      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I've just written my letter asking for my last six years statements. It's good to read the experiences of others and it fills me with a bit more confidence to ask for MY money back!!

I did try to ask lloyds to consolidate my overdraft with my personal loan, which would have enaabled me to keep my account in the black, but I was flatly refused. So much for customer care and they have the nerve to charge me £15 per month for the 'privilege' of putting my money in their bank??!!:mad: :mad: :mad:

Anyway that's my rant over with, hopefully after time I will receive my money back and I will be able to pay off some of my debts.

Well I've sent my SAR today. Absolutely sick and tired of the downward spiral of debt these charges are causing, almost a quarter of my salary goes on charges each month which makes me overdrawn and incurr more charges...............methinks the whole world has gone mad!!!:eek:

 

If this continues for much longer I will be forced to move out of my home and will have to find somewhere cheaper to live......perhaps take up residence in my local lloyds branch!!!!!!!!!

Yikes, just had a thought, I also have a bank loan woth lloyds TSB if I persue charges and Iget them back will they be arsey and ask for all their loan money back in one go??

Many thanks for putting my exhausted mind at ease. I was telling a friend about the site last night and we were talking about the letters they send (and charge you £30 for) to tell you that your overdrawn and it got me thinking.......maybe I should send them the following;

 

Dear Lloyds

 

No sh*t Sherlock, thanks for stating the obvious and charging me £30 for the privilege. I apologise for the inconvenience to your bank and the unnecessary distress this has caused you, there's nothing I like more than being overdrawn.

P.S I have no option but to charge you £30 for this letter!!

I've just had an awful thought......

 

I know I have incurred charges this month and normally I would have had a nice little letter from LTSB to tell me when the were going to take them out and make me overdrawn....again. However, it has just dawned on me that no letter has come, what are they up to?????????

 

Maybe it's a new policy, don't send letters, just take the charges out regardless!!:eek: :eek:

Well I got all my copy statements today, just finished inputting them onto the spreadsheet (thanks for this template) and discovered I've paid £3757.50 over 6 years!!

Will do Closey. I've been trawling through the forums and can't find what I'm looking for, can anyone help with the following......

 

My LTSB current account has an agreed overdraft of £2750 (maxxed out!!) and today they took another £350 in charges making me go over my agreed limit. This happens every month, but with rent, council tax and bills theres never enough money in to cover these charges and this is becoming a rather viscious cycle.

 

If I closed or ceased using my account does anyone know what the consequences of this would be?? I know they would expect the OD to be paid back but at what rate/timescale??

A similar thing happened to me. I changed bank accounts for all my bills etc, and because Lloyds saw I wasn't using the account much, they demanded I repay the overdraft immediately. I was in no possition to do so, so they then offered me a loan to pay it back. I felt pretty much forced to take it out, so did.

 

Because the amount of your claim is more than your overdraft, perhaps it would be wise to keep going with this account. When you receive settlement in full, you can pay off the overdraft in full and still have a bit of money left over.

Have completed my moneyclaim online claim, but guess what ......can't afford to file it at the minute (£120) due to paying back bank charges!

 

£4464.82 inc interest, hoping to file the claim in the next week or so.
