      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

no money has gone in my account as of yet ive just checked online im gunna cancel my card aswell also as anyone ever heard of a company called WW.Loan-Centre.Net LOAN-CENTRE.N? well i just checked my account history online and on the my last payday the 24/03/2011 they took £74.95 from my bank account ive never even heard of them so how can they just take this money from my account ive tried emailing them but the emails just bounce back as undelivered and theres no phone number on there web page please help me get my money back

That Loancentre.net is part of Minicredit (so I believe), get onto Minicredit and ask for the fee which you did NOT authorise to be returned, if they say it is a requirement tell them a report is going to Trading Standards, Office of Fair Trading and get a crime number from the local police, this then will get you the money returned via your bank.

 

Ask the bank to give you another account as this one is now clearly compromised.

 

If you want you can also get onto your local MP and ask them to ask questions, but it is now getting near the long break period and they may not be able to help.

i checked my bank today and cfo have still paid the £200 in even tho i emailed them to tell them to cancel it now i dont no what to do as i no longer whant the loan as for loan centre.net ive spoken to my bank they are treating it as fruad

Phone CFO and ask them to take the money back, you have already informed them in emails that you do not want it, also ask the bank to return the £200 and give you a new account number as they will try and take it again, you have the paper trail refusing the loan, should this go further CFO will look complete idiots.

 

Try phoning them and tell them that you are recording the call.....

I've used them, I lost my debit card, transferred £100 which they were reluctant to give me their bank details at first, then I transferred this over thinking hey that's fine sorted.

 

However.. I was wrong, I then checked my bank to see they had returned it to me the full amount of which I had paid.

 

So I called, e-mailed everything transferred £100 to them and told them I'm paid this Wednesday they said yes that's fine we won't charge you extra.. I've got £156 to pay this Wednesday and I'm hoping this is it.. NEVER TAKE A LOAN FROM THESE PEOPLE PLEASE!!! Borrow from a friend or family member.. pay them a little bit more interest back not like these people who can't even reply to e-mails because they've got "lost" as I've been told.. how does an e-mail get "lost"!?!?!? :evil::evil::evil::evil::evil::evil::evil::evil::evil::evil::evil::evil::evil:

Phone your bank, tell them that your card has been compromised and then you can cancel that DD they put on your account, make a payment when the new card arrives.

 

I finally sorted mine out, paid .. All cleared and I'm never borrowing again from one of these companies.

WARNING: Be very careful before supplying this company with any personal orfinancial information.

I applied for a loan with this company some days back and i got suspiciouswhen the funds didn't go into my bank so i done some research and found thissite. Then i carried out a credit check on the company and found that theirworking capital is in the red £-103,665.00 and net assets are £-158,385.00.

So they are clearly using YOUR money to keep their failing business afloatand it’s not there first company they just bounce onto a new name when theadministrators are called in.

They have dozens of creditors chasing them for payments of bills. If thiscompany goes into administration before you get the money back that they areowe you, the chances of getting it back are very slim.

Hmm, so what happens if they get wound up, do we still have to pay them?

I have been trying to get them to agree to a payment plan , I have informed them I will pay what I owe and dispute their charges, they have refused, but I made the monthly payment anyway, just so they cant say I'm not trying to pay.

Yes if they go into administration the administrators would try to collect the debt. After a period of time they would sell your debt to a collections company at a fraction of it's value.

 

I would also contact Trading Standards Department or your nearest Citizens' Advice Bureau if they are refusing to setup a payment plan with you. But i suspect you are doing the right thing in making payments when you can and not just thinking it will go away.

This was referring to the people in this blog who have had moeny withdrawn from there bank accounts "in error".

 

I haven't had the loan as agreed from this company as yet but i can see they have setup a direct debit order on my account.

I checked a few others and as you would expect at 3000% APR on a loan they are all doing very well. For example MEM Consumer Finance LTD who are Payday UK have millions in working capital, all bills are paid on time, if they were a public company I would be buying shares. So either Capital Finance One directors have no clue how to run a company or they have an expense account bigger then the CEO's of the top 5 banks.

Hi,

I took out a loan with these sharks earlier this year, got in to serious trouble and defaulted on it, I changed my debit card to stop them taking random amounts when they felt like it, but I have just noticed today that they have taken £195 yesterday and £196 today. Phoned the bank and they say there is nothing they can do about it, phoned Capital Finance One and got told that they can take any amount they feel like from my new card as they got it from another website that I had a payday loan with!

Phoned the Visa fraud team and they say there is nothing they can do about it until the amounts are no longer 'pending' on Monday, if they are pending why cant they stop them? I have to phone on Monday and query it all then, but in the meantime I have £77 in the bank with a mortgage payment due on Tuesday of £747 on a suspended repossession order and nothing to pay it with, so could be homeless, thanks Capital Finance One! I darent put any money in the bank in case these people grab it, I have cancelled my card...I hate my life!

Something to keep in mind with all debits cards, (and credit cards), - if you have any sort of problem, report the card 'lost or stolen' which means that the card is cancelled with immediate affect.

It also means there will be a brand new number issued with your new card that no one knows and can't be tied into to any other past use of the card.

Beware of this company. I borrowed £250 and now owe £600 or £900 had two letters with different amounts. I cancelled my card as this is not the amount i agreed to pay back.

They managed to get my new card details. They claimed i had completed a new payday loan application with them on three different occasions. (I haven't) and because i had signed an agreement saying they could use any card details i hold, they were well within their rights to do this.

They took a £100 administration fee from my bank, they said this was the charge for them having to seek new card details.

 

I have spoke to the bank and because i have had dealing with the company they can't do anything about this. I have contacted the company requesting a break down as to what i owe and i am still waiting for this.

Just to add to my last message. Spoke to them on the phone today and the balance has changed again.. I now owe £550, They will not send you a copy of your agreement via post or supply you with a break down of your account in writing. They will give you it over the phone. Nor will they except a payment plan.. They will give you a lower balance but you will have to pay it in full or pay what is outstanding on your account..

 

If you want a payment plan you have to go through a dma and supply them with all your bank statments and payslips.. if they feel you can afford the loan they reject your offer..
