      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

can anyone advise on rlp claiming costs and threatening to take me to civil court if i don't pay £250 . they say i need to have a legal basis for them to correspond further. I can't get any advise, spoke to cab, oft, ts. all very interested in my unfair treatment by tk maxx but are unable to give legal advise. i can't afford a solicitor and it wouldn't be worth it as their costs would be more than £250 they told me. i don't want to pay rlp as this is admitting i have done something wrong but i'm scarred if i go to court they are powerful to prove otherwise. they are bullies and have said i have no likelihood of sucsess. i was accused of fraud and had police involvement but with NFA now established. i feel i should be the one accusing tk maxx for costs etc for what i have been through, but have never been in this situation before and have no idea how these awful people work.

Perhaps a little more detail is needed here? You say you were treated unfairly, perhaps you can explain how? Just because the police have decided to not take any further action, doesn't make you innocent.

 

Presumed innocent until proven guilty

 

RLP pursuing someone does not mean that they are guilty or that they should pay them anything.

 

RLP will take paying as entitlement to store their details on their database ...

 

There are lots of threads here that say RLP will not take you to court because they don't want their methods examined (and potentially stopped).

 

If you post more information you will get advice rather than judgement (possibly as well as judgement - it depends on who posts or if anyone from RLP registers)

Edited for ethical reasons.

I frequently speak to "innocent" people. They tell how me I'm wrong, how I've made a mistake and how this will probably cost me my job... Sometimes they cry, or they shout and protest their good character from an imagined moral high ground. Once they've done this I calmly relay the facts to a nice police chappy, provide him with a statement and some CCTV and walk him to his car.

Occasionally I have to put on my favourite suit and jump on the train to a court. The judge or judges always thank me for coming. They're quite nice folks generally. They also apologise that I've had to come all this way, just so the "innocent" person can see me walk through the door.

Forgive me for being cynical, but i've had my fair share of guilty people walk away on a technicality, I'll believe there's a real victim here when I've got a few more facts.

Are you therefore claiming you have never made an error of judgement or ever got it wrong??

 

Whatever your secret is, you should bottle it and sell it coz you'd make a fortune!!;)

Getting it wrong when it comes to this kind of thing equates to A p45 and the end of your career. I make damn sure I get it right every single time. I save all my mistakes for my love life...

Most companies work on the principal that if you fail to follow correct procedure (which is generally pretty bullet proof) then you face the consequences. Do not past go etc.

Lipi, just how many more facts would you like to be presented with before you will believe there are real victims on this site???

 

Walk a day in my shoes and you mightn't be so quick to make your haphazardous assumptions!!

 

I generally try and see it from everyones point of view but I find your comments insulting.........and that says alot coming from someone who took pity on bleating Adrian Mole from RLP.............

lpi004 i would like to point out that the RLP site has only changed to say they will take medical conditions into fact after intervention from this site

I took my details off this forum as my dispute with RLP is ongoing - I will post all the facts on this site eventually.

 

Are you not prepared to go into too much detail because of your employment? From your knowledge and experience, is there anything constructive you could add to help people on this site?

I'm really sorry, but speaking as an ex Police Officer I can honestly say the majority of 'private' security personnel I met did not know the law and were not shall we say, 'intelligent' of human beings.

 

I beleive this is an area we need a lot more regulation in.

 

How much training does a private secuiry person get? Maybe two or three days? Compared to the best part of a year a Police Constable is put though.

 

I'm sorry, but this is just my personnel opinion and I feel very strongly about it. People deserve to be treated fairly, not patronised by a 'rent-a-cop' who has not been trainned correctly (and this comment is not made in reference to any posters on this thread)
