    • as with some of your threads in the past. you are not reading things carefully and understanding things properly by going off on assumptions. not sure where you are getting your driving licence is being revoked from? nowhere do they use that word. nothing to do with it. vehicle excise licence. (Road Tax), a VEL cannot be revoked only voided. you are also wrong and nowhere does the DVLA state they cancelled the DD.  the court summons clearly states in the DVLA statement: it was your cancelling/reclaim of the DD on 15-02-2024 that caused this, NOTHING to do with the DVLA, they did not revoke the VEL. as they received no payment, on 02.05.2024 the VEL was Voided. it appears you have got the new DD setup wrong to the wrong DVLA account/ref number/VEL number. they have not received the payments to the correct VEL. i would be ringing DVLA and finding out where these payments are on their system and get them attributed to the correct VEL. that should solve the problem.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all,

 

I have a joint 2nd mortgage with Ocwen/iGroup/GE Money from 1999. Around this time last year I saw an annual statement which showed some £7500 outstanding in the final year of a £14000 10yr loan & listed regular "additional interest" charges which were greater than the regular interest. I queried the figures with GEMoney & was sent an our 1st sight of our 'interest bearing charges statement'. I made an official complaint re not being informed re outstanding charges which they logged & gave me a reference number but never responded to. I then sent SAR in Jan & received documents in April finding out that "additional interest" had been accruing on our account from it's second month & that was 2yrs before any action ie returned DD, which may have resulted any charges. Our payment history has been far from smooth resulting in charges around £2500 up to 2007 but GE's annual statements have been designed to hide charges & rack up interest if you miss them. I have statements both monthly & annual which do not correspond with the interest charges statement.

Around the same time my business went bust & my wife & I are also now in the midst of a long overdue divorce so I had not followed up, but trying to juggle the divorce, bills & deal with missed council tax from when I was away from the property has resulted in no payments to GE since May & they are seeking possession. Arrears are now £1200. My wife made an offer of £100 on top of the regular payment before the 1st hearing in August but nothing has been paid & in any case the hearing was adjourned as GE's paperwork was not correct. They were directed to File & Serve the copy mortgage deed within 18 days which they did but they didn't send us a copy & we weren't to be "charged with costs of & incidental to today's hearing".

I stupidly had not filled in a defence so I urgently need help with that also can anyone please check our Credit Agreement

The first hearing was in August, and it was adjourned. Is that right? Do you have a date for the new hearing?

Arrears are £1200. Have you spoken with the lender? They may accept an offer of a lump sum against the arrears and your undertaking to make the monthly payment plus an amount off the arrears. Is this a possibility?

Had the hearing today. GE Money were granted possession in 35 day's. The loan finishes 15/12/2009 & even if all the arrears are paid GE are not willing to extend the existing term. Round 1 to GE Money, so I guess I'd better look over the threads for the next step :cool:

Hi there, you need to enter an N244 application at court asking for time to sell - there is case law you can use for the judge to consider. I have affixed an N244 form to this post so you can see what it is. If you need help filling it in - in particular Q.10 of the form (your defence statement), please let me know and I'll help you draft it.

 

There will be a fee of £75.00 to pay when you take the form into court. However, if you wait till you get an eviction notice the fee is £35.00.

 

In the meantime you need to get a valuation on the property and get an estate agent so you can show the court you are serious about selling and not just playing for time. You will need some documentary evidence that you are selling to take to the court for the hearing, so you need to get on with the valuation and estate agent asap.

 

Is your primary mortgage up to date?

Is there enough equity in the property to settle both mortgages?
