I have a mortgage with gmac who took me to court for reposession which was suspended.i agreed to pay an extra £45.42 per month towards my arrears,however they are charging me a £50 p-m fee for arrears & a £15 p-m fee for not paying by d-d,so the extra that I pay towards my arrears doesn't cover any arrears at all. my mortgage is going up daily.does anyone know where i could try for a mortgate to get away from GMAC as thay are taking me through court again.my credit rating is not very good either at the mo,any advise anyone?

There are a lot of brokers around and plenty deal with people with adverse credit. I know London & Country Mortgages - Best Rate Mortgages & Remortgages Deals UK – L&C Mortgage Search - have good reviews on Money Saving Expert and so do https://www.centralcapital.com/ I believe. However, with you about to go to court again I really do not know if they could help you but it might be worth a try?

 

I wouldn't try claiming fees back from GMAC until after you have remortgaged with someone else, to be honest.

I know London & Country Mortgages - Best Rate Mortgages & Remortgages Deals UK – L&C Mortgage Search - have good reviews on Money Saving Expert and so do https://www.centralcapital.com/ I believe. However, with you about to go to court again I really do not know if they could help you but it might be worth a try?

I’m sorry I don’t have any answers for you at this time, bit I thought I’d drop you a line to inform you that your not alone and I’m in the same position with GMAC with them threatening to take me to court AGAIN too.

Due to the nature of my job I can’t guarantee when my wages are paid into my account, so therefore not able to put a specific date for DD’s so they have happily charging me these fees’s every month over well over a year.

If I get any information I drop you a line and will keep an eye on this thread ( two heads better than one etc).

I am Still hopefull i contacted the broker who originally put me with GMAC,firstley he apologised & said he no longer deals with them,he coming to see me today to try & sort out another mortgage for me. I will have to self cert but it will save me over £200 p-m. If it all goes through ok i will then claimback my charges & the penalties cause i know they will be excessive.

I will keep you posted to how it all goes.icon14.gif

Hi may have a new mortgage with a company called Victoria, no fees & no penalties tied for 2 years. i have never heard of them though. My penalties are going to be around £4900 to get out of GMAC. How excessive is that. i would like to know if anyone has been able to claim back penalties from GMAC.does anyone know?

Taken off their web site fyi - they are american company who tend be quite agressive when problems arise with cashflow - not sure what type of mortgage you are considering, but have you thought about interest only with an option to overpay - you can then pay the minimum on the due date and top up when your money clears. Nobody that I know of has received a refund yet but a few are trying - Iwill be claiming off mortgage express as GMAC sold my account on to them.

I am having a nightmare with Gmac as i applied for a remortgage which was agreed in principle, as i have a suspended reposession with Gmac i had to go back to court as they said id missed further payments.the eviction was suspended due to dicrepency over payments.I called Gmac on several occasions re- missing payments, they were very Unwilling to search for the payments as they needed proof from my bank. My bank then phoned them & they didn't believe that is was my bank calling them. My bank then chased these payments & sent a letter to me showing dates that thay were paid , My mortgage account was then credited & the letter was then faxed to Gmac showing these dates. Because of this my new lender is unwilling to send out the mortgage offer. Gmac have not ammended my credit file. Im due in court again on monday & intend to take all my proof to show to the judge. Im at my wits end now as i dont think im going to get my new mortgage now & really dont want to stay with Gmac.:evil: Where do i go from here?

I think you have a good case for bullying here. Take everything to the judge and explain what you had to do to prove GMAC had received the money. However it does leave you without new mortgage. Shop around on the links shown in Dollys reply earlier and good luck

:? I went to court today with all my proof showing that payments had been made.I heard the solicitor acting for Gmac saying to my representative that he had been advised by Gmac to be hard as nails & to get the re-posession wraped up. We all went in to the judges chambers & the judge looked at my bank statements that i took & he turned to the solicitor Why are we here? The soilicitor was a bit purple as the judge ordered a further suspension with a review in 6 months.

However i then came home & checked my credit file online & Gmac have not amended my file, Suprise Suprise.i gave them a call & was given a fob off. I also noticed on my file that last week the outstanding balance was showing at 89 thou +, this week ive noticed this amount has gone upto £90,472 in a week? Originally i borrowed £83,000 less than 2 years ago.my payments have jumped up from £425 to £597 per month. Surley this can not be right.I could really do with some advise on this one.:confused:

Hi Amanda,

 

Have you done a SAR on GMAC? All the late payment fees are unlawful and you can claim them back. There is a template letter in my thread in my signature, just remove the bits relating to ERC. Furthermore if the information on your credit report is incorrect then you can apply to have it corrected. Have a look in the legalities forum for info on dealing with credit reference agencies.

I put in a complaint to FOS yesterday about Gmac as not yet had a callback from them at all.Fos are going to send them a letter asking them to give a brakdown of all the cost's as balance is disputed by myself, they have also asked them to correct my credit file. Ill await the outcome of this, as soon as they have corrected my credit file I will get my mortgage offer & can get away from them & will then start my claim against them.Will keep you all posted on this one.

This happens all the time. There is no point when you are at offer stage of starting all over again with new lenders. You have a suspened possession order hanging over you and not many new lenders will want your business

Phone your new lender/ broker and explain the situation. You can fax certified (by broker bank manager, solicitor etc) copies of proof of payment to the new lender and they will get the offer out for you. This is a fairly common situation, a last credit check before the offer goes out to check payments made. It is easily rectified.

If your doing your mortgage yourself pm me with your new lenders name and I will give you the direct contact details. If you are going through a broker give him/her a kick up the backside and tell them to sort it.

