      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

HELP!!!!!!!!! I'M BEING TEMPTED TO THE DARK SIDE HA HA!!!!! :D

 

Got a letter from court today: General form of Judgment or Order.

It is ordered that unless the defendant files at court a completed allocation questionnaire by 4pm on fri then the defence will be struck out and the defendant pay the claimant £XXXX together with interest and costs. :p

 

I'm so tempted to sit back, do nothing and win!! Is that terrible?? :(

 

BUT......equally I want justice!!!! If I do nothing they get to never admit liability and carry on doing this to others :mad: No, I think I've decided....I think I'm gonna try to submit my SJ and see if the judge allows it.

 

What d'ya all think??????

Firstly after all the brainmush and stress this has caused its in no way terrible to sit back and get what is due to you! On the other hand you deserve to string them up :lol:

However tempting, I think that if the court has made this order, you should let it ride that way.

 

I think it is quite clear that they have no intention of trying to defend their case, they know they can't and will just cave in rather than go to court. They tried the bullying, they bit more than they could chew and now they're just going to pay up and write it off as another one that got away. Sadly, for one like you, they'll have another 50 who won't do a thing, so they're still quids in no matter what. :-(

I agree - I wouldn't push this too far you never know what they will come up with. A win's a win and I'd take the money honey :)

Thanks Bookworm, it's that exact thing that is urging me on! I can't stand the thought of them carrying on with this practice and getting away with it :-x I feel like it fell this way for me for a reason. I've put so much time and effort in, I feel almost cheated that they're gonna away with it so to speak.

Thank you :) It seems that is the general consensus! I mean we all know it'd still be a win even though they'll argue it was a "business decision" ;) I just would've loved to have been able to get a proper judgment :Cry: But hey ho, at least I can still help others fight against them :D

 

It's not over yet though, they might surprise us all and file their aq :lol:

I have had the best day today :D I got my car back!!!! :D Admittedly I had to buy it back but nonetheless, the car that Welscum Finance illegally repossessed is now back with me :) And the best bit is it's hpi clear and totally belongs to me :p I hope to God you're reading this Welscum, cos I know you are trying to deprive me of my day in court and sold my car so I couldn't have it back but it didn't work!

 

On my claim form I asked for £4K, (value of car as stated in agreement), OR my car back, which incidentally is currently worth less than half that amount :p Ideally I would've liked my car back rather than the money, as it was always about the principle-they unlawfully took it, therefore they should rightfully bring it back! But seeing as they decided to sell it after the case had been allocated to trial they now have to give me the £4K. Which is cool cos now I get my car and their money! (minus the minimal amount I purchased it for of course ;))

 

I don't care if I get judgment by default cos the outcome will be that I get my car back and the **** get hit where it hurts-the pocket!!!! And that's a win in my book even if a judge hasn't said so :D

 

Come on Welscum, I dare you to file!!! 4 days and counting :p

I'm so happy!!! :D She's old and tatty with bits falling off here and there, but I love her :)

 

The cheeky salesman even used me to try to sell the car! "One lady owner for last 4 years"! I didn't let on who I was til I sealed the deal :) I made such a fuss about them not having the proper key! "How am I supposed to activate the alarm then?? It'll invalidate my insurance!" Anyway, after I haggled him down to his bottom dollar I told him that the 'one lady owner for last 4 years' was me :D His face was a picture!!! Especially when I pulled the key outta my pocket and remote locked it :lol:

 

I told him the story and he was gobsmacked, he couldn't believe that I'd recognised the car on auto trader and driven 90 miles to get her back! It warmed his heart that she was coming home and he said he was gonna tell the story to everyone :lol:

 

I've had such a lovely day :) Irony is today is 4 years to the day that I bought the car in the first place and my original agreement was for 4 years too! Some things are just meant to work out a certain way ;)

just been reading around the threads, wot i am now begining to understand is that under ECHR, we as a LiP are supposed to be put on an equal footing. however "we are not". take for example in your case, if the creditor had screwed up, it would be a simple case of re-submit and very little costs awarded to yourself (if any). has your case been allocated to track yet:confused:
