loan at a time the charges will got rhough the roof on the others and make them totally unmanageable? Is there anyway the other companies will hold on and freeze interest until you are in a position to pay them?

I agree with Dawny here - I'm going through it at the moment and it really is better not to favour one creditor over the others. You'll end up chasing your tail and getting in a bigger mess. Offer the other companies what you can reasonably afford on the condition that you have all additional interest and charges frozen.

Thanks for the advice ;-) so far i have a payment plan with Wonga and Quickquid were very helpful saying they cant do anything til you default on the loan? and even agreed to contact by email only...whats the catch???

QQ Said they have sent the request to the bank already and takes3 days to change anything?? does this mean even if the funds arent there i can so into a negative balance?

 

i havent yet cancelled my debit card(have2 accounts with same bank 1 my salray goes into and the other has a cashpoint card so if i cancel i wont be able to get money out!!)

both electron cards and identical

 

there is a signature strip and 2 different 3 digit numbers on back of both

 

think i have a pin number somewhere at home but doubt i can find it ive just never used that account til i recently moved my salary to it? and itd take weeks to get a new 1

report both of them lost NOW!! Dont ignore the lenders, offer a repayment plan to everyone and be upfront and honest. Make sure they do not get hold of your details whatsoever. You need to pay them directly. PM me more information about the lenders and amounts, i'll help you with what to offer each one...

I agree with Jamie. Report your cards as lost immediately or (despite what they tell you over the phone!) they will take the full amount or whatever they can from your account.

 

Try to set up a new bank account to be extra careful. Even with a poor credit history I managed to get a 'cash card' account offered by Natwest and Barclays so I changed my wages into that account and then pay all the creditors out of my old account (I transfer just enough money to cover the payments) so there is no way they can get hold of my account details.

I would avoid sending a PM to another cagger who you know very little about, I suggest you make them an offer of whatever you can afford, either that or you contact the national debtline - National Debtline – Free, Confidential Debt Advice – Call 0808 808 4000

I see what 42man means, but there is nothing to be afraid of, as long u dont provide any private details, dont use the precise amount just change it with a couple of pounds etc.. and dont use any real names / account refs or numbers etc.. no problems in that, Jamie just trying to help! nice of him.

Jamie's really helped me out this last week and does give some very good advice - all of us who've been in this boat are here to help you out so draw on our experience.

 

I don't know about Lending Stream but from my experience both Payday Express and PaydayUK are pretty ok to deal with and will agree a payment plan, although you may need to nag PDE to get a final agreement and bank details. They also respect your request not to phone. Be honest, explain that you've gotten yourself into a mess financially and are seeking debt advice and insist on standing order payments only.

 

I've found that by paying by SO and informing them when I've made the payment it keeps them sweet!

quickquid might agree i just emailed them and the other 3 would ideally like to get agreements before 01/07 so i can start the repayments
