Hi.

 

If the tenancy agreement specifies that the utilities will be reconciled each quarter but despite repeated requests from tenants the landlord fails to furnish said tenants with a copy of the utilities, must they still pay the bills in full when given the total amount over a year later?

I think so, yes.

 

Remedies for breach of contract are usually to put people back into a situation where they would have been if the contract had not been breached. In this case, you have not lost any money by the delay in issuing bills.

 

In a different example where utility companies have failed to issue timely bills, if I recall correctly, they can claim bills for up to two years. I would think that consumer protection against utility companies will be stronger than the normal legal protection.
