    • The important thing to know is that MET - although they will send you threat after threat about how they will divert a drone from Ukraine and make it fall on your home - hardly ever do court. Even in the very small number of cases where they send court papers, if the Cagger defends, they drop the matter before the hearing.  They have no real intention of putting their rubbish claim before a judge.  The aim is to find motorists who are terrified of the idea of going to court and who will give in when the court papers arrive. Thanks for doing the sticky and well done on finding F18's thread.  Do what they did.  On the first page - I think post 19 - there is the address of the CEO of BP.  Write to them, lay it on thick about being genuine customers in the various premises, mention the small kids, the very short stay time, attach any proof of purchase - and request that they get the invoice cancelled.
    • Thank you for that, I have obviously already been convicted so I think the appeal lodged is for the previous offence? Sorry if that doesn’t make sense. I suppose my only concern is that weds I go there and they don’t let a stat dec happen. If they do then as you say and solicitor says it’s highly likely I’ll be happy with the outcome. But I’m being told there’s no guarantee for the stat dec to be hard Weds as that’s not what the hearing is proposed for. Solicitor has stated that you can put a stat dec before a magistrates at any time so it shouldn’t be a problem.   
    • I re-read the extract from your  solicitor's letter this morning and think I might understand what they have in mind. I believe (and it’s only a guess) their strategy is this: 1.    You will make your SD 2.    You will enter fresh pleas to the four charges (not guilty) but will offer to plead guilty to speeding on the understanding that the FtP charges are dropped. 3.    If this is accepted they will attempt to argue that the two offences were committed “on the same occasion” 4.    You will be sentenced for those two offences (the sentence depending on whether the “same occasion” argument succeeds). They also have a plan in the event that your offer at (2) is unsuccessful and you are convicted again of the 2xFtP charges (and so face disqualification under “totting up”): 5.    They will make an “exceptional hardship” argument to avoid a ban. 6.    If that is unsuccessful they have already lodged an appeal in the Crown Court against that decision. (This is the only “appeal” I can think of). 7.    They plan to ask the court to suspend your ban pending that appeal. If I’m correct, I’m surprised the Crown Court has agreed to accept a speculative appeal (against something that hasn’t happened). The solicitor says this is to lodge it within the normal timescales. But you will have 21 days from the date of your conviction (which will be next Wednesday) to lodge an appeal with the Crown Court, so there is no need for a speculative appeal. I have to say that an application to have your ban suspended pending an appeal is unlikely to succeed. The Magistrates Court is unlikely to agree to it for one very good reason: if they make such an order (suspending your ban until your appeal is heard), all you need to do is not to pursue the appeal and the Magistrates order suspending your ban will remain in place. Hey Presto! No ban and no need for you to trouble with an appeal. Perhaps he will ask for your ban to be suspended for (say) three months or until your appeal is heard (whichever occurs first). This potentially creates a problem because if your appeal is not heard in that time either your ban will kick in or you will have o go back to court to get the suspension extended. But the solicitor obviously knows more about these things than I do. I would want to be very clear about this solicitor’s fees and what he proposes to charge you for. As I said, there is absolutely no need to lodge an appeal with the Crown Court. That can be done if and when it becomes required. But I am still firmly of the opinion that it is overwhelmingly likely that you will not need to progress beyond point 2 above. Point 3 is optional and I don’t know whether he solicitor has made It clear to you that the only thing you will avoid in the event of success is three penalty points. You will still be fined for the second offence and your driving record will still be endorsed with the details, but no penalty points will be imposed. Do let us know how it goes.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hope You can help me and give me advise on this.

As i have been searching and been reading different threads and also forums regarding all this with claiming back charges etc...

 

I am hoping this will be possible in my case, allthough i have got confused if its only old charges when they were a lot more than £12?

 

I took out a Barclaycard back in April last year 2009, it was ment for me to be a kind of reserve and also good to have. If i was going on holiday and needed a bit extra cash.

