    • all DYL's are subject to a TRO. looking at this newish, ever increasing as old ind units have gotten removed, estate, there are only lines on one side, on the other there is a parking lane with traffic calming through which you mention. i seriously doubt your mate has any clue what he is talking about.!! its not a private housing assoc estate. so its a public council owned road. no construction co can just decide to draw their graffiti on a road. the DYLs are certainly there pre 2016 even before his home was built. now ive had a quick look to see if the main access to royal park road has signs. there is no royle park road even on your map but there is a royal barn road which leads to where you are parked royal road has a restriction sign on the pole by the fence of the electric substation jnc with gipsy lane there does not appear to be one leading in from the other end - tesco petrol station
    • Hi All. I was driving in Stevenage down a 40 road.  After coming off the motor way i noticed my car felt a little "weird" so i accelerated, then slowed the car down.  Shortly after i got stopped by a manned police car with a laser. During the stop the officer stated i was doing 54 in a 40, the conversation was short, but he said i would unlikely get a awareness course and it was most likely 3 points and a fine.  Mrs thought it was a good idea to have dairy when she is lactose intollerant on date night, so we just got on our way.  At the time, i didnt admit to the offence, but did say i didnt realise and had slowed down in any case. The officers chest camera was recording and on. At the stop, he asked where to send the fine to, as i knew i would be travelling to visit family up north, i provided my temporary details at that location in Yorkshire. It is now 05/05 and i havent recieved anything at either my home address in Stevenage or the temporary address. 1. Is there a time limit in which paperwork needs to be sent to me. 2. SHould i query the ticket as i dont want to miss any deadlines (if so who do i check with?) OR should i keep queit. 3. Given nothing has arrived in 20 days, is there a chance of appeal if and when it comes through? Many thanks CrazeUK
    • Hi All. A family friends car was having issues when she was on a trip visiting family up north at the begining of January.  She ended up leaving it at my friends garage in the same location, who parked it on his forecourt to investigate the issue, howver he said most likely it is beyond economical repair as its a serious gearbox fault. In the meantime i replaced her car with one of my spare cars. The insurance on the car then expired in at the end of January.  When the insurance expired, I sent a paper V890 paper as i didnt have her V5 Reference number in hand to do it online (i have a copy of this).  She didnt mention she hadnt recieved any confirmation as she didnt know if she would get one.  She then cancelled her road tax at the end of March (i think) as she was paying by DD. She then was travelling up north so didnt get her ,ail until last week. She recievd a letter dated 09/04/2024 stating she had failed to insure the vehcile and there was a £100 fine which could be reduced to £50 if she respons by 11/05/2024.  As soon as we noticed, i got her to dig  out the V5 and SORN'd the vehicle.   My friend has been a bit slow in checking the fault, however i suspect it will still be scrapped and is still on his forecourt. Is this possible to appeal?
    • worthy to not forget Just to let you know this bunch Kensington have been fined £1.225m by the financial regulator for treating borrowers who were in arrears unfairly. Claim those charges back plus the interest and tell them not to add any more to the account.     • Hi All. I went to visit a family friend in Rochdale on a new housing estate opposite a old row of houses. The location is Royle Road, Postcode OL11 3PE. I was originally parked in parking bays outside the old houses, then moved the car, when I noticed my tyre was flat, so parked on what looked like double yellows to use his air pump to check and inflate the tyres before we left the house.   In the time i went inside to sort the pump and power supply i got a PCN.  The tyre then got changed (has a puncture) and we left. PCN Number:         RE######## Date:             04/05/2024 Time:             20:36 Observation:         20:34 to 20:36 Reported location:     Royle Park Road Reason:        Parked in a restricted street during prescribed hours (Code: 01) I believe this PCN is not correct and has grounds to appeal: 1. My friend who moved into the property around 6 months ago, swears that even though it has old double yellows marked, they are not current or council marked.   He said the property development company had said they had marked them for ease of access during development. 2. The road i was parked on was Royle Road.  The PCN was issued for Royle Park Road, which is about 400 yards up the road. 3. There are no sign posts or marking showing parking  restriction hours in the entire area (there maybe on Royle park Road). I have attached a map of the Location where i parked as a red dot. I have 2 questions: a.  Is there a way to check where double yellow lines are marked on some register to check if they are current? b.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hey all, new here, have built up a fair bit of debt in the last few year, some of it was my own fault, some of it due to loss of a business and some of it due to loss of a job.

 

My debts are as follows:

 

Bank of Scotland/Blair Oliver & Scott - £13072.00 (Unsecured personal loan - In default).

Council tax arrears/Being handled by Sheriff Officers - £1184.58 (For 07 to 08 & 08 to 09 - Surprisingly I have no arrears for 09 to 10).

BT/Handled by DCA - £596.70 - Business debt from 3 years ago.

Scottish Power - £341.38 - Business debt from 3 years ago.

British Gas - £228.28 - Debt from previous address.

BT - £159.74 - Debt from previous address.

BT - £137.69 - Debt from previous address.

