Not sure I really understand you there.

 

I have written to capq stating that the stat demand was dismissed and I was awarded costs. They have said that the stat demand had nothing to do with their claim.

Was thinking of sending another letter outlining the reason I do not acknowledge their claim.

 

Account is in dispute for non compliance off cca request.

 

No deed of assignment seen

 

No default notice received.

 

I am also wondering whether to send off a sar request to them.

 

Thoughts anyone ?

Hi tm

 

2 different regimes..... Bankrupty and civil proceedings

 

If they fail in insolvency proceedings [bankruptcy], they can bring a case to test the triable issues in civil

 

If you believe they've failed to supply a compliant [or any] agreement then a dispute would be a logical step

 

Personally, wouldn't give them any further information, why give them the opportunity to 'correct' their records re: DN and assignment. If they proceed to filing it's for them to prove.

 

SAR.... to Capquest - probably a waste of a tenner, by all means send one off to the OC
