Having upset peeps with my first post I'll try to behave. Soz.

 

Not sure which forum to pop this in as it relates to both PPI and how it affects an agreement. So I'll put it here and hope for the best.

 

My question is, if a lender agrees to refund my PPI and so is agreeing that it was mis sold. Does that not make the whole agreement unenforcable because the toatal amount for credit was mis stated as a result of the ppi being added?

I don' think so as if you relaim your PPI you get the PPI and the interest that was added,

Thanks Ida. There are a lot of threads to get through but one in particular (can't remember which one now) mentioned the Wilson case where the woman won her case becase the toatal amount of credit was wrong by £250 so making the agreement unenforcable. Since PPI being added made the amount wrong on my agreement I thought Wilson might apply in my case.

 

I don't really want to stop paying but want to have more ammuntion if they get awkward and don't want to pay me all my ppi back. They already want to take the amount off my payments instead of giving me back what I have already paid.