Ebay - £90.73

 

Total £15811.10

 

I have kept up communications with my creditors, kept them informed when I changed address etc.

 

Problem I've got is that I've been making payments to some of them for nearly 3 year now but have barely made an impact on how much debt I have due to Bank of Scotland adding interest to what I owe them despite several requests to freeze interest.

 

Council Tax Arrears

 

This debt is in the hands of Sheriff Officers, I think their now getting impatient as I have received a letter this week saying "we are instructed to commence enforcement action by way of Arrestment and/or Attachment of your effects. Where appropriate our solicitors may be instructed to raise a petition for your sequestration."

 

What do they mean by way of Arrestment and/or Attachment of your effects?

 

I wrote a letter back to them asking for more time to enable me to seek advice.

 

Bank of Scotland - Unsecured personal loan

 

At the time I took the loan, I was in full time employment, also had a business which was doing good but lost my job and eventually the business failed... the loan is now in default. They are adding more interest on than I can afford to pay each month.

 

Scottish Power

 

This debt was in the hands of a DCA (LCS) but I havent received any letters from them since January 2009, I have made 3 payments to them since Jan 09 but none of the cheques were cashed, I have also wrote several letters but no reply. Any advice on what could be happening here?

 

At present I'm in full time employment (temporary), but my income is less than my expenditure, I rely on help from family to put a meal on the table, pay bills, rent etc. I also own a small limited company, it isn't a big earner but also helps financially as I receive a wage from this too. The LTD company doesn't have any debt, doesn't make a lot of money (hence why I'm also in full time employment).

 

I currently live in a furnished private rented home. I'm not tied down to any long term lease or anything so looking for somewhere with a cheaper rent but very few homes round here that's cheaper.

 

Apart from the clothes I wear I don't have much in the way of personal assets, all I really have is:

 

Car - non runner, been off road for nearly 2 year, worth scrap value.

Van - occasionally need for work and help with LTD co, worth £500 maybe.

Laptop - old one, don't know what it's worth but doubt it's much.

Some tools - Under £100's worth.

 

I feel my debts have dragged on too long, I'm now at the point I feel that's affecting my personal well being (can't sleep, being treated for depression, I'm kinda finding myself not answering the phone or wanting to open my mail as I know what it'll be about). Basically I'm just seeking some advice on what to do now, I think I've done what I can but just need a bit help or advice on what to do next.

 

I apologise if this post is a bit long or doesn't make sense, I'm no good at this but do have a tendency to drag on a bit.

 

Your help or advice would be more than appreciated.

Just had a quick look at the links provided, will have a better read through them in the morning though, I don't take info in too well when tired.

 

Just worked it out that with what I have left at the end of the month (on the months I've got something left over that is), would take me about 458 months to repay my debt - that's without interest and charges and anything else that gets added on :confused:

I'd strongly recommend you make an appointment to see a local Citizens Advice Bureau or local authority money advice service, or indeed give a local Insolvency Practitioner a call to chat through your situation. There are people out here who are trained to guide you through the maze of debt solutions and point you in the right direction. You can google debt advice in your area to find such advice, or check out Yellow Pages etc.

Ok, had a better look through the factsheets, got a few questions though.

 

Regarding a Trust Deed, if I was to go into a Trust Deed, would my employer and landlord be informed (I have no rent arrears)?

 

It says I can't be a director of a limited company while in a Trust Deed, I own a small limited company and I'm the sole director. Would the company automatically be struck off or would I have to do this before going into a Trust Deed and would I be allowed to continue trading as a sole trader?

 

It states that my assets and property would pass to a trustee to be administered, I've worked it out that my assets are probably worth £1000 at most, would I still be eligible for a Trust Deed with a low value of assets?

 

I use my van for work, I also use it to earn a little extra income outside of work, van is only worth £500 at most (on a good day), would this be taken off me? Would I have to prove I need it?

 

I pay van insurance monthly by direct debit, also have broadband. Would I be allowed to keep these? Would the broadband be seen as a luxury item and cancelled?

 

In the meantime I'll try to get advice from Citizens Advice, but finding it hard to find somewhere that's open at a time when I don't work (boss isn't too understanding when taking time off for such things, asks a lot of questions too).

 

I appreciate your help.

Ok, made the time to see Citizens Advice, also spoke to an Insolvency Practitioner via email and phone. I have also managed to shuffle a few outgoings about and have a little extra left over each month... should of done this a long time ago, would have saved myself a lot of problems. :-x

 

Spoke about Trust Deeds and Sequestration, I can't go into Sequestration through LILA, my assets are low enough but the income is a bit high.

 

I spoke to someone the now about Trust Deeds, an Insolvency Practitioner will call me tomorrow evening to discuss it further and hopefully take it to the next step.

I've spoken with an Insolvency Practitioner, they don't think they would be able to take me on a Trust Deed as it's unlikely it would become protected unless I could raise my income which would be a struggle, if at all possible at the moment.

 

That really leaves Sequestration but at the moment I have no way of proving Apparent Insolvency.
