    • So, Sunak has managed to get someone to 'volunteer to go to Rwanda hasn't he? .. for just £3000 payment to the person plus 5 years free board and lodging isnt it? - cost to UK taxpayer over £300M+ (300 million quid+) isnt it? - Bargain says Rwanda, especially with all the profit we made privately selling those luxury chalets Bravermann advertised for us   I wonder how many brits would jump at that offer? Thousands? Hundreds of thousands? Lets see, up to 5 years free board and lodging and £3k in my pocket .. I'd go - and like that person - just come back if/when I get bored. First job - off to Botswana for a week to see the elephants.   Of course the paid volunteers going to Botswana are meaningless - Rwanda have REPEATEDLY said they wont take any forcibly trafficked people in breach of international law eh? Have they actually got any civil servants to agree to go yet - probably end up as more massive payments to VIPal contractors to go and sit there doing nowt shortly eh?    
    • Hi Wondered if I could get a little advise please. I entered into a commercial lease (3 years) and within a few months I had to leave as the business I was trading with collapsed. I returned the keys to the landlord and explained the situation and no money, also likely to go on benefits but the landlord stuck to their guns. They have now instructed solicitors to send letter before action claiming just over £4000. The lease was mine and so the debt. I know this. I have emailed the solicitors twice to explain I am out of work and that with help from family I could offer a full and final settlement figure of £1500 or £10pw. This was countered by them with an offer to reduce the debt by £400, or pay off the amount over 12 months. I went back with an improved full and final offer of £2500 or £20pw. This has been rejected with the comment 'papers ready to go to court'. I have no hope of paying the £4000 and so it will have to go to court. Pity as I have no debts otherwise but not working is a killer. I wondered if they take me to court, could I ask for mediation? I also think that taking me to court will result in a pretty much nothing per week payment from my benefits. Are companies just pushing ahead with action even if a better offer is on the table? Thanks for your help.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All

 

I have unfortunately got myself into a bit of a mess with Payday loans. I have recently lost my job and have 4 payday loans scheduled to leave my account at the end of the month.

 

As this is going to be my last wage I really need to ensure money does not leave my account and try to sort out a payment plan with these people or at least let them send to a debt collection agency and deal with them.

 

They are

 

PTP - £200

Wonga - £100

PDUK - 100

CashGenie - £100

PD Express - £160

 

I have rolled my PDUK loan over once and noted the payment was taken via card payment rather than a direct debit. I have been monitoring my direct debit to cancel any they set up but they have not set any up at the moment.

 

I need to know how I can definitively stop these companies taking money out of my account, I have my wages and will be expecting a backdates working tax credit payment to go into my bank and cant afford for these to be taken out as I need the tax credit money to pay off rent/council tax arrea's and obviously my wage needs to support me until I can make a claim for JSA or get a new job.

 

Please help do I need to cancel my card and get a new one ? I am not saying I wont pay these loans, but I obviously cant afford to pay them all at once and lose my entire wage, plus allow them to gain access to my bank account at any time and remove money.

 

Please advise as best you can.

 

I have also set up a new lloyds bank account but this wont be sorted in time unfortunately.

anyone can help me guys ? I have kids to feed and really need to ensure they cant get any money out of my account, I dont think I will have time to set up a new account. I have set one up with Lloyds today but cant get to the bank to take in my ID until next Saturday, the payments are due on the 22nd and 31st of this months

 

Help please I am worried sick these people are going to clean out my account and leave me pennyless, unable to eat and pay my rent :(

Hi

 

Only thing You need is to call your bank and rapport that your card is lost or stolen, just make up something, i told them i had lost my card on the bus.

And then make sure the direct debit is cancelled, try check your bank account from at least 4 days before you get paid.

I was worried like sick as well regarding PTP, but they didnt take any money despite i have heard rumours that a payday company can take ur money out on a cancelled debit card or lost card, or they can go into your account and take the money....that is not true!! just get your card rapported stolen or lost asap!! and u can still go into the bank and take all money out just bring identification. ;)

Some good advice from paske however on occasions funds can be taken from cancelled cards. It doesn't happen often but a few on here have had it done to them. Halifax told me that certain companies could force payments through. A new account is the only totally safe solution.

bit of an update, PTP is due tomorrow however there is no direct debit set up on my account, I have been checkeding my online banking since 4 days every other hour and there is nothing, so duno how I am supposed to stop it :s they said it will be taken by direct debit as when I applied for the loan they sent me a direct debit form. I will be cancelling my card today and instructing the bank to put a complete stop on it and ensure no transactions from the account.

 

Hopefully a new card will come quickly. I am due to get paid on Thursday so hope my money will be ok :s

Be careful here, if you havent actually cancelled the direct debit, it will go through anyway, it does not necessarily show up until the day it comes out, I wouldn't of thought you could stop this without changing your bank account if they have a signed mandate, I think you may need to ring your bank and check

Thanks for that, I have just contacted my bank and they have cancelled the direct debit for me, aparently they do not show up on internet banking until the first time a payment comes out. Natwest had assured me they have cancelled it now though and advised me to contact the company to advise them I have cancelled it.

 

The direct debit form even states quite clearly I can cancel it at any time I choose.

Bit of an update on this, despite my best efforts and assurances from Natwest PTP manager to get 2 direct debit payments from my accoun this morning putting me £260 overdrawn unauthorised.

 

Fortunately Natwest have been very helpful and recalled them and assure me this will rectify overnight and the money will not leave my account, I really hope this is the case as I have nmy wages being paid tomorrow

 

I have also sent an email to PTP to tell them I have to default and offered a payment plan, they have completed ignored the request and took it anyway.

 

Will see in the morning if the money is back but it better be!

No surprises there Kelly. You are very being patient with the bank as they are obliged to refund the money immediately.

They gave some blabla about it should have been cancelled 3 working days before (it didnt appear on my internet banking so no way of cancelling it until I rang on a whim) either way Im just glad the bank are with me on this one and hopefully I wont have any more problems.

 

I have a appointment with Lloyds TSB on saturday to set up a new account and get wages paid into that ASAP so that will sort it out once and for all

 

When I saw my bank statement this morning I seriously considered reloaning with them for highest possible, getting the cash and closing my account and telling them to get stuffed, glad I didnt!

Hi All

 

another update. Natwest have done their bit and direct debits have been returned today and my money is secure. I will be attending at 09:30am to withdraw my money over the counter and will attempt to get my bank account number changed if possible

 

I have received no contact from PTP, apart from one email saying 'please call payment department as they cant deal via email' I have just sent another email re-iterating my previous point.

 

I received a dubious call from someone from a company called 'First Start' last night at 9pm, I am almost certain this was PTP. Surely it is illegal to call someone up and impersonate another company ?
