Hello all

 

Sent a CCA to Scotcall on Thur 9th July for my OH's Barclaycard agreement (Mercer's had been dealing with it previously).

 

Just received a reply from Scotcall dated 10th saying "this account is closed, please contact Barclaycard..."

 

They returned the £1 postal order too.

 

I did include in the CCA request the paragraph intended for DCA's which cites:

 

" If it is your view that you are not the creditor, s.175 of the CCA 1974 applies in the case of a simple assignment, and places a duty upon you to pass this request to the creditor. "

 

Where do I go from here - do I get back to them & point out that they breached s.175 by not passing the request on to the creditor or do I simply re-issue the letter as a duplicate with the clock still running to Barclaycard or do I simply start over with a new CCA to Barclaycard?

 

Any advice would be much appreciated.

Just send a new CCA request to BC. :cool:

 

Don't rely on Scotcalll to do this for you - it'd probably just go in the bin. :mad:

Thanks for the advice.

 

Will get onto it - at the risk of sounding cheap :smile: is the returned PO a write-off or can it be re-issued to the others?

Take the P Order back to the P Office that issued it - they will say if you can get credit for it.
