Received this letter from citi in response to request for return of £12 fees any ideas.

The fact remains that under contract law for their penalty charges to be lawful, the penalty charge has to bare a fair and reasonable relation to what they're costs are.

 

What they havent told you that on every occasion they have been requested by courts to provide a breakdown of their charges they have defaulted and refused.

So does this mean if I proceed to the final letter and then court stage citi will just fold or the court will dismiss my claim.

Its likely that you will have to persue them to court, Citi are likely under instruction to defend all claims made against it.

 

In this instance though we have plenty of experience against them and can prepare you well.... at the end of the day Citi have lots of weak points, submitted conflicting cost exhibits etc.

 

It might be daunting, but county court is relatively informal, a fair few of us have been through it and are able to advise.

This account has a zero balance and I am only claiming £15.

Has anyone lost a court case and had costs awarded against them.

I am happy to pursue them as a matter of principle if the risk is low.

 

There are several other CC accounts with large negative balances citi are just the first to respond to my mailings.

Theres a lot of work involved-if its only 15.00 you are claiming then I would seriously look at deciding if it will be worthwhile to you.
