      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Beachy's OH just received letter from Egg stating that they have been unsuccessful in trying to telephone OH to discuss account (in agreed payment plan with them & it's up to date), if OH won't speak to them ON THE PHONE they will seriously consider taking legal action.

 

Didn't think WE HAD TO speak to these people, True Call installed but their number hasn't been Zapped (yet) & they don't leave any message, they were told last year that we will not discuss financial matters over the phone and everything to be done in writing.

 

Is there a LEGAL right for them to DEMAND OH rings them?

Think the cause of it is coz I've SAR OH account, PPI & horrendous charges on the accounts, and it's upset them!

 

Doesn't give them the right to make such a threatening letter though.

Just file it with the rest (not the dustbin lol). Have you disputed the existence of a valid cca or are you just going for charges. Until you dispute one way or another Egg do tend to be rather tenacious with the phone.

 

Perhaps you should expand on your situation and them keep the thread up to date, that way you will get ongoing advice.

Ta muchly,

 

Just started out on this one, have sent SAR for complete banking history inc. CCA's for card & loan.

 

So early days yet I suppose.

 

Initial goal was ppi & charges but now looking at the full 'monty' (enforceability etc).

Sent off cca request to Egg three weeks ago, received a letter today informing me that they are unable to respond to my request as I did not enclose the £1 fee, once I forward the fee they will process my request.

 

Is there a way of checking whether postal orders have been cashed, cca request was sent RD (which I have proof of delivery), the £1 postal order was stapled to my letter and was made payable to Egg.

OH sent cca request to egg received their response today (two weeks outside the 12 + 2 days).

 

Firstly it was addressed to Mrs Beachy but letter started Dear Mr Beachy, next is the account number on the letter does not relate to any paperwork we have from Egg.

 

Then they say that OH didnt enclose the £1 fee and to forward it on by return, a £1 postal order payable to Egg was stapled to the cca request and was sent recorded delivery.

 

If the above wasnt enough there were about 10 pages of terms and conditions headed Credit Agreement, no dates or account number or signutures or place to sign, in addition on about page 5 it states about Approved limit as opposed to credit limit which PT refers to in his thread.

 

In a seperate letter also received today was a stroppy letter saying that they have not been 'successful' in getting a telephone response from OH and unless OH contacts them by phone legal action may be taken.

 

If this wasnt enough OH had a third letter containing statement of payments made over the past six months, OH is in an agreed p/plan and they agreed to freeze interest and charges however looking at the statements they have continued to charge interest each month.

 

Phew that it - any views?

seems like the lovely staff over at EGG PLC have been busy - agreements flying out all over the place! :D

 

Mr Meerkat received his agreement yesterday and it appears to be very similar to Mrs Beachy's, only 'Approved Limit' mentioned.

 

Also Mr Meerkat's mummy got an Egg agreement with her signature exactly like that, however the date she apparently signed it on was last year and not in 2005 when she applied for the card.

 

Hope things are ok over in Casa de Beachy ;)

Yeap everything fine over here, hope all is well with you & yours - starting to wonder where everyone was :D

 

Looking around the Egg forum Egg seem to be hopelessly disorganised regarding paperwork.

 

A Cagger gave me an address to write to to check if the postal orders had been cashed, I cant see how they can deny receiving them when they were stapled to the letters! Popped into our local PO yesterday afternoon (now on first name terms with them) apparently if you take a postal order receipt to the PO they can check there & then as to whether it has been cashed.

 

The SAR (when it arrives) should make fascinating reading!

Morning CAGGERS,

 

Wonder if anyone else has encountered this problem with Egg.

 

For both OH & me, we sent off for copies of our egg agreements & SAR (5 accounts in total) Egg are now well outside the 12+2 days so the accounts are now in dispute. Even outside the 40 day period regarding the SAR's.

 

All requests where sent individually by Recorded Delivery (have proof that they were received, however Egg have replied that we did not enclose the required payments (done by postal order and awaiting post office confirmation that the orders have been cashed).

 

I have an Egg loan which they sent a cca & looks enforceable - but they are demanding payment of £1 by return.

 

OH has been sent T&C's for an Egg card with an account number that isnt hers and again asking for the £1 to be sent by return.

 

Other three accounts & SAR they require the fee to be sent again, surely if they received five recorded delivery letters each containing a postal order, payable to Egg, they cant say they havent received payment.

 

Just wondering if they are also playing delaying tactics.

P58 form available from any Post Office® branch. When you’ve completed the

form hand this in at the Post Office® and this will be forwarded to Royal

Mail to investigate.

 

Alternatively you can send the P58 form and the receipt for the postal

Egg are quickly becoming renowned for their delaying tactics, swamped under comes to mind.

Thanks for the comments.

 

Did ask the local Post Office the other day, gave me the address to write to, told me to write a letter quoting the seriel numbers of the PO's, didnt mention about the P58 which I have picked up this morning.

 

It goes without question that by sending my requests Recorded & got proof of delivery I know they received the PO's.

 

Just so happens that I received my SAR this morning (they again asked for the fee to be sent by return as it has not been received).

 

Just had a quick scanny through the contents, plenty of charges and suprise suprise they added ppi to a loan amounting to £2,472 which I did not consent to, so it looks like GAME ON!

Have received my SAR from EGG - what a complete mess they've made of it, one account completely missing, one former card statements duplicated three times (no wonder the envelope was so heavy), although I asked for everything I only received one loan cca and everything else was just statements relating to two former cards.

 

They did supply the cca (below) but did not supply state of account, payments made etc etc..

 

I've read so much about Egg I wonder if someone could confirm whether or not its enforceable & whether the interest rates and figures are correct.

Its not a Debt Industry problem (yet) so cant post there & I dont believe in posting my problem on someone elses thread,

 

So bump.

 

I make the interest/APR a couple of pence different to them.

 

On a payment plan & they are dividing the monthly payment into two parts, wont tell me why and have not provided a statement of account as part of me cca request & as part of SAR.
