Does every bailiff need to be certificated by law i know about the hmrc site to check if the bailiff is certificated ?

Also if the bailiff is not certificated what happens from then on ?

The bailiff needs proof of who the person is they are after don't they ?

NO

 

It depends on what they are working on

 

Council tax, business rates and parking penalties - yes they must be certificated

 

Magistrates court fines - NO but only for the first 6 months, after this they must be certificated, however, arrest officers must be certificated at all times.

it depends on the debt type

 

it is very rare to not need a certificate and only bailiffs working for Philips, Marston's, Swift or Excel would fall in to the magistrates fines where they do not need them for the first 6 months.

 

Slightly correct...it is my understanding that bailiffs enforcing these Distress Warrants can work for 6 months without a certificate but that they CANNOT undertake any "enforcement" on their own during this period. They would need to be "shadowed" by another bailiff.
