Just curious as to when egg started using the Citigroup Centre, Canada Square address on their CCAs?

I ask because I have assumed it was sometime after their takeover by Citigroup in 2007. If so, my agreement has been, how shall I say, re-constructed using the latest version.

I would love to see a definite answer to this question. Or at least some suggestion how to find out.

If it turns out that they did not use it in Oct 2005 than this effectively would mean that credit agreements they have on website are fake. In my account on egg website they have credit agreement which is dated Oct 2005 and it starts with:

"This is a credit card agreement between Egg Banking plc of Citigroup Centre, Canada Square, London E14 5LB and you."

Yorkshire Bank ~1200£ of charges reclaimed many moons ago, settled out of court

HSBC ~350£ of charges reclaimed many moons ago, settled out of court

HSBC ~4000£ flexiloan CCA request sent May 2009, 'sorry, we do not have your CCA' letter received June 2009, AccountInDispute letter sent.

HSBC ~9000£ CC CCA request sent May 2009, no response, AccountInDispute letter sent.

HSBC - preliminary letter for about 300£ of unfair charges plus interest sent May 2009, LBA sent June 2009, N1 POC and Schedule of charges submitted July 2009

Egg - CCA, SAR, "no more calls" letter, DMP offer sent July 2009. Got a DN from Egg - wont say a word on this one until court papers are received.

according to archive.org, at least until Feb 26, 2007 Egg was not at Citigroup Centre, Canada Square. This actually coincides with timing of Egg acquisition by Citygroup and looks quite plausible.

Therefore, IMHO, Egg represents on their website that some customers signed their agreement which is a falsification because until Feb 26, 2007 this agreement could not have Canada Square address. Given that they have falsified first sentence of this supposedly electronically signed agreement, on balance of probabilities rest of this supposedly electronically signed agreements is falsified as well.

But I am a layman, we need legal eagles to have a look into this.

Great research Readalot!! Now I have done a screen dump for my files, it should be easy to prove this in court!!

Thanks, now if needed we could use each other as witnesses if required. Moreover, I could introduce some high profile expert witnesses if needed. Qustion is: will it help? It seems nowadays banks can get away with a murder, and perhaps nobody will be too much excited about a trivial fraud. ;)

On the other hand, imagine, some high court judge (hypoteticaly speaking) rules that since it is proven that Egg falsified electronic signature, all their electronic CCA are unenforceable... I should stop daydreaming now.

Citi group did not buy egg until Feb 2007, so the document is a forgery.

When you do a CCA, they are supposed to send a true copy ot the original, which obviously is not what you have there.

I have a slightly different situation in that I have a non compliant CCA for a different reason.

My Lawyer advised this, but you may want to proceed differently given that you have a forgery. he told me not to write or say anything. That way, if they do eventually go to court, which is there only possible grounds to claim back money, you can simply say that the agreement is unenforcable.

The problem is that most people feel they have to write back and that conveys the image that you want to keep talking or that they say jump and you jump.

After i sent the non compliance letter, they have gone very quiet indeed, so I am not wasting time writing to an organisation that tries to chase money on an unenforcebale debt. In asking for money, they are acting unlawfully, so let them get on with it. Give them enough rope and they will hang themselves!

And remember you saw it first here......unenforecable CCAs are the next big miselling/bankcharges/penions/PPi/etc scandal.

I'll be scanning the agreement tonight at work and then I'll send it to my solicitor , we might be lucky and get some opinion back from them sometime next week as she said she'd have to discuss it with one of the partners after she receives it from me. I'll let you know.

I will be interested to hear the outcome - I have had the same - an agreement from 2005 with Citigroup as the address ... I will watch with interest. We were just about to start making a deal with their DCA, but may just hold fire a little now ...
