    • Thank-you dx, What you have written is certainly helpful to my understanding. The only thing I would say, what I found to be most worrying and led me to start this discussion is, I believe the judge did not merely admonish the defendant in the case in question, but used that point to dismiss the case in the claimants favour. To me, and I don't have your experience or knowledge, that is somewhat troubling. Again, the caveat being that we don't know exactly what went on but I think we can infer the reason for the judgement. Thank-you for your feedback. EDIT: I guess that the case I refer to is only one case and it may never happen again and the strategy not to appeal is still the best strategy even in this event, but I really did find the outcome of that case, not only extremely annoying but also worrying. Let's hope other judges are not quite so narrow minded and don't get fixated on one particular issue as FTMDave alluded to.

    • the claimant in their WS can refer to whatever previous CC judgements they like, as we do in our WS's, but CC judgements do not set a legal precedence. however, they do often refer to judgements like Bevis, those cases do created a precedence as they were court of appeal rulings. as for if the defendant, prior to the raising of a claim, dobbed themselves in as the driver in writing during any appeal to the PPC, i don't think we've seen one case whereby the claimant referred to such in their WS.. ?? but they certainly typically include said appeal letters in their exhibits. i certainly dont think it's a good idea to 'remind' them of such at the defence stage, even if the defendant did admit such in a written appeal. i would further go as far to say, that could be even more damaging to the whole case than a judge admonishing a defendant for not appealing to the PPC in the 1st place. it sort of blows the defendant out the water before the judge reads anything else. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All,

 

Have today sent 'Account in dispute' to MBNA for my Virgin CC.

 

Requested CCA on 29th April to which no response has been received, although this comes as now surprise from reading relevant threads.

 

Won't hold my breath for a reply. Am still paying minimum payments but soon to become a struggle due to reduced working hours.

 

Really want to offer F & F but if no CCA then maybe I will be in a better position to negotiate.

Hi All,

 

Have sent 'Account in dispute' letter as they have not replied to my CCA request on 29th April.

I realise this is not going to be easy and ultimately I want to get to a F & F offer asap.

 

The CC is up to date at the moment and would never have been a problem if they had stayed as things were with HFC.

 

 

Salary was paid to this card on a monthly basis and covered all DD's and S/O's

 

 

but when it went to MBNA they stopped the facility that had been used for getting on 15 years, if not longer.

 

So annoying!

Hi Anyone?

 

Well up to now, heard nothing from them, not even an acknowledgement!

 

So, reluctantly cancelled the DD today, so expect they will be in touch soon. Working reduced hours from this month so decrease in pay, want to offer F & F but if they can't be bothered to respond, why should I do anything?

 

Didn't want to do too much damage on CRA's but wondering now if it really doesn't matter, wanted to look at re-mortgaging but lenders aren't lending anything, it seems!

 

Can someone please tell me how to move this thread to the MBNA forum.

Not heard a sausage from these, had a look online last night and they have changed due date of payment from 19th ish to 7th (earlier not later!) so now in arrears anyway and of course, £12 charges slapped on. So I removed all contact phone numbers!

 

Account now in dispute so not sure what to do next really.

 

This is a really old CC which was originally through Beneficial, could offer F & F but it seems that you may get a better result if the account has defaulted and DCA's involved.

 

Any thoughts/advise greatly appreciated and how to move this thread to MBNA forum.

Message left on home phone to call RMA 01772 833380.

 

Think I have seen RMA on some threads but not sure which, I have just missed last payment for MBNA so assume it is on their behalf.

 

I have no intention of calling back though, still waiting for reply to CCA from 28th April and sent Account in dispute letter.

Had another message left on landline from RMA to call them, which I didn't do.

 

Letter received in the post this morning from them so that confirmed they are chasing payment on this card.

 

Should I write back to them advising that this account is in dispute or just do as MBNA do and ignore them completely? (for at least 2 month anyway!)

 

Any experts out there? Help gratefully appreciated

As MBNA are in default of your CCR, they are in the wrong to pass your account to RMA so the more RMA try to contact you the more of a counterclaim you will have for harassment if this ever went to court.

Thanks for your advice, they have called home today and my works number, really not impressed fortunately I took the call but it could have been quite embarrassing for me! As they asked for me by my first name which I don't use, I just said no one of that name here!

 

I went online and removed my numbers, so they have got them from somewhere.

Hi rev.ian, if you are around. Or anyone else.

 

Just a little advice needed please.

 

I came across this letter which I believe may be more appropriate, in the first instance rather than the telephone harrassment letter (they have only called 3 times) so far. Yes I expect it will get worse!

 

Not sure what dates to put in, I CCA'd them on 28th April and sent Account in dispute on 29th May. Do I quote the dispute date as 28th April plus 12 working days and/or 29th May plus 30 days?

The dispute date is 12+2 days. I bet MBNA didn’t even tell you that RMA would be dealing with this account, as that a breech of OFT guidelines as well.

Hi Anyone,

 

Now getting a few calls from them, they start work early dont they! I did take one call and found it very difficult to understand what they were saying but I just refused to give any details to them and they gave up.

 

Had a letter from Global Vantedge now but it says don't respond to address in New Delhi!

 

Have drafted a letter from the library on here, do I just send it to MBNA as this is the only address on the letter for me to send a 'cheque' to.

 

Of course there is a freephone number on it which I can call!

 

The letter is unsigned but is for and on behalf of Aegis Ltd

Dotty, I got a call from RMA today. I also have had no reply to my CCA and they just sent me my SAR so I know they have no enforceable agreement (it was an application form without any credit limit amount).

 

Thanks for posting up your letter, and Rev.ian, I will work out what to send MBNA now!

Well my letter got to someone as I have received a reply as follows:-

 

'Thanks for getting in touch about the customer service recently received. It is something we take very seriously and we're sorry to hear it wasn't up to scratch on this occasion.

 

We're currently looking into the matter and promise to get back to you with a full response in writing by August 10th 2009'.

 

I find this a bit of a strange response but at least I got something and wait in anticipation for 10th August to arrive!

Hi Anyone,

 

Have been away for a couple of weeks, still no reply to CCA request but constant calls from them (glad I don't have their phone bill to pay)!

 

Well I called them, (yes I know I shouldn't) the lady that answered said "Are you calling to make a payment?" "No" said I.

 

I was then transferred to a different dept and the person I spoke to advised that nothing showing on their system for the letters that I have sent (surprise, surprise) he gave me another address, just a different PO box number. He didn't question anything, I just said I would only deal in writing, so have sent copies of all my letters (3) today and given them 30 days to reply.

 

He said it can take up to 14 days to get letters scanned on to their system! Expect they have quite a lot!!!!
