Also, you haven't told us anything about what has happened. We don't know dates, items dispatched, value, whether they were properly declared, whether you bought so-called insurance, you have been declined reimbursement but we don't know why. If you want us to help you then you will have to give us this basic information. Also the fact that you are an eBay trader makes this slightly more complicated although it doesn't at all affect your chances of success.  Read the other threads on this sub- forum – and especially the pinned threads at the top in order to understand the principles. You also quickly understand the kind of help that we will give you and you will understand some of the draft documents which have been used in other successful claims.
    • Thanks, I'm finishing up the skeleton and hope to have it done today. Will look at statement of case too and get that done over the next few days.
    • But, but, but... They've already sent you a letter of claim, which said... "Should the outstanding balance not be settled by 20/04/20204 we will commence legal proceedings against you without further notice." 🤣 🤣 🤣

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

In early July 2009, at 0230hrs, I was rushed into my local hospital, and 24hours later I was operated on, and they found a perforated small bowel.

Then 4 days later I was sent home.

I cannot complain about my treatment in Hospital as they were great.

The staff were 100%, the doctors also.

This op was life saving major surgery, and all they found was a small hole in my bowel, which if not found would have been fatal.

I have an 18 inch scar from my operation and the knowledge that no cancer was found.

All I can say is Thankyou to all involved at my local hospital.

I am now recovering from the op which is a slow process, after major surgery.

A successful and positive outcome.

I would love to hear about more positive stories instead of people always slagging the NHS off and putting it down.

I have worked hard for the NHS for the last 30 years and care for the job I do. I also fight hard to maintain good care for those I care for, and will continue to do so.

I also had a good outcome from NHS ! I started to loose the sight out of my left eye got refferred by casaulty to emergency eye clinic,They found i had a detached retina and that very same day i got reffered to another hospital and went there! The next day i had an operation to fix it,All the doctors and staff there were brilliant I even had a doctor look at me in evening when i arrived at hospital who were able to treat me! So yes the good old NHS was there for me on that occasion! They are very good with emergencies:)

Hope you still makeing a good recoery now and feeling a lot better! As you say the good old NHS are there for people when chips are down,I also want to mention how good they were when my OH had a heart attack and the prompt help they gave him and how caring the nursers and medical staff were during his stay! Another positive example !

My wife worked 40 years as a SRN/SCM, and ended up as a Snr sister on the same surgical ward as I ended up on,and she specialised as a Stoma Care Nurse.

I have great respect for the doctors who dealt with me, and the nursing staff and all the rest of the team.

When I came home, my wife went into Sister mode, so I was unable to pull a fast one on her, as she has seen/heard it all before.

Its now 12 weeks since I had the op, but I do not over do things as my stomach tells me straight awayto slow down.

Glad I do not live in Yankee land and have to pay for my treatment.

You have paid for your treatment through the high taxes we suffer in this country. Just because it is free at the point of access does not mean it is free. The NHS is only good because of the front-line staff who work in it. As a system of health care provision it is a mess, being used as a political football by all parties as a vote winning tool.

I was sent to hospital on the 09/04/1990 after collapsing in my local diy store they thought i had meningitis so after having a one week stay in hospital then a lumber puncture i was sent home to rest.

 

the following night i was rushed back to hospital after taking a grave turn for the worst.

 

I was given an MRI scan (one of the first to use this new piece of kit at the time) and it showed up an subarachnoid haemorrhage- aneurism of the left middle cerebral artery.

 

So at this point I was sedated and rushed to the nearest nuro surgery unit at Southampton and went under the knife to stop the bleed.

 

I was put in an induced coma for 2 mths to aid recovery and after 4 mths was transferred back to hospital at portsmouth for a further month and underwent physiotherapy on my rightside.

 

Now considering all this was some 19 yrs ago and im still here 99.9% fit and the fact stroke treatment has come a long way since then i cannot thank the NHS enough.

 

Admittedly my condition was not spotted straight away and I was sent home,but then not enough was known about the warning signs it still is not spotted straight away hence the adverts we have all seen on tv.

 

My thanks goes to that MRI scanner an excellent piece of kit.

 

Anyway i just like to say here's to another 20 yrs as the last 20 has been fabulous

Sorry to hear you had such hoffific problems as well but at least you got fantastic help and treatment and i do admire your fightting spirit,Well done and in spite of your health problems you managed to give MBNA and all those other pondfeeder DCAS a run for their money!Heres to many more years of giving these DCAS grief!:D

Seconding, wholeheartedly. You wouldn't believe the kick I get when we get a nice letter from a patient "saying 'thanks, you really helped me'". It genuinely makes my day. We do try, honest!!! :D