I take it the new lender needs to see the last three paid?

You will be in a more secure position to sort Gmac when your remortgage has completed.

I gave Gmac a call last week about the payment histroy of my account.At first they tried fobbing me off & then they suddenly found the letter from my bank & was still being dealt with, I asked them howlong this would take & they advised me it should be completed by the 11th & asked me to give them a call on weds. I will do this but do you think it may be worth me getting in touch with experian

Your new lender will be aware that payments made are not automatically uploaded onto Experian and will accept the letter/bank statement showing payments as proof of payment.

All lenders report at different times some monthly and some 3 monthly. On a set date during the month they load a cd/ whatever and Experian read it. Realisticly Gmac will hardly have any new info on you showing on the CRA report untill their due upload date.

Have you got a broker?

If so they should be collecting POP from you, certifying it as a true copy and faxing it to your new lender. It is a five minute job.

If no broker get your solicitor or bank personal to certify and fax to new lender.

Get your offer and complete and then go for Gmac afterwards.

Gmac may have behaved unreasonably with the means of reporting your payment history but you will be in a much better place to argue your case after

you have nothing that they can take.

Hi there.

I do have a broker who has already faxed through to them the letter from my bank, but they seem to be taking more notice of the credit report.the new lender is called Victoria, ive never heard of them though.i think that i will email experian & fax a copy of the letter to them.but i will wait & see what happens tomorrow when i call Gmac again.

Called Gmac this morning & i am sooooo mad:mad: they have said to me that as far as theyr'e concerned the payments will stay as Missed payments & they will not amend my credit file even though they have proof from my bank in the form of a letter showing the dates that payments were made. & because i have a bad payment history my credit file has nothing to do with them.i have already contacted FOS & Experian. God i hate Gmac. I feel like they are doing this to see if i miss another payment so that they can take my house.:mad:

Any money that leaves your bank account should be shown on your statements which providing the amounts you paid were enough to cover the payments you owed Gmac can not be disputed.

Did you pay the full amount that they expected?

 

Are your payments DD, cheq, debit card?

Hi Amanda

 

I can understand why this is causing you so much stress.

 

If there are discrepancies on your credit reports, the credit referance agencies have a duty to ensure their records are correct. Write to the relevant credit reference agency (Experian or who ever) and explain that these payments were not allocated to your mortgage account upon reciept by GMAC despite the amounts leaving your bank account on time etc. Explain that you have had no joy in getting this incorrect information amened via GMAC on you credit report so can they look into it for you. Send ll the evidence you have statements, letters etc & they should sort it out for you.

 

As for looking at your credit report - I wanted to remortgage with BoS a few months ago & because Cahoot hadn't amened something to 'cleared' on my credit report (despite telling me they'd done it twice) they mortgage couldn't go through. BoS even had copies of letters from Cahoot saying the debt was settled!!! My FA said that someone was being a jobs worth, but it stopped me getting the mortgage.

 

I hope that you can get this sorted pretty quicky & things work out in the end.

You seem to be in a real catch 22 situation here. You must be really stressed out.

 

If you dont already have these - try and get them.

Copy of your credit file. You need to see exactly what Gmac have and havent reported.

A copy of the Agreement in Priciple from Victoria

Gather together any court documents that you have especially the decision to suspend the possession order and reason why.

Your letter from the bank confirming payments.

Any bank statements that you have now with payments showing on them.

 

Write a letter explaining the circumstances

how and why the arrears started

that you are now in a position to make payments (which you have proof of)

and that you are trying to put the past behind you and are making every effort to rectify your finances but are being hampered by Gmacs actions.

the effect this is having on you (and family if any)

the actions you are taking to solve problems with Gmac(going to court & the judge found for you, speaking to Gmac, speaking to Experian, trying to remortgage and that you are taking advice from CAB etc.)

that you have been left with no other option but to make a formal complaint to the Information Commissioners Office and the FSA.

 

Send the letter with copies of all above docs to

Gmac

Gmacs solicitors

Experian

If you put a notice of correction on your credit file and send Experian proof of payments they will have to investigate as to why Gmac is still reporting missed payments when they can see them.

It will also stand in your favour if you do happen to end up in front of the judge again as he wil be able to see that you have taken every single option you possibily could to recify things.

 

CAB can give you a list of solicitors in your area who do free sessions for CAB

It may be worth speaking to one.

hi, i know how you are feeling i was in this situation with GMAC around 18 months ago, fortunatly have a lot of equity in my property...if you have more then 45% equity try Cheltenham and Gloucester. i only earn 8k a year and i was able to have a 80k mortgage with bad credit history and didn't have to disclose my salary, am now on a decent rate with them...hope this helps, might be worth a try.

Hi everyone,finally got my mortgage sorted & is due to complete on monday.have already got a statement from gmac RE-charges & arerears, also got my statement from solicitors this morning showing redemtion figure.statement shows

expenses-£120

charges- £350

deeds production fee - £50

solicitors costs - £1432.00

repayment admin fee - £135

early redemtion charge - £4,467.68

 

can i claim all this back & does anyone know if anyone has been sucssesful in any claim against GMAC

 

there is also £1595 in fees applied to my account, I hope i can get this back as they have been total *hits to me & attemted to take my house twice.

 

I am also interested to know what the charces & expenses are for :idea:

Oh Amanda, I was so chuffed when I read you'd sorted everything out. Really sorry to hear that GMAC are messing about again. Coul dyou not borrow the extra £800 from somewhere for a few months - you'd be able to pay them back once you'd tackled GMAC for your fees, ERC back?
