    • I did call the police both in the UK and in my country but both of them said no way to get the money back now. I tried my best not panic but it indeed influenced my life in many ways, the only thing I could do is start therapies. It happened around February- March, so I started to do this shoplifting thing to cover my rent and everything from the end of March, it’s been a month now… today it my first time to get caught. I know it’s very very bad, I seriously didn’t want to do this at all. But luckily I just saw an message from HR, they asked me to have an online interview next week. I’ll stop this behaviour and wish my messed up life back to normal soon 
    • did you contact your bank about the fraud? contact the police , action fraud anyone in authority? have you done anything about it? when did it happen? dx

    • Thank you, I was been told that it’s a serious crime if I shoplifted above £200, (this time £500, I gave the thing back+ last time probably also around £500 which I didn’t give back).. and I admitted to them that I sold those things at very low price to pay for food and stuff.   That’s why I was worried..as it wasn’t my first time.. I also did it in John Lewis in the city I live, but when they asked me I said I didn’t steal things from it as I don’t wanna get caught in my city. But I don’t know when they upload my pics in the system will they recognise me and think of me a professional shoplifter than against me… so what happened about the fraud was that what there was a phone call told me that my visa has problems etc due to I helped bad people do money laundering etc. I said I didn’t then they tried to ‘control’ me and many things happened to make me believe what they said… as soon as I gave them the bank details I lost all the money in it.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

I took a secured loan out in late 07 with Welcome when I was in a very bad place (fiancee had just left me in half done up house that I therefore couldn't sell).

 

House now completed (took along time, alot of friends help and much fudging on my part).

 

Now want to move and want to settle Welcome loan with equity. OMG no chance looking at the advice on here :eek:. Feel ill with worry. Realise I was stupid to take this out but as I say i was in a bad place and really not thinking straight.

 

I am thick when it comes to maths, could anyone please advise if this sounds correct i.e. does it all add up?

Cash Advance: £16000.00

Acceptance Fee: £235.00

Broker Fee: £800.00

Interest Charge: £42899.89 (gulp)

APR: 24.60% (double gulp)

Monthly payment: £327.22

Duration of loan: 180 months

 

Have tried the rule of 78 calculator (and subsequently avoided the knife drawer)...but cannot find a calc for 2007 loans.

 

Anyone know roughly what they are likely to ask for in settlement?

 

As going to send them a cca followed by a sar as i seem to strongly recall that I explained that I was planning to move and was advised that there was no early payment penalty...yeah right...presumably this coversation should appear in the sar?

 

I can't eat, I can't sleep and I feel very ill with worry, I stupidly thought the settlement figure would be the closing balance on the statement. If they make me pay more I cannot move and would owe the estate agents and solicitors alot of money I do not have.

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I would say that the calculation for early settlement for 2007 loans is slightly better for the consumer than the Rule of 78.

 

Can you say exactly how many payments you have made and what were the payments?

 

Also, is there any arrears?

 

The interest charge figures quoted above is for the £16000. I presume the broker fee and acceptance fee were added to the loan, if so then they charge interest on them also!!

Have made 21 payments of £327.22, no arrears.

 

They have the interest charge as separate figures from the acceptance and broker fees then the total charge for credit as £42,899.89 (sorry made a mistake in my initial post).

 

The quarter term repayment is £15,622.92 but I'm 2 years off paying a quarter term. The statement they sent last Sept was approx. £16,800 which is what I had stupidly budgeted on.

 

One good thing - my appetite has completely gone so I may lose a few pounds in weight too!

Rule of 78 is approximately £20k, I would guess that the settlement is less than this for 2007 loans.

 

Why don't you write to them and ask them for a settlement figure and more importantly also ask for the calculation how they arrive at the settlement figure?

 

You can then double check this amount with either the FSA or OFT I'm not sure which!

I had a loan from 2004 from Welcome.

It was a £20k loan with 6k tacked on in ppi and mortgage indemnity.

 

I had no choice but to sell because of my daft mortgage.

On the day before the exchange they told me they wanted £31,500 (or more can't quite remember was may 2008.)

 

They agreed the move on the balance of what was left in the house for tehm to take £28k and want to make a new loan on the difference

The paperwork i have since from them states a £22k interest reversal and they want £8192 settlement, though the local branch have come down to £2950. Still debating what to do.

 

The paperwork from head office states

 

The amont of rebate has been calculated having regard to the consumer credit (early settlements) regulations 2004, so it might be worth finding out what that is.

And regulation 3 of the consumer credit (settlement information )regulations 1983.

 

Do know whether this helps, but they may well take the view that it is better to get the bulk of their money back now, and turn the rest into unsecured loan in the current climate...

 

on the other hand, this is welcome finance we are talking about....
