No-one has said you should take the advice on this site as the only advice. It is a self help site where people give their opinions and time freely and in good faith and is usually based on shared experience.

 

If anyone is unsure they should always taken legal advice, either from a free counselling service such as CAB, Nationaldebtline or - if they can afford it - from a fee charging solicitor.

 

Also, in most cases the Claimant will get a copy of your defence from the court before the hearing - the court will quite happily tell you that if you ask.

Hmmmmm Something not quiet right with this one, Being made redundant, re-employed and giving redundancy back !!!!! Original thread in June and

took the advise from this site, then all happy with Ell's responses and

must say the defense makes sense to the information which was made available.

 

Then............ Her last post, which does not make sense to me at all

 

"I dont think i will visit this site again "

Oh well, lets hope that her solicitor can get it sorted for her and

it doesn't cost her too much in legal fees.

i understand that this is a self help site and am glad that we got the advice that we needed but also that people who are vulnerable would only read on here what they wanted to hear...

I was a tad angry yesterday as was asked by my legal rep if i understood the statement given to me to add on the N244 form and I did not

especially the bit about cheltenham and gloucester verses someone ( whats that?)

 

so carry on giving advice Ellen as you do give very good advice and we have followed it in the past.

Luckily i can afford the legal fees which are minimal in this case but think it is a better route to follow.

 

Thanks for all your help - we do appreciate it and that other guys comment - yeah whatever mate you do not know the half of it so dont make assumptions about people you've never met or spoken to - prat

I think you are being rather unfair on Ellen here.

 

Firstly the Cheltenham & Gloucester vs Norgan is a very common precedent used in these cases, and you are only showing your ignorance and that of your legal advisor by not using it in your defence.

I suggest you search the internet for this case and its implications specificaly to your situation.

 

Ellen devotes a lot of time and effort to this site and has helped many hundreds some who can and some who can not afford legal help. If you had an issue with anything best thing would have been to send a private message.

 

I understand any person in a desperate situation as yourself may panic and say things that they dont mean,

I have avoided repossession many times with Ellens excellent help and I know the litigation process very well , I dont see anything wrong with the advice given.

I think she deserves recognition not this kind of attitude.

 

In any case. I wish you and your legal advisor well and hope you get the result you are looking for.

Nobody asked you to ask or take advice given, I hope you dont loose your house but you cant blame this site if you do

What's so difficult about the statement re C & G v Norgan?

If you don't understand it, your legal rep should already know about it if litigation is his/her specialist field.

 

Many of us are grateful for all the advice Ell-en gives on this site - its free & she gives her time & effort to anyone needing it. To imply that her knowledge is limited is, frankly, an insult :mad:

How very rude, is all I can say. Happy to expect all the help when panicking, but quick to throw it all back because they 'can't understand it'. Good luck with your solicitor. I hope they can explain all the legal jargon to you in words of less than 2 syllables, and don't charge you too much for the pleasure of doing so. I have been in the situation of having my home repossessed, and frankly I would have been extremely grateful for any help Ell-en could have given me.

I too would have been most grateful for Ell-enn's advice two years ago when we were almost repossessed and my OH took an overdose as a result of the stress it caused, but unfortunately for us we didn't know about CAG then:eek:

from reading dsjulies reply she does appear to me to be thanking ellen for all her help - read it before you reply - she is obviously confused !

 

and in all this the best advice to anyone in an eviction case is SPEAK TO YOUR MORTGAGE COMPANY!!!! last thing on earth they wanna do is evict you!!!!

 

and everyone on here stop giving dsjulie a hard time - she is under considerable stress obviously !!!! grief thought you people were meant to be supportive????

 

 

and in reply - yes you can have to pay your redundancy money back if you are re-employed by the same employer within 1 year - check your facts first! and read the previous posts

Well obviously no-one who has replied so rudely to what I put actually thoroughly read my last post ? As I did thank Ellen for her advice and help

She is brilliant on this site

 

I am actually allowed to have an opinion

 

Thank you to Lynda who can actually read and yes I am now very hopeful that when I appear to defend my house it will be saved.