But things changed from that and turned into nightmare for me, because i moved from Denmark around 2 years ago, my credit score is very bad etc.

Despite i have good full time work now and have been since march 2008.

But i used my fionces bank account for my wage salery etc.. and didnt open a bank account until April with Barclays.

And also tried different companies for a creditcard, and Barclaycard accepted me.

Since then i overspent, and didnt really think to well. So suddenly my Barclaycard reached the 260 pound limit.

I paid in full, but then spent it up to limit almost.

I continue paying the minimum as i should, but problem also is that the payment date is 15th, and i get paid 26th from work.

So i ended up getting late payments fees also had direct debit rejected etc..

Long story ill keep it short ;)

I also tried contacting Barclaycard several times regarding this, that i wanted to change payment to around where i get paid to avoid all this.

But because of different things i havent followed up on it.

And now my account keeps going over limit because of charges etc..Also had months i havent even paid minimum.

My other problem has also been that ive gone into the payday jungle :( because of my credit score, i coudlnt get any low interest loans. As i really wanted to try get a transport for myself to work, as i am using bus, and that is horrible here in UK. You cant count on anything, and ive ended up spending lots of money on taxies :(

So my situation is quite bad right now, also fighting with Vodafone because of a stupid expensive mobile contract i took out with them at 45£ a month, because the phones i really wished for, could not be taken out at lower tarif with any other mobile companies, as they all rejected me back then.

 

Sorry for this long text, i will answer any questions, as its a bit hard for me to explain proper and keep it together :)

 

To cut it short, please help me and answer if i can claim back charges for my barclaycard? they are all 12£ charges i have mad charges list here, not including last couple of months.

What can i do and what should i do? :)

 

I see this is a brilliant forum, please help me get sorted and get back on track, also if anyone can help me regarding the paydayloans and phone contract.

I have been thinking about going to Barclays (my bank), and see if they can help me with a loan or overdraft of 1000 pounds.

And then i will clear the paydayloans, and also get back on track with Barclaycard and also phone. Allthough i have low credit score, and also not best credit worthiness , then i somehow hope they might be able to help anyway, if i am honest and put all things on the table?

 

But most important as this is mainly what the thread is about, can i and what should i do regarding the 12£ charges?? as if i could clear them, then i would easily be able to maintain the card again with proper payments every month.

 

Thank You all, please do not comment and tell that ive been stupid, and why take out payday loans.. etc.. i know that!! that i was stupid, and i am regretting all that now :( I just want to learn from this and get back on track ;)

Please anyone able to give me a hand? As im really confused what to do, i have some ideas, but dont want to get off to a bad start. Want to make sure i do everything from now in correct order, to make proper action, for the best possible chance of getting refund and get my balance up to date.

Hi Paaske and welcome to CAG.

 

No one (I hope) will tell you you're stupid. You've come here for help and you'll get it.

 

Your case with BC is simple. All of the above charges are unlawful penalties and you can reclaim them in full.

 

Read the Reclaiming Guide at Link No1 in my signature below. A lot of it refers to reclaiming bank charges but some of it is still relevant to your credit card charges case.

 

Complete a site spreadsheet listing your charges - this will be your Schedule of Charges or SOC.

 

Send the SOC to BC with this letter to reclaim the charges - http://www.consumerforums.com/resources/templates-library/48-bank-templates/121-bookworm

 

Let us know what they say, or ask any questions you may have.

 

Read other threads and you will learn plenty.

Thank You so much Slick ;) just what i need to get going, im gonna look into this tomorrow morning.

Can i send Barclaycard an email from my secured account page, and ask them to stop keep calling my work and sending texts etc on my mobile?

I allready spoke to them months ago, that i was furious that a automatic voice called up to my work phone, and saying this is barclay card....asking for me.

Also ask them to stop adding charges etc, because my account / barclaycard is in dispute?

But they have done it again last week.

If anyone have a suggestion what to write them, then i would be gratefull.

I have an idea and will try making that in the morning.

