    • OK  so you may not have outed yourself if you said "we". No matter either way you paid. Snotty letter I am surprised that they were so quick off the mark threatening Court. They usually take months to go that far. No doubt that as you paid the first one they decided to strike quickly and scare you into paying. Dear Chuckleheads  aka Alliance,  I am replying to your LOCs You may have caught me the first time but that is  the end. What a nasty organisation you are. You do realise that you now have now no reason to continue to pursue me after reading my appeal since you know that my car was not cloned. Any further pursuit will end up with a complaint to the ICO that you are breaching my GDPR.  Please confirm that you have removed my details from your records. ------------------------------------------------------------------------------------------------------------------------------------------------------------ I haven't gone for a snotty letter this time as they know that you paid for your car in another car park. So using a shot across their bows .  If it doesn't deter them and they send in the debt collectors or the Court you will then be able to get more money back from them for  breachi.ng your data protection than they will get should they win in Court-and they have no chance of that as you have paid. So go in with guns blazing and they might see sense.  Although never underestimate how stupid they are. Or greedy.
    • Thank you. Such a good point. They did issue all 3 before I paid though. I only paid one because I didn’t have proof of parking that time, only for two others.    Unfortunately no proof of my appeal as it was just submitted through a form on their website and no copy was sent to me. I only have the reply. I believe I just put something like “we made the honest mistake of using the incorrect parking area on the app” and that’s it. Thanks again for your help. 
    • They are absolute chuckleheads. You paid but because you entered a different car park site also belonging to them they are pursuing you despite them knowing what you had done. It would be very obvious to everyone, including Alliance that your car could not have been in two places at the same time. Thank you for posting the PCN so quickly making it a pity that you appealed since there are so many things wrong with it that you as keeper are not liable to pay the charge. They rarely accept appeals since that would mean they lose money but they have virtually no chance of beating you in Court. Very unlikely that they will take you to Court given the circumstances. Just in case you didn't out yourself as the driver could you please post up your appeal.
    • Jasowter I hope that common sense prevails with Iceland and the whole matter can be successfully ended. I would perhaps not have used a spell checker just to prove the dyslexia 🙂 though it may have made it more difficult to read. I noticed that you haven't uploaded the original PCN .Might not be necessary if the nes from Iceland is good. Otherwise perhaps you could get your son to do it by following the upload instructions so that we can appeal again with the extra ammunition provided by the PCN. Most of them rarely manage to get the wording right which means that you as the keeper are not liable to pay the charge-only the driver is and they do not know the name and address of the driver. So that would put you both in the clear if the PCN is non compliant.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I had a phonecall from a rather snotty, aggressive young man who demanded to know who I was. I refused to say who I was and demanded to know who he was, to which he mumbled something and I caught the word "Preston".

 

Eventually, I got fed up with him and told him to go away in the time honoured tradition of two words. Foxtrot Oscar!

 

Less than two minutes later, the phone rings again. This time a nice young lady. She also got told to Foxtrot Oscar and told, in no uncertain terms, that if her company phoned my number I would do them for harrassment.

 

Today, I was out and my hubby took a call from this same outfit. He warned them not to phone this number again or he would report them to the OFT and also the police for making harrassing phone calls and demanded personal information. It seems, for some reason, they are after me. Possibly because I have an account in dispute just now with eBay/PayPal and I believe iQor/Preston are dealing with eBay/PayPal.

 

What is concerning me more is where they got our phone number from. We recently changed internet and phone providers and have had our new number only a few weeks - and it is ex-directory.

 

What on earth is the point of having ex-directory when anyone can get access to it. Incidentally, neither eBay nor PayPal were given my new number.

 

As far as I'm concerned, Iqor/Preston can go away in short, sharp, jerky movements but I would like to know how they got my number:evil:

 

Ah well. Just have to have my trusty whistle at the ready evil.gif

Yes its concerning that they have got the number.

You need to look at anyone else who has been given your new number-have you registered it with your bank/other creditors/insurance/etc ?

Very few people have my new number - because it is so new. My bank's got my mobile number only so they wouldn't have got it there. Don't have any other creditors.

 

I have just had a horrible thought though - and I'll find out shortly. I'm wondering if the phone company's made an error and listed us instead of putting us ex-directory. A quick phone call from another phone to one of the directory enquiry lines should find that out.

