      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All, We ahev spoken to M&S today and they have confirmed the followng details:

 

1, The last payment made to the account was at the end of December 2006 ( £101.19 )

2, The debet was sold to HFO Servcies on 13/09/2007

 

And if the debt was sold back in 2007 both M&S and HFO never wrote until now ?????

More mess. HFO Services? Not what HFO says.

 

HFO will try and claim interest from the date of assignment. They can’t. They can only claim from when you were told of the assignment.

 

They will probably produce a new M&S letter from September 2007 saying it was sold to the Irish company, before it existed!

Hi All,

 

M&S informed that the debt was sold to HFO Services at 165 The Broadway, Merton, London SW19 1NE on 13/09/2007, and not to an Irish company ?????? as we last paid the debt in Dec 2006 can HFO enforce the debt and take goods such as wife car etc etc

If HFO claim to have told you at the time of assignment that the account was sold to HFO Capital, it would have been to Cayman; then when Ireland supposedly took over Cayman’s assets in 2008, they would have had to send another NoA. But they didn’t ever do this with anyone, and that will be another one of the nails in the coffin.

 

Anyway, everything sold to either of the HFO Capitals is instantly reassigned to HFO Services by virtue of the CP2 document. HFO have gotten themselves into rather a mess.

Hfo are a long way from enforcing this IMO and can be challenged on a number of counts. The threats they spout in their letters are untrue anyway and there is no way they can just come along and seize goods.

 

Complaints to the relevent authorities will be really helpful in getting this shower put out of business

We have asked M&S to confirm in wrting the details ie when the last payment was made, who and when the debt was sold etc , will the confirmation from M&S help use against HFO ????

 

 

 

Yes - definately, you have also sent the SAR request to M&S? This will be helpful also, if they can send you everything they have

After chatting to the Wife she said the debt may have been sold to roxburghe (UK) limited and then to HFO Services on 13/09/2007, helpfully we will have a full account who and when the account was sold to from M&S shortly. If the account was sold to Roxburghe UK ?? who are they and when did they sell the debt to HFO

 

what a mess its like opening a can of worms

Rox are part of the can of worms and debts were sold to them and then passed to to one of the HFO companies. I am sure a detailed explanation will follow

A sale agreement does exist between HFO Capital Cayman and M&S. I’ve seen it. It identifies Roxburghe as the company dealing with the admin of the account.

 

If you push this point, HFO will get M&S to send you a letter ‘clarifying’ the situation.

 

But it shows that neither M&S nor HFO are terribly good with the accuracy of their admin. Barclaycard are worse. I also have incontrovertible evidence that HFO have recreated letters from Barclaycard to ‘clarify’ issues which, even if the facts are true, is naughty.

Hi, When my wife called M&S first to ask who and when the debt was sold, they stated the name roxburghe ? at first i thought this was the start of the address but then she quoted HFO Servce with there full address in london, we think ithe debt was with roxburghe (UK) limited first and then to HFO Services but we will have a good idea when the letter of confirmation comes from M&S.

 

If the debt was sold on 13/09/2007 to the first with this company roxburghe and then to HFO Servcies are the owned by the same company, once we have more details we will post replies

BUT this is the THIRD Company within a couple of weeks to insist the debt was sold to HFO Services.?

 

Are they all wrong or just begining to tell the truth?

 

Which ever way it is it is certainly a cause to doubt the validity of any assignment.

 

Am ot even sure HFO relaly know who purcased what and when.

Well spotted DoH, but have you noticed the address for HFO Services, not theirs but TR,s, I have a feeling someone has contacted these companies and asked them to remove the Roxburghe entry and replace with Services.

US President Barack Obama referred to Ugland House as the biggest building in the world or the biggest tax SCA* in the world.

More help needed now, today after weeks HFO have sent a copy of my wifes application form dated 1998, however we have also asked will / can they provide a full account of the account as the debt has not been paid for a number of years and so far they have refused, they just keep sending the 72 hour letter again attaching our full credit history file. what more action can we do or just keep waiting.

 

They are calling my wifes mobile everday, so she has changed it now, also we are moving home soon ( redirected mail sorted ) but do we have to tell HFO about the move, any more help would be great

Are you able to scan a copy of that application form with all personal details covered? Does it contain terms and conditions?

 

Need some idea of what is on that form so that you can respond to HFO accordingly.

 

Will you be able to have your mail directed when you move? It is not a good idea to loose contact as firms have been known to obtain CCJs by default using old addresses.

 

I think that the need to complain very loudly to Consumer Direct about the continued harassment as you are disputing this. Also complaints to OFT about this and the correspondence they are sending.

Update as of Aug 2011 ,

 

On checking my wife credit file HFO Services

 

Company name:HFO SERVICES LTD Who's this? Account type:BankStarted:11/05/1999 ( OLD M&S Credit Card ) Default Balance:£3,520Current Balance:£3,554Defaulted On:18/08/2007File Updated for the Period to:17/07/2011

 

They have filed default on 17/07/011 however on checking the last payment made to M&S was early 2005, we have wrote to M&S and had no replies what action should we do ????????? My wifes debt are currently over 25K, and mortgage balance /shortfall of 40K would bankruptcy be the best way forward.

Hi again. Bankrupcy is a very personal thing as a lot of factors have to be taken into consideration and it can help some people but not others. It is worth checking out advice from someone like National Debtline, http://www.nationaldebtline.co.uk/england_wales/, some very good stuff there. As for HFO, it looks like the M&S debt could be Statute Barred anyway. Have you rung M&S? Ask them when the last payment was made and when they sold this and to whom. You can also send them a SAR which costs £10. Are HFO still contacting you?

We rang M&S and got nowhere they could not locate the acount so we wrote and enclosed the £10.00 whch was never actioned and the payment was not cashed, as far as HFO had nothing for a few months now maybe they have given up ? but they did input the default on 17/07/2011 on the wife credit file?, also what action can we take to get the credit file change as if the account is statute barred and HFO are inputting incorrect data can this be removed.

You MUST reissue the SAR to M&S. Did you send it recorded? It looks to me as though the sale date of the account is recorded as the default date. They cannot record a default two years after the last payment.

We have just been checking all the paperwork which we have and we can confirm the last payment which was made to M&S was on 22nd Jan 2007 and nothing after that date. can HFO post a default on my wifes credit file? if no payments have been made since 2007, also we will send another SAR to M&S also can M&S sell the debt on without if forming my wife as she has not signed any paperwork to confirm the debt sale.

Hi All, Well the story keeps on going, today we have checked my wifes credit file and HFO have issued a default on the credit report but can they still do this as the very last payment made was to M&S on 21/01/2007 and since then nothing. Is it legal for them to issue a default on a debt so old. ????? Can we get the it removed ????
