Have sent off a Subj Access req to MBNA this morning to there Customer Advocates assistance dept making the postal order out to them requesting everything (even older than 6 years). This is because on both my accts with them all they have sent me is details of an application form from 2000 and current t & C which inc the £12 charge.

 

My question is this..........

 

 

  • Should I be sending a copy of a letter to Debt Clear Recoveries where communications are being dealt with so they are aware of this?

 

  • Also I have added in another acct no which is with Restons and under court action at present Court papers help required pls Should I copy Restons a copy of this Subj access request letter too?

No need to send any copies of your Subject Access Request to Debt Clear Recoveries or to Restons.

 

You have asked MBNA for any documentation bearing your name. It is not something for anyone else to be aware of.

I understand there are 2 different Subject Access Request letters that can be used. I have used the DATA PROTECTION ACT 1998 SUBJECT ACCESS REQUEST

Is there any reasons one should not use this request?

 

or is the other one the most common to use? Confused? :confused:

I have had the postal order & letter returned back to me due to MBNA asking for my official proof of identity and signature 1st regarding this like a passport/driving licence...

 

anybody else had this stalling procedure done on them too???

I have sent it back with a copy of my driving lic today - not sure if that was right or wrong??:confused:

 

For those applying for subj access info - you may want to consider copying this sort of info in your initial request stage at the start...it then does not give them an excuse to bat it back to you :wink:

I got past their request for identification but writing back with a list of all the personal information they held, ie date / place of birth, bank account details and so on. It did the trick as I got they complied with the SAR a few weeks later.

I submitted what they asked in the end only because I did not want any further stalling obstructive tactics they so like to continue with ;-)

Foir further reference for members reading this thread, this is the OFT's position on a signature being required for a Subject Access Request para 2 -

Suffice to say that if the Information Commissioners Office are satisfied that if you have previously corresponded from the address then it is reasonable that you are the person you say you are, therefore there is no leglislation nor guidelines that they can hide behind in an attempt to avoid fullfilling a legal request,

40 days will be up next week from 18th June for my SAR (although my first letter requesting this was initially 6th June!) I did a Co-op card SAR 12June (had those docs this week) I wonder if MBNA will perform on time (me thinks not somehow!:rolleyes:)
