Hi All,

 

Just trying to clean up my wifes credit file, had nothing from HFO regarding this debt, however looking at the credit file it state a defualt date of 18/08/2007, however the last payment which was confirmed by HFO was on 22/01/2007 so will the debt be SB Jan 2013 or Aug 2013 can any help

No. SB date is nothing to do with the recorded default. At present the default will fall off in August 2013.

 

However, seven months to record the default with the CRAs is a tad long. Should really be 6 months max, if they are treating their customers fairly and in accordance with guidelines.

 

You should complain to the original creditor about the delay in defaulting with the CRAs, and ask that they arrange with HFO to change the date. However, the date will probably only be moved back a month. Maybe not worth the bother.

Stat barred = no payment (to any party) regarding the debt and no written acknowledgment.

 

The entry remains on file until the full six year life of the default expires.

Well checked the credit file today the debt relating to HFO services is still listed copy below, we have double checked and the last payment was on 22/01/2007 which was confirmed by HFO therefore is now Statue barred. They issued default on 18/08/2007, will the credit company remove the account & default after the date 18/08/2013 or do we have to ask HFO ????????

All references to a defaulted debt must be removed from your credit files after 6 years has passed from date of default,

whether paid off or not.

This is so that someone who continues paying something even after 6 years from default should not be at a disadvantage

to someone who pays nothing after default and ends up with a clean file after 6 years.

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

yep on the 6th anniversary of the default date or soon after depending on the CRA normal updating schedule.
