    • I bought a rare collectible item from a friend in USA. I paid him via Paypal and had him send it to my forwarding address in USA. This is a business called Stackry which is essentially storage lockers that consolidate packages for you and you choose how and where to ship them, thus cutting on international shipping costs. I have done this many times before and never had an issue. On this occasion, I chose the option of Global Mail Direct. The package was picked up and handed to DHL e-commerce and I was able to track it all the way to the UK. From then on, it was handed over to Evri and a new tracking number was generated. Long story short, they lost it. The driver marked it "out for delivery" then 2 hours later "returning to sender". I was at home and no attempt for delivery was made. What followed was several weeks of back and forth with Evri through chatbots, emails and phone calls trying to locate the package and have it delivered to me. They said I should contact the sender. I explained that in this scenario I am the sender and the recipient. I did not get anywhere. I emailed the CEO and joined a Facebook group. I kept screenshots of everything. At no point did they make a genuine attempt to intercept the package or locate it or at least assure me that it's on its way back to its origin in the US. For several weeks now, the tracking is simply stuck at "on its way back to sender". They owe me £200 and I intend to get it. I do not care how long it takes or how much it costs me. I am prepared to fight this to the end. I wrote them a letter before action and sent it by tracked post to their HQ giving them 14 days to make things right before I take the matter to court. It has been a week now and I have had no response.  I have no experience with legal matters and I am hoping someone can guide me into what I should do next. Thank you.
    • Thanks Dx, Tbh, I’d forgotten that this account was the subject of a charges claim - nearly 10 years ago now! I don’t know for sure that a default notice was issued by Barclays when the account was in arrears but I would guess there may have been one somewhere in 2010. A suspended repossession order was awarded around May 2010 so I’d assume that a default notice would have been a pre-requisite. Based on the info in the thread those arrears were cleared around 2014-2015 but I don’t have any more info to hand atm since it’s such a long time ago. I believe the files I prepped for court in 2015 have since been shredded. How would the presence or absence of an old default notice help with this current issue? Thanks for the merge/support. J

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I recently wrote to Robbers Way asking if i could pay by Standing Order (i usually pay using the payment slips they send to me but they never arrive on time and Robbers blame me for it).

 

I received the letter below today and i noticed that they are asking for the Standing Order to be paid to London Scottish Finance.

Now correct me if i am wrong but i thought the London Scottish Bank had gone into Administration this year. I know Robbers Way are a London Scottish Company but how can i make payments to a bank which no longer exists.

Mr Ton. I am quite happy to pay them. It is from an old bank account that was passed to them in 2003 it was then sold on to Robbers in 2005 or 2006 and i have been paying them ever since.

 

I did send an SAR to the original bank, i got a lot of stuff back including statements showing all the activity on the account from January 2001 until February 2003. It is all made up of charges but since i didn't make a claim for the charges to be refunded in 2006/2007 (when i probably should have done but did not think about it) i don't think i can put a claim in now because the charges were applied more than 6 years ago (shame as i could use the money now).

 

I did put a thread in the Bank Action Group but i was told that i can only claim back if it was less than 6 years ago.

Thats shocking. I should be paying Robbers not the Liquidators!!

IMHO, you need clarification about exactly where is your money going to!

 

Technically speaking, I believe the payments should be going to Earnst & Young LLP; the administrators of London Scottish.

Also, you can claim back charges from when you bacame 'aware' that you could claim them

 

They may try to use the 6 yr limitation, but they are wrong.

 

I would not be paying ANYONE for an account that is just charges.

I am trying to claim back the charges from Santander (formerly Abbey National) under Financial Hardship but they refused to pay up and i have had to go to the Financial Ombudsman Service to try and get the money back.

 

Do you want me to email the Insolvancy service to ask why i am paying a Standing order to a bank that no longer exists?

Personally, I would pay NADA. However, if one chooses to make token payments, best to ascertain who said monies should be paid to...common sense, methinks.

Sorry i never did get around to writing a letter to Robbers (i will do it this week now i have sorted my paperwork out) or the Insolvency Service (i will do it this week) but i will let you all know when i get replies.

 

Ive been so busy with other things this slipped my mind. I will get cracking this week as i have other DCA's to deal with so i wont forget this time!!

Oh, yes, I was driven up the wall by these people! So know all their 'little' foibles where payments are concerned. Paid by SO, they kept claiming non-receipt of payments, despite all information copied and provided by them provided to my bank, all payments went out and were never missed. Not so according to them.

 

Ultimately, as I knew they were, they were trying to make me send them copies of my bank statements in the end so they could 'trace the payments'. Get lost! Apparently, they needed to know my account number in order to do so. Same as with sending payment slips late on purpose, so then it makes you look in the 'wrong'. Which is what they were doing with me over the SO. Was only a few pounds but the 'Rob' part is utterly suitable after my dealings with them.

Ok. Here is the letter i have drafted to send to Robbers tomorrow. If anyone has anything i should add please feel free to make a comment. I have to print this out today as i wont be here tomorrow.

 

After recently checking through all my paperwork I have found out that my Standing Order (which I set up last year in order to pay my debt to you) is made payable to London Scottish Bank. I would like to know where my payments are going to.

 

I would like to know why my Standing Order payment is being made to London Scottish bank which no longer exists. I know you were a subsidiary of London Scottish bank until it went into Administration in 2008 but I am rather confused as to why you asked me to make payments to a company that no longer exists.

 

I must inform you that if I do not receive a satisfactory explanation to my query I will be suspending all payments until further notice.

 

You have 10 working days to reply to my letter.

The only reason they are still going is because the collections section did a deal with Earnst & Young whereby they have to repay 70 million over 6 years

 

how do they get money when they are barred from buying any new debts?

 

They take money from you even though they provide no evidence they were legaly allowed to

 

I'd write to them giving them 14 days to prove they own this dept and then stop paying

 

but that's just me , I'm not a fan of Robbingscum way

Interestingly, the directors also own this company: Aspire Money

 

Which flogs extremely high rate loans 50 - 70% APR and here's the clincher:

 

 

 

 

They have no consumer credit license!
