  1. Hi, 6/6 I parked in a P & D space and went to machine to pay, in Manchester City centre - £1.45 for 30 mins, £2.90 for 60 mins, no change given, oh, and "new" 10p pieces do not work. Pay by mobile was an option, but it had cash. I inserted 2 x £1 + 2 x 20p coins, the 20p coins being rejected. Checked the dates - 2003 & 2010 (I had the rest of the fee, but only just). I then inserted a third pound coin, and pressed the green button for it to print my ticket. The machine rejected the third coin, and printed a ticket showing I had paid £2 but ONLY given me 30 mins parking time. Upon returning after 50 mins, I found a ticket had been issued after 45 mins. I appealed and have received a reply saying that my appeal has been rejected, on the grounds that the ticket had been issued correctly (I agree), but no answer as to how old a new 10p piece is, or the fact my other coins had been rejected, but instead was referred to the fact that I could have paid by phone (having paid £2 in cash, and the machine would not return it, why would I pay an additional £3?) Question: Should I pay the £25 fee, or fight this on principle? Thanks in advance for any advice or experience anyone might be able to addv
  2. I have read, on Ofcom's website, that the phone provider has to provide an ADR (Alternative Dispute Resolution) option. If they don't they are in breach of Ofcom regulations.. i cannot see on 3's or HFO's website any link to an ADR option, and have not heard from either of them since 13/12/08. I don't know whether to "poke" them with the ADR stick, go to my son's Credit File and make a note concerning his disagreement with their viewpoint, or just leave things as they are. My son has applied for a mortgage & got past the credit check stage. Anybody any experience/strong views?
  3. Hi, My son has received a letter, supposedly from Mike Reid, Collections Manager @ 3 Glasgow, to pay £216.81 to HFO Services in West Byfleet. This was the first communication relating to this since mid 2004. After many phone calls threatening an increase in amount owing up to £900, Court appearances etc, I discovered that HFO had fabricated & written the letter on photocopied 3 headed paper. Following advice from Consumer Direct, I gave HFO 14 days (which was up 5/12/08) to produce written evidence of the outstanding amount (from a phone that was returned to 3 in April-May 2004). We've now sent all copy letters etc. to Consumer Direct asking what action we can now take, but my son is just in the process of applying for a mortgage, and from other site members, it would appear that a 6 year default is going to appear. Any advice anyone please? Should I contact BBC Watchdog? What documents, if any should be sent to them? Worth writing to Sunday Times or any other papers? All comments welcome. Thanks in advance
  4. Thank you all for your comments/observations. Since asking, I discovered that the letter they have sent, supposedly from 3G, has been "created", and posted from HFO's home town rather than 3G's. They have also admitted in phone conversations that they sent the letter. As a result I contacted the FSA, who directed me to Consumer Direct, and also the Information Commissioner's, as HFO discussed my son's finacial liabilities with me, without asking him. Consumer Direct have flagged HFO to Trading Standards, relating the the less than authentic letter, and a possible breach of Data Protection. I've also written to the Head of Collections from 3G asking him to comment on the letter he is supposed to have signed (with a copy of it enclosed). Will try & keep you advised of progress.   5. Has anybody had any dealings with this company? My son seems to be being chased for an unknown debt from 2004, that they appear to have bought, and we have had a number of phone calls in 24 hours, "threatening" to take it it 'legal' & 'the next level'. They are not a member of Credit Services Association, FSA or whatever Regards, Chris Mickley
  6. I've claimed for 10 charges (value £69), and MCOL defence by Barclays shows exhaustion of time as a reason for not paying out. Should I, when returning my Allocation Questionnaire, submit a revised claim schedule, and send it to court, apologizing for my error? Copy of revised schedule to Barclays? Offer to settle on revised figure?
  7. Hi All, Sorry to be a nuiscance. I received Barclays defence, and an Allocation questionnaire, and I 've a couple of questions - please forgive the length. DEFENCE 1) Particulars of claim do not provide details or particulars of the precise charges alleged to have been unlawful or the date thereof. I have sent copies of my spreadsheet with dates etc. What does this mean? 2) 3) 4) 5) 6) 7) & 8) look like they are saying that it was all in the original contract, which were signed up for when the account was opened etc. & Legal principles relating to liquidated damages & penaly charges are denied.. 9) This, to me, is the most intriguing and concerning item. The defendant denies it is liable etc. In the alternative, (denied) if the charges amount to breach of contract, then charges prior to 13/10/2000 not recoverable due to exhaustion of time (bearing in mind that they claim that they have not received a detailed breakdown, with dates on). I originally requested refund of charges 19/8/06, sent LBA 2/9/06, and applied via MCOL 13/10/06. However in my spreadsheet claim I have inadvertently included 10 entries totalling £69.18 (against a total claim of £1142) that occurred prior to 23/11 2000. Is there a way of retrieving this situation, or have I messed it up? Finally 10) If the charges are unlawful, they are looking to ssek to recover loss & damage actually suffered.   8. Just a thought. What is the legal view on the fact that most of the claims have been met with a partial offer (albeit conditional)? Does this suggest that there is some admission of the charges being laid at their door? (I know we all know they are guilty, but do the judges think so (in their legal guidelines/directions?) Chris
  9. Hi All, Looking for guidance again please. Today is 27th day of notice served via MCOL. Defence posted by Barclays as follows; Defence You are unable to take any further action online on this claim. The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly. What should I expect now? Do I need to do some more research? Or what? Thanks in advance.