But it is possible for me to put my account in dispute? ive read that other places, but not sure if its correct in my case, as i somehow have missed out on payments.

Hi Paaske,

 

You should follow my advice and send off the Preliminary Claim letter and the SOC. This will place the a/c clearly In Dispute but don't expect BC to stop chasing for payments. Use Recorded Delivery or get a free Certificate of Posting from the Post Office when you send it.

 

You can email them if you want, but we try and keep everything in writing so you have copy letters if you take BC to court.

 

I suggest you send them the following letter separately about their phone calls:-

 

Dear sir or madam,

Account No xxx xxxx

I refer to the phone calls which you have made to contact me.

Despite previous requests, you have again called me at my place of work where I cannot take personal calls. This is a clear breach of the OFT Debt Collection Guidelines and Sections 2.6(a) and 2.6(j) refer.

Any further attempt to call me at work will be reported to the OFT for investigation. You may write to me if you wish, but no further contact is to be made by phone.

Because of unlawful penalty charges, take note that the account is IN DISPUTE. Until this matter is resolved, you must refrain from any further collection activity.

Yours faithfully,

You should also see here - The Consumer Forums - Debt collectors There is a letter to use when the a/c is in dispute about charges, but that should only be used after you have written asking for the refund. There are also other good letters to look through.

Hi

Again thank You for taking the time to help me out :)

 

Because of lot of work from morning to late night, ive not had any time almost.

But i have managed to get all the charges of 12 pounds set up on the spreadsheet together with dates and total amount.

And i have also removed the interest calculation, as this is only needed if ends in court. Hope i am right here :)

I am off work friday, and i am going to send the spreadsheet and also the other letter trough recorded delivery with royal mail.

 

But i have one last question, as im still in doubt if there is more i can claim or if its only the late payment and over limit plus direct debit charges of 12 pounds.

Also last question, As i have not paid some of the months and not paid last month, will this give problems in me claiming? as im afraid if im in dispute with the contract rules, as i have not kept minimum payment? But main reason for this, has been because i have been furious with Barclaycard, as they are really p... me off, especially one woman that is hard to understand, who i have spoken to lot of times, both when she has phoned me at work, also my mobile. Even when i contacted them a couple of times way back, i went trough to her...call it luck hehe :)

When she phoned, she kept saying You need to pay , what will You pay now, and she kept repeating herself... i ended up most times screaming in the phone, that i am not paying until Barclaycard contacts me proper so i can understand, or someone that will listen to me.... Your charges are unlawfull GRRR....

Sorry had to have this out :) exhausted after work again!!!

 

Well hope i am not to enoying.....will be the last from me, hopefully i can get last thing on place, so i can post letter (letters) on friday :)

From what I can see, there are two £12 penalty charges to be reclaimed.

 

I'm not sure what you mean by " .....plus direct debitlink8.gif charges". :confused:

 

If there is mis-sold PPI on the a/c this can also be reclaimed but should be dealt with separately just now.

 

It makes no difference whether you have made the right monthly payments on time or not. Their penalty charges are unlawful and they must repay them in full.

 

If this annoying woman calls to pester you for payments, the answer is simple. Tell her, or anyone else who calls from BC, "This call is being recorded, I will not answer any security questions and, if you have anything to tell me, put it in writing."

 

Then hang up. No need for screaming or rudeness and, in the end, they will realise they cannot bully you. :)

I have completed the pre letter, with addreses and account number etc. Also done the charges letter.

What about signature.....ive read i shouldnt used my real signature?

Or is that in different cases? :)

I suggest you use the statement address at this stage.

 

Sign the letter as normal if you are not disputing whether the a/c is enforceable. Or just write your name.

 

Your Prelim Reclaim letter should just ask for the amount of charges you are reclaiming. Include the SOC but don't show the 8% interest column at this stage - you only claim the 8% when you file a claim at court.

 

You only mention "plus interest of ....." if you are claiming compound interest, which I assume you are not.
