      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

What the hell is B/Card playing at??????

 

Just received an envelope this morning with the original letter I wrote to them on 7th March, demanding the rest of the SAR, with a covering compliments slip asking for a copy of the letter they sent us on 3rd March - this is just going round in circles - don't they keep any copies of their correspondence??!!:mad::confused::(

 

I getting bl**dy fed up with this, all I want is the rest of the data (if they've got anything) and all they do is to and fro with pathetic bits of paper!!

 

Right, I'll copy all the correspondence I've sent them in the last few weeks, (that'll confuse them LOL) and see where we go from here!!

mmmmmmm i dont think i would be too keen on giving them copies of their own correspondence to you

 

they may have cocked up and are trying to find out how they cocked up

 

the only thing you need send them is a copy of your orginal SAR and tick off the items that they have sent and mark the ones you are still waiting for

Every letter I have sent them, they've returned in it's original state, even down to my SAR - what are they up to??

 

If they can't comply, then why don't they just write and say so!!

they are not allowed to return the request to you

 

if there is a problem or queery that have to lodge the request then put it on hold and either telephone or write to you to resolve the problem, whereupon the clcok re starts when the problem is resolved

Didn't think it would be long.......!!

 

Another letter from Cabot, again with a copy of the Goldfish application form, however, this time they've sent complete T&Cs from 03/08, and prescribed terms which they claim to have been on the back of the application form - I think not!

 

No where, (that I can read) is the word "overleaf" mentioned on the form, the terms have 4 paragraphs missing - 1,2,7 and 8, so this has to be a copy and paste job.

 

How many more lies, and decept, along with fraud is this company going to be allowed to get away with.

And my credit "agreement" is very similar to yours.....

Received a letter from Barclays last Friday, incidentally, addressed correctly, correct account number, wrong name!!

 

They say they have no correspondence in relation to this account, but any other information will came from the relevant departments, so far we've had nothing!

 

Cabot/Fire have gone very quiet since I wrote asking them to confirm the T&Cs they alleged were on the back of the application form, were actually there, they didn't, cause they couldn't!!

 

So no developments as regards to the DN or TN.

An update:

 

Absolutely nothing from Barclaycard, so presumably they must have destroyed all the data, when they took over the Goldfish account. Would it be a good idea to report them to the ICO?

 

Next, received a letter from "Clarity" (never heard of them!) saying they have been instructed by Cabot (clients) and offering a 25% discount!

"Until further notice all repayment proposals must be agreed with us. The options available to you are: etc Oh, and they're threatening doorsteppers if they do not hear from us.

 

I will be sending them the "bemused" letter!!

 

And another thing, Cabot have issued me with a SD for an Old Littlewoods/Barclaycard account, I think they are putting their toes in the water, and I wouldn't be suprised if this doesn't lead the same way!!

Sent the bemused letter to Clarity, they returned the account to their clients - CABOT!!

 

Haven't heard anything since!!:D
