    • Today , after a lot of years i received a letter from this lot. Very friendly, "Were writing to remind you that we haven't had any contact from you in a while".  The velvet fist, followed by  a veiled threat to get their preferred debt collectors involved. Yep dead right. In 1992/3 I took out a Student load under duress from DHSS. up to 2000 I had successfully gotten deferment on low income. But rather than sign on as unemployed ,I decided to be self employed. I applied and they asked for all sorts of documents. I obliged and then correspondence ceased from them, circa 2001. To date I have had no correspondence from Student Loans. I was made redundant in 2009 and reached 65 in 2012 , at which age the loan should have been cancelled. Now , today, 12 years on retirement and 11 ( at least years after last contact) I get a letter with veiled threats. Do I , as I smell a scam a) ignore it and hope that Erudio will think that this phishing attempt has failed or b) respond with a statute barred letter or c) remind them of legal terms that loan should be cancelled 12 years ago or d) combination of b) +c)

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have been really stupid

I logged into my husbands facebook account and posted some not very nice things

 

He has found out it was me who did this and is threatening me with a police visit and that he is going to get me arrested

Can he do this?

Yes he is my husband who is aged 35 and is now having a relatoinship with an 18 year old school-girl

 

So the things are true

 

I, as his wife knew all his passwords so I cannot be accused of hacking can I ??

Well...it's never been illegal to tell the truth & the truth isn't libel or slander which would be a civil matter anyway. As for you having his login details he could have given them to you anytime & no it's not hacking & even if it was, somehow I think the police would have better things to do.;)

You can be prosecuted under Chapter 18 of the Computer Misuse Act 1990 as follows:

 

Section 1. Unauthorised access to computer material

 

Section 3. Unauthorised modification material

 

and possibly

 

Section 2. Unauthorised access with intent to commit or facilitate commission of further offences (depending upon what you wrote about him)

 

Section 1 carries a maximum sentence of six months imprisonment and/or up to £2000 fine. Section 2 and 3 carry a maximum sentence of five years imprisonment.

 

Whether the Police etc. actually do anything is another matter, of course.

The above Acts are designed to cover the hacking of government, military and financial institutions in the main.........somehow I don't think a Facebook account is in that league.

 

Even if the police were remotely interested it would be one persons word against the others as to whether permission was given to access/alter the Facebook account, especially difficult as it involves spouses and passwords not 'backdoor trojans' or other nefarious methods employed by hackers, which no doubt the OP has never heard of let alone be capable of implementing.;)

If he has been doing naughty things which are likely to incite his wife's anger, and has not changed his passwords to ones his wife would not know, then HE has been rather stupid.

 

He would have one hell of a job proving that your access to the account was "unauthorized", when he has almost certainly shared the password with you, and then not bothered to change it when he started doing things which any rational person would expect might just annoy their spouse a little bit.

 

If you still have access, delete the offending material. Then forget it. And forget him as well. There are plenty of decent men out here who don't behave like this.

Are you sure about this? The Act was a response to someone shouldersurfing a BT engineer and accessing BT systems using his passwords. But the Act was introduced to cover all unauthorised access to computer systems, not just the ones you mention.

 

I stand by my comments re. Section 1 as the access was unauthorised, but I guess it could be argued that permission to access was implied due to the sharing of the password? I withdraw my comments about section 3; it cover trojans, viruses and *phishing* amongst other things, but phishing or social engineering don't apply here. Section 2 may still be applicable though, depending on what the OP said about her spouse.

 

But as I said in my post, whether the Police do anything is another matter.

When I mentioned the government etc I did say 'in the main' & telecommunications & internet networks would be included for obvious reasons.

 

As for any police involvement, I doubt very much whether it would happen. They would see it as a 'domestic', particularly if there have been any other complaints. If you look at some of the OP's other posts you will see that she has been having a rough time of it all in all;

Have a bit of senitivity guys i`m sure Vincentfan feels really good about you letching over 18 year old schoolgirls. Have3 daughters myself one an 18 year old schoolgirl. Really like to see a 35 year old married man on my doorstep!

As for problem let him blow off steam as the others said the Police have better things to do. Good luck

Giggly 18 year old girl drags old 35 year old boyfriend to the pub for a night out with her friends. Friends are polite in their company, but in the toilets (you know what I mean girls THE TOILETS) it's a different matter, 'ewww he's sooooo old, have you seen how bald he's going, it would be like snogging your dad ewwwwww', after a night on the alchopop and people of all ages staring and talking about the fantastic couple it's time for him to carry her home as she has rendered herself unconscious after all the red bulls and vodkas. This is how it goes every night, because this is how a lot of 18 year old girls with sugar daddies live their lives. After a few weeks, the attraction of the older man has gone, she suddenly sees the whole thing for the massive joke that everyone else saw when it started, she can see that boys of her age don't have the sagging gut, chins that don't defy gravity, backs that don't need waxing (shoulders and arms) and they actually know who Lady GaGa is and know that Lilly Allen knocked her off the top spot.

 

You are well rid, he will be the laughing stock already, just wait until he is dressing like an 18 year old then you can take photos of him and poke fun on YOUR facebook account!

Lol, it hasn't happened to me, but I have been in a club where an older man (35-40) was with his 18(ish) year old girlfriend, I couldn't stop staring and I was in THE TOILETS when her friends were laughing at him. I was laughing at him by the end of the night.

I certainly wouldnt worry too much about it, even though what youve done is pretty much harassment.

Only worry if the police turn up at your door.

well, you know what i mean.

 

Lass i know thats just turned 20 only seems to go for blokes 10+ years older than her, but the novelty soon wears off when it turns out that men that age arent interested in spending 3-4 nights a week in a night club till 4am, then having to get up for work at 6 and spending all day nursing an alcopop induced hangover/sugar rush.

they also tend not to like not knowing wtf everyone is talking about and being ignored on said nights out, when 9 times out of 10 its them thats paying for it, esp if they arent getting much in the way of "favours", if you know what i mean.

 

i know i dont :D
