Has anybody had any dealings with this company? My son seems to be being chased for an unknown debt from 2004, that they appear to have bought, and we have had a number of phone calls in 24 hours, "threatening" to take it it 'legal' & 'the next level'.

 

They are not a member of Credit Services Association, FSA or whatever

If you pick up a call from these muppets just say in writing and put the phone down.

 

If you get a letter and you stil dont know what it refers to, write back and tell them you do not recognise the debt and that until written proof is provided they can whistle in the wind

You could send this to them by recorded delivery

 

Dear Sir/Madam

 

You have contacted me/us regarding the account with the above reference number, which you claim is owed by myself/ourselves.

 

I/we would point out that I/we have no knowledge of any such debt being owed to (insert company name).

 

I am/we are familiar with the Office of Fair Trading Debt Collection Guidance which states that it unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

 

I/we would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

 

Furthermore ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

 

I/we would ask that no further contact be made concerning the above account unless you can provide evidence as to my/our liability for the debt in question.

 

I/we await your written confirmation that this matter is now closed. Otherwise I will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.

 

I/we look forward to your reply.

Thank you all for your comments/observations.

Since asking, I discovered that the letter they have sent, supposedly from 3G, has been "created", and posted from HFO's home town rather than 3G's. They have also admitted in phone conversations that they sent the letter.

 

As a result I contacted the FSA, who directed me to Consumer Direct, and also the Information Commissioner's, as HFO discussed my son's finacial liabilities with me, without asking him.

 

Consumer Direct have flagged HFO to Trading Standards, relating the the less than authentic letter, and a possible breach of Data Protection.

 

I've also written to the Head of Collections from 3G asking him to comment on the letter he is supposed to have signed (with a copy of it enclosed).

 

Will try & keep you advised of progress.
