I'm not sure whether i'm in the right posting section but here goes. I'm in the process of taking an ex Letting Agent to small claims court a process I have never been through before. I have upto date got all of my info on how to proceed to small claims court from reputable books and internet sites

 

I am a little confused at the moment as I have just received notification from the courts that the defendant has filed an acknowledgement of service and that it is the defendants intention to defend part of the claim.

 

Am I right in assuming that because the defendant is only defending part of the claim that the rest of the claim is admitted and therefore they are liable to pay the claimant the amount that they admit they owe.

 

If this is the case can the claimant accept payment for the amount admitted and still proceed with the disputed amount in the small claims court?

No the case must continue.

I would wait for the defence first but I would suspect so.

Yes you can settle any issues you want in whatever form you like without affecting any other parts of your claim