  11. What does anyone think? My son is claiming £244 + £44.42 interest. We have sent LBA (4/11/06). We owe the holders of the debt (Eversheds) £191. Letter from Halifax has offered £140 in full & Final settlement. 1) Do we accept? 2) Do we offer a compromise of £200 (middle ground)? 3) Do we refuse & pursue via MCOL? As of this date? Any advice gratefully received Chris Mickley (Case against Barclays deadline is 15/11/06 for judgement)
  12. Thought I was the only one up at this time. Thanks for prompt response, but my age is an issue. If I understand you correctly, they have 28 days from 18/10/06 (deemed as date of service of claim), which is 15/11/06, and NOT 29/11/06. Chrinorden
  13. Couple of questions. MCOL claim sent 13/10/06 - instructions say that assumed served in 5 days, takes it to 18/10. Also says defendant has 28 days to respond. Barclays has responded 30/10 to say will file a full defence, and MCOL says they have 28 days to file this. Does this mean I have to wait until 29/11 before I can file for judgement (or respond to their defence - whichever is sooner)? Congratulations to Paula v A & L by the way
  14. MCol filed tonight Claim No 6QZ73096 Northampton County Court £830 (paid referrals) + £192.41 interest + 18 per per day from today. Entitled to a response 14 days from accepatance of claim by HMCIS? How will I know if Barclays intend to defend online?
  15. Many thanks for your replies & encouragement. It is true to say that SOME of the interest was because of the overdraft. What do I do for the best (i.e. make sure my action doesn't fail)? Do I remove the interest part, and charge the 8% only on the 'Paid Referral' fees, or do I let it go & take my chances of a reduced offer?
  16. Ready to start court action against Barclays. I'm just a little nervous that the spreadsheet (which now includes 8% statutory interest claim) is error free, as I would hate to fail due to "incompetence" on my part.   17. Hi all, Feeling stupid again! LBA date was 16/9/06, but they have replied in the timescale they said they would (22/9) (holidays intervened - bad planning). They have offered partial refund (£365 as against claim for £1100+), as well as outlining their 'Terms & Conditions'. Having exceeded my own deadline, do I now just go straight to Moneyclaim, or do I accept their partial refund, then claim? 8% on total amount (including the refgunded portion) or 8% on the remaining balnce? Thanks in advance
  18. Thanks for the encouragement. Original 14 days up today. Fresh letter sent today - LBA - acknowledging disappointment at lack of refund, offering them 14 days from today to refund or I will go through claims process without further warning. Right approach??

Sent letter containing schedule of charges I was asking for (approx £1450) - 1st 14 days are up 2/9/06 Received letter (looks standard) today from Jay Sobers, Customer Relations Advisor, apologising for the fact that I have cause for concern over level of service, and will reply or update asap, but certainly by 22/9/06. (along with the obligatory leaflet) Do I go "aggresive" and remind them the deadline is 2/9/06, but I'll give them another 14 days? I want to appear reasonable, but forceful, without unecessarily putting their backs up, and giving them ammunition should I need to proceed further. Regards to all and keep up the good fight

Monday 7/8 Posted SAR form (with £10 cheque) using template letter, asking for 6 years worth Monday 14/8 Received 2 envelopes with 9 years worth of statements, and my cheque returned, stating that they don't charge for this service. Saturday 19/8 Posted Request for return of penalty charges and interest shown, including a spreadsheet schedule, for a total of £1145. No going back now - we'll see what sort of response/defence we get - if any.
  21. I sent off for my six year' worth of statements, which arrived in 2 separate envelopes, within 7 days, and they returned my £10 cheque, saying that they don't charge for this service!!