 

If so, I should think someone is going to get a rocket stuck up their behind!

 

I'm not particularly worried about iQuor/Preston because the "debt" is very small - less than £100 and it's in dispute anyway with eBay/PayPal.

 

Now looking at getting TrueCall :)

 

I haven't had anything via post either come to think of it.

Heh-heh. I wasn't born yesterday. I won't give anyone any information over the phone, not even my name. To many unsavoury characters trying to get personal details for nefarious activities these days :wink:

 

Anyway, it would seem that our phone is ex-directory. I tried getting the number through one of the directory enquiry lines to be told politely that they could not give the number as it was ex-directory.

 

As it happens, the morons phoned back again (harrassment starting?) Thursday morning but hubby was in and answered the call. Gave them a load of bullsh*t and told them never to phone this number again. No calls yesterday or today but I bet someone tries their luck next week.

 

Showed hubby the True Call system and he's impressed by it so I think we will buy one sometime next week - with the call recording facility on it. Very useful I think.

 

Love the idea that we can choose who to speak to :D

 

Another one we keep getting a lot of and I know it is a [problem]/con is the recorded message saying "Please do not hang up. This is a government initiative...blah...blah...blah". I hang up. I've had at least 10 of these calls in the past few weeks - usually when I'm in the middle of doing something - like baking or cooking :evil:

 

True Call will put their gas at a peep too :D

I HAVE A MASSIVE PROBLEM WITH THIS COMPANY DEMANDING MONEY PAYPAL HAVE TAKEMN THEN MONTHES LATER TAKEN BACK and returned to the buyer after payments were taken through there safe payment taking site greater london police and local forces are taking this very seriously any info much appreciated they did stop ringing and threatening once you let them know you know the law they are not allowed to call you every day then put their phone down etc they are one small time preston based bunch of abusive theatening law breaking idiots praying on vulnerable peaple IQOR THE TRUTH ABOUT THESE BULLIES without a legal leg to stand on its disgusting they exist if you come acrosss them CONTACT TRADING STANDADARDS IMMEDIATELY

Deja vu. Is it just Preston or an actual DCA you have issues with? And why are these posts almost always around this time of night? As to your police comment ... Can you provide some proof of this, if they are taking this as seriously as you claim? There would be reports somewhere. Yes, no ... Should I be bothering to even reply ...

After my hubby blew their heads off over the phone and told them in no uncertain terms where to get off, they have never contacted us again.

 

They don't like the threat of legal action against them. That was enough to send them scurrying back under the stone they crawled out of :madgrin:

Don't let these people get to you, they really are at the bottom of the food chain in Debt Collecting Circles, They rely on catching people out and will try to get a payment over the phone before you realise that they have no powers whatsoever (normally after the event)

 

If and when they call, refuse to answer any of their security questions in the first instance, give them nothing at all - they will have to terminate the call if you do not confirm your identity - often their security questions are designed to "fill in the blanks" in their database

Insist that they "put it in writing" then hang up

 

If you are confident enough, turn the tables on them and have a laugh at their expense, "Who's calling please" "Can I Take your full name" "Can I confirm your date of birth" "Your mothers maiden name" obviously they will not give you this information, but it takes the wind out of their sails and gives you the perfect response which will be whatever they tell you is their reason for not giving out THEIR information. - Once they realise that they will not get a result they will drop your account pdq

 

They cannot access your funds

They cannot "send in the bailiffs"

They cannot take your house etc

 

it's all just bull and bluster designed to panic you into making a payment

I have also been receiving phone calls from iQor for a debt 12 years old. Would your current bank disclose that personal information to an third party? Woah, thats concerning! I have moved several years ago since the agreement was made, so there is no way that they have got my details from the OC as iQor have claimed.

 

Anyway, I didnt answer the security questions and told them to put it in writing, much to their shock and frustration. Got a letter demanding payment today, but the account has been in dispute since September with another DCA, so not sure what they are trying, but I am now an older hat, previously in a state of panic over these issues, but have now become more fearless. Though I have to say, it does still make my heart skip a beat when I get the letters.

 

But, Im sending my own little ditty to them tomorrow to advise that the account is already in dispute and it has not been answered, therefore no action can lawfully be taken by them. Also added they do not have permission to call my number which has been obtained without my permission.

 

I am sick of the battling, but I know its important to keep going!
